The Minutes of March 8, 15 and
22, 1967 were accepted as trans-
cribed.
USE PERMIT NO. 67-8
Applicant: Robert Johnson
To permit a home occupation for
the puse of conducting an import and export business
in therpo1 Sin le Family Residence District. Located at
5172 Edinger venue and legally described as Lot 12 of
Tract 3616.
The hearing was opened to the
audience.
Mr. Johnson, the applicant, explained
the request to the Board. He stated that the business
would be limited to a desk and cabinet in one room. He
also informed the Board that he could comply with the ordi-
nance regulating home occupations.
There being no further comment, the
hearing was closed to the audience.

AREA VARIANCE NO. 67-22
Applicant: SS. -Simon and Jude Church
To allow construction of a 3 ft.
high block wall in deviation to the 6 ft. high block wall
as shown on the approved plot plan for Use Variance No. 885.
Said wall is located on the east property line of a parcel
of land located on the northeast corner of Magnolia Street
and Indianapolis Avenue. Legal description on file in the
Planning Department.

The Secretary read a letter from the
applicant requesting that the wall running north and south,
from Indianapolis Avenue to the north property line be
eliminated rather than reduced as requested because the
church is in the process of acquiring the adjacent 2.8
acres of land.
Alfred J. Fontaine, representing the
applicant, explained the request to the Board. He felt
that it would not be necessary to construct the wall at
the. -present time because the entire site will be fenced
when the adjacent property is acquired.
There being no other comment, the
hearing wa-s closed to the audience.
A MOTION WAS MADE BY MANDRELL AND
SECONDED BY HARLOW TO APPROVE AREA VARIANCE NO. 67-22 AS
AMENDED SUBJECT TO THE -,FOLLOWING CONDITION:
1. Construction of the wall shall be waived for a period
of one year or until such time as the tract map for
the adjacent property is recorded, whichever is sooner.
FOR THE FOLLOWING REASONS:
1. The Church is planning to acquire the adjacent 2.8
acres of land, at which time the entire site will be
fenced.
2. The adjoining tract to the north has a low percentage
of occupancy, therefore a wall will not be necessary
within the one year period.

AREA VARIANCE NO. 67-23
Applicant: Air -Vent Aluminum Awning Company
To allow an addition to a single family
dwelling to encroach into the required minimum open space
causing the minimum dimension to be reduced to 14-ft. in
deviation to the required 20 ft. Located at 16751 Heritage
Lane, City, and legally described as Lot 42 of Tract 5735.
The hearing was opened to the audience.
The Secretary stated that the applicant
requested a one week continuance.
There being no other comment, the
hearing was closed to the audience.

AREA VARIANCE NO. 67-24
Applicant: Raymond Murphy
To allow a business with 199 sq.ft.
of sign area in deviation to the allowed maximum of 93 sq.ft.
Located at 6042 Edinger Avenue and legally described as the
north-2 acres of the west 16 acres of the NW4, Section 22-5-11.
The hearing was opened to the audience.
N. C. Zeitvogel, representing the
applicant, explained the request to the Board. He stated
that the signs proposed are the standard signs used in all
Jack -in -the -Box Drive -Ins.
It was noted'by the Board that the
total sign area is 162 sq. ft. rather than the 199 sq. ft. as
advertised.
Dick Pomeroy, representing Jack -in -
the -Box Drive -Ins, stated .that they control the entire 330-ft.
of frontage from the corner to -the medical center.
The Board informed Mr. Pomeroy that
if the property is divided -or developed into different uses
they would be limited to very little sign area. '
Mr. Pomeroy stated that they could
reduce the size of the sign to meet the requirements of the
ordinance; however, they felt it necessary to have the sign
located along the west lot line.
It was the consensus of the Board
that the sign along tbe.west lot line would not require a
variance because the line is for lease purposes only and
not a property line.
There being no other comment, the
hearing was closed to the audience.

SECONDED BY MANDRELL TO DENY AREA VARIANCE NO. 67-24.

AREA VARIANCE NO. 67-18 - continued
Applicant: Huntington Harbour Corporation.
To allow a roof overhang to encroach
6 inches into the required setback for architectural features
on the north side of a house and to allow a 12 inch encroach-
ment into the required setback for architectural features on
the south side of a house. Located on the east side of Sea
Witch Lane, approximately 134 ft. south of Kamalii Drive,
Huntington Beach, and legally described as Lot 110, Tract
No. 5050.

A MOTION WAS MADE -BY MANDRELL AND SECONDED
BY HARLOW TO APPROVE AREA VARIANCE NO. 67-18 SUBJECT TO THE
FOLLOWING CONDITION:
1. The eaves shall be setback 2 ft. from property line.
It was noted that this could be accomplished by cutting
the eaves back'or shifting the lot line between Lots 109
and 110.
FOR THE FOLLOWING REASONS:
1. FHA requires a minimum 48" separation between.eaves
on adjoining house.
2. There are no windows required for light and ventilation
on this side of the house.

AREA VARIANCE NO. 67-20 -'continued
Applicant: Huntington Harbour
To allow a facia (not a solid roof) to -encroach
into the required setback for architectural features. Located
southeast of Kamalii Drive, approximately 80 ft. northeast of
Sea Witch Lane, Huntington Harbour and legally described as
Lot 113 of Tract No. 5050.
Dick Maitland, representing Huntington Harbour,
explained the request to the Board.
It was noted by the Board that all abutting
properties are owned by the applicant.
There being no other comment, the hearing
was closed to the audience.

A MOTION WAS MADE BY HARLOW AND SECONDED BY
MANDRELL TO APPROVE AREA VARIANCE No. 67-20 FOR THE FOLLOW-
ING REASONS:
1. The design of the open facia is such that water will
not run onto adjoining properties.
2. The encroachment occurs at the second story.

Applicant: Huntington Harbour
To allow a roof overhang to encroach 6"
into the required setback for architectural features and to
allow an 8 ft. high wingwall to extend to the property line
in deviation to the 6 ft. height limit. Located on the
west side of Beruna Lane, approximately 105 ft. south of
Kamalii Drive, Huntington Harbour and legally described
as Lot 116 of Tract No. 5050.
Dick Maitland, representing Huntington
Harbour, explained the request.
There being no other comment, the
hearing was closed to the audience.

A MOTION WAS MADE BY FERGUSON AND
SECONDED BY MANDRELL TO APPROVE AREA VARIANCE NO. 67-21
FOR THE FOLLOWING REASONS:
1. Inasmuch as the encroachment occurs on the second
story, the roof overhang will not interfere with
the adjoining property.
2. A 41 separation between eaves on this house and the
adjoining house will be provided, which is the minimum
requirement for FHA.
3. Access to the rear of the lot is provided through
the fence by a gate.
4. The fence adds to the aesthetics of the neighborhood.
5. Wall at this location does not interfere with adjoining
property view or safety.
