TUESDAY, FEBRUARY 21, 1967 COMMISSIONERS PRESENT: Worthy, Bazil, Lawson, Larkin, Royer, Tom, Miller. COMMISSIONERS ABSENT: None. MINUTES: On motion by Miller and seconded by Royer, the Minutes of the Huntington Beach Planning Commission of January 31 and February 7, 1967, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP NO. 6147 Subdivider: Hotel Kin swa 0 eratin Co. e 6ubdivision Committee Report was read by the Acting Secretary. Jack King, representing the developer addressed the Commission and stated that there were no objections to the conditions suggested by the Subdivision Committee. The Planning Director explained the layout of the subdivision as it related to the original approved layout. A MOTION WAS MADE BY MILLER AND SECONDED BY BAZIL TO APPROVE THE REVISED TENTATIVE TRACT MAP NO. 6147 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received February 1, 1967, shall be the approved layout. 2. All utilities shall be installed underground. 3. Lot 38 shall be treated as "Not A Part" of this subdivision. 4. All alley and street radii shall comply with City Standards and Department of Public Works Specifications. 5. 'The transition of Stark Street from a 100' right of way to a 60 ft. right of way shall be approved by the Department of Public Works. 6. The alley between "A" Lane and "B" Lane shall line up with the alley on the north side of "C" Drive. 7. The alleys between. "A" Lane, "B" Lane and Teri Street shall intersect at right angles with "C" Drive. 8. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. 2/21/67. The Acting Secretary read a letter submitted by the Chamber of Commerce recommending that the Planning Commission retain the present industrial zoning in the area commonly referred to as the Southeast Industrial Area. RESOLUTION NO. 66-67 A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 66-67 Sub Items Q, R, S, W, X and Y and Recommending Denial of Sub Items T, U, V to the City Council. A MOTION WAS MADE -BY -MILLER AND SECONDED BY BAZIL TO ADOPT RESOLUTION NO..66-67 RECOMMENDING APPROVAL OF THAT PORTION OF ZONE CASE NO. 66-67 PERTAINING TO SUB ITEMS Q, R, S, W, X, Y TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The subject zone case will implement the,Master Plan of Land Use. 2. There is a high school site at the northeast corner of Magnolia St. and Hamilton Avenue. 3. A city park and elementary school site is located northwest of the proposed zone change. AND FURTHER RECOMMENDING DENIAL OF THAT PORTION OF ZONE CASE NO.'66-67 PERTAINING TO SUB ITEMS T, U, V TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. A FURTHER MOTION WAS MADE BY BAZIL AND SECONDED BY LARKIN TO INSTRUCT THE STAFF TO REVISE THE MASTER PLAN OF LAND USE TO CONFORM WITH EXISTING ZONING AND SET SAID ITEM FOR PUBLIC HEARING. ROLL CALL VOTE: AYES: Miller, Worthy, Bazil, Lawson, Larkin, Royer, Tom. NOES: None. ABSENT: None. THE MOTION CARRIED. ZONE CASE NO. 67-2 Applicant - U.N.A. Investors, Inc. Change of zone from R-A-O Residential Agricultural District combined with oil production to C-2 Community Business District with setback provisions. The Acting Secretary further informed the Commission that there are several lots within the boundaries of the zone change that are not owned by the applicant and have not been included in the request. RESOLUTION NO. 67-2 A Resolution of the City Planning Commission Recommending_ -approval of Zone Cage -No ,,67-2_for a`C-4 zone rather-tT an G-2__as requested to the City Council. A MOTION WAS MADE BY LAWSON AND SECONDED BY ROYER TO ADOPT RESOLUTION NO. 67-2 RECOMMENDING APPROVAL OF ZONE CASE NO. 67-2 FOR A C-4 ZONE RATHER THAN C-2 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. The proposal will conform to the Master Plan of Land Use. ROLL CALL VOTE: AYES: Miller, Worthy, Bazil, Lawson, Larkin, Royer, Tom. NOES: None. ABSENT: None. THE RESOLUTION WAS ADOPTED. USE VARIANCE NO. 67-1 - Continued Applicant - Paul A. Cooper To permit the continuance of a retail and wholesale business of peat soil and fertilizer in the R-A-O Residential Agricultural District combined with oil production. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience, there being no comment the hearing was closed. The Acting Secretary stated that the applicant was not present and suggested that the Commission continue the matter until he arrives. THE MOTION CARRIED. ZONE CASE NO. 67-5 RESOLUTION OF INTENT Change of zone from: 1) M-1-0 Light Industrial District combined with oil production to,. M-1 Light Industrial District; -4- 2/21/67. The Acting Secretary informed the Commission that this proposal is to implement the City Council's policy to remove the "0" designation from properties not within producing oil areas. The hearing was opened to the audience.. Mrs. Sarah Matineau, 209 Baltimore Street, City, and Helen Driver, 1225 W. Cruses Street, Wilmington, California, addressed the Commission and opposed the removal of the "0" designation. There being no other comment the hearing was closed. A lengthy discussion was held by the Commiss-ion. RESOLUTION NO. 67-5 A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 67-5 to the City Council. A MOTION WAS MADE BY LARKIN AND SECONDED BY LAWSON TO ADOPT RESOLUTION NO. 67-5 RECOMMENDING APPROVAL OF ZONE CASE NO. 67-5 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. This proposal will implement the City Council's policy to remove the "0" designation from properties not within pro- ducing oil areas. ROLL CALL VOTE: AYES! Worthy, Bazil, Lawson, Larkin, Royer, Tom. NOES: Miller ABSENT: None THE RESOLUTION WAS ADOPTED. COMMISSIONER BAZIL: Commissioner Bazil was excused from further participation at 7:40 P.M. ZONE CASE NO. 67-6 Applicant - Kenneth & Jacqueline Ferrara Change of zone from R-1 Single Family Residence District to C-4 Highway Commercial District with setback provisions. -5- 2/21/67. Charles Osterlund, 5902 Nordina Drive, City, addressed the Commission and asked why the zone change was filed. He was also concerned with setback provisions. Kenneth Ferrara, applicant, addressed the Commission and stated that the change of zone was filed to permit the subject property to be used for an equipment rental. There being no other comment the hearing was closed. It was the consensus of the Commission to continue Zone Case No. 67-6 to March 21, 1967, in order for the Staff to prepare a Master Plan and Zone Change study for the area. NOES: None. ABSENT: Bazil THE MOTION CARRIED. USE VARIANCE NO. 67-1 Applicant - Paul Cooper The Chairman re -opened the hearing to the audience. Paul Cooper, applicant, addressed the Commission and requested that the variance be granted for a period of 5 years. Robert Bruce, City, addressed the Commission and suggested that the applicant accept approval for one year to allow time to work out arrangements for dedicating Goldenwest Street. There being no other comment the hearing was closed. A MOTION WAS MADE BY MILLER AND SECONDED BY TOM TO APPROVE USE VARIANCE NO. 67-1 WITH THE FOLLOW- ING CONDITION: 1. A MOTION WAS MADE BY LAWSON AND SECONDED BY MILLER TO APPROVE USE VARIANCE NO. 67-5 UPON THE FOLLOWING CONDITION: 1. All provisions of Code Amendment No. 67-1 shall be complied with. ZONE CASE NO. 67-7 RESOLUTION OF -INTENT Change of zone from: 1) R-A Residential Agricultural District to C-4 Highway Commercial District with setback provisions; 2) R-A Residential Agricultural District to R-5 Office -Professional District; 3) R-A Residential Agricultural District to R-1 Single Family ,Residence District; 4) R-A Residential Agricultural District and R-2 Two Family Residence District to all R-2 Two Family Residence District. The Planning Director made a presentation of the proposal. The hearing was opened to the audience. Julius Gomes,x-epresehting 3 property owners addressed the Commission and submitted_a__A alternate proposal. RobertHarron, City, addressed the Commission and asked what his property was proposed to be zoned. There being no other comment the hearing was closed. PRECISE PLAN ALIGNMENT NOT 67-1 RESOLUTION OF INTENT he hearing was opened to the audience on the Precise Plan for Street Alignment for Goodwin Lane, Patterson Street, Lisa Lane and two future local streets. There being no comment the hearing was closed. It was the consensus of the Commission to continue the matter to March 7, l967, since it is in conjunction with Zone Case No. 67-7. CODE AMENDMENT NO. 67-1 The Acting Secretary informed the Right-of-way Dedication Commission that this code amendment and Improvements clarifies the provision of the Code as to when dedication and improvements of highways, streets and alleys must take place, by excluding certain uses and improvements. The'heaxing was opened to the audience, there being no comment the hearing was closed. A MOTION WAS MADE BY LARKIN AND SECONDED BY LAWSON TO RECOMMEND ADOWION OF CODE AMENDMENT NO. 67-1 TO THE CITY COUNCIL. ROLL CALL VOTE: AYES: Lawson, Miller, Worthy, Larkin, Royer. NOES: None. ABSENT: Bazil, Tom. THE MOTION CARRIED. CODE AMENDMENT NO. 67-2 Variances - Time Limit require a one year time a specific use after a has been denied. The Acting Secretary informed the Com- mission that this amendment was initiated by the City Council. Said amendment will limit for filing a Conditional Exception for zone change request permitting the same use The hearing was opened to the audience, there being no comment the hearing was closed. CODE AMENDMENT NO.. 67-3 Minimum Lot Widths requlating minimum -lot The Acting Secretary informed the Com- mission that this amendment clarifies the -intent of sections of the Code widths and frontages. The hearing was opened to the audience, there being no_comment the hearing was closed. CODE AMENDMENT NO. 67-4 Park and Recreation'Facilities The Acting Secretary informed the Commission that this amendment clarifies the intent of Section 9744.3 by: 1) Crediting two family and multiple family units for fees paid,under the Subdivision Ordinance; 2) Requiring the developer -to pay the difference between the fee paid when the subdivision records and -the fee paid when building permits are issued if there is a time,lapse of 2 years; 3) Re -number- ing certain sections and; 4) Adding a severability clause. The hearing was opened to the audience, there being no,comment the -hearing was closed. ABSENT: Bazil, Tom. ' THE MOTION CARRIED, DISCUSSION: The Commission discussed the proposal to rezone certain areas within the boundaries of Zone Case No. 67-4 but not included in the request. A MOTION WAS MADE BY LAWSON AND SECONDED BY MILLER TO INSTRUCT THE STAFF TO INITIATE A RESOLUTION OF INTENT TO REZONE THE PROPERTIES WITHIN THE BOUNDARIES OF ZONE CASE NO. 67-4 TO C-4 AND SET SAID MATTER FOR PUBLIC HEARING. ROLL CALL VOTE: AYES: Miller, Worthy, Larkin, Lawson, Royer. NOES: None. ABSENT: Bazil, Tom. THE MOTION CARRIED. COMMUNICATION: The Acting Secretary read a letter submitted by George Gavora requesting reconsideration of a.variance previously denied by the Board of Zoning Adjustments. Page No. 10 Minutes: H.B. Planning Commission Tuesday, February 21, 1967• COMMUNICATION: The Acting Secretary read a letter submitted by L. J. Newcomb, requesting permission to construct a residence adjacent to a storm drain easement rather than conform to the required 5 ft. setback. The Acting Secretary informed the Commission that the applicant was seeking permission to be re- lieved from one of the Standard Conditions of Approval for Tentative Tract Maps and that relief has been granted in similar instances. The Commission considered the request. A MOTION WAS MADE BY LAWSON AND SECONDED BY MILLER TO APPROVE THE REQUEST SUBJECT TO THE FOLLOW- ING CONDITIONS: 1. No portion of the dwelling including architectural features may encroach into the easement. 2. The applicant shall enter into a waiver of damages and right of ingress and egress agreement with the City of Huntington Beach. ROLL CALL VOTE: AYES: Miller, Lawson, Larkin, Royer, Worthy.
