HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS

BOARD MEMBERS PRESENT: John Mandrell, Sam Ferguson,
Richard Harlow.
BOARD MEMBERS ABSENT: None.
USE PERMIT NO. 67-9
Applicant: Washington Capitol Company
To permit the construction of
commercial buildings in the C-4 Highway Comme rcial_District.
Located on the east side of Beach oulevard, 330 feet south
of Ellis Avenue. Legally described as being a portion of
the S 2, NW4, NW4, SE4 of Section 36-5-11.
The hearing was opened to the
audience.
There being no one present to speak
for or against the matter, -the hearing was closed to the
audience. I
The Secretary informed the Board
that the subject use permit is a renewal since the applicant,ts
previous application has expired.
Board discussion followed.
A MOTION WAS MADE BY MANDRELL AND
SECONDED BY HARLOW TO APPROVE USE PERMIT -NO. 67-9 SUBJECT TO
THE FOLLOWING CONDITIONS:
1. Beach Boulevard shall be fully improved to State Standards.
Improvements shall include street trees, street signs;
and street lights.
2. Water supply shall be through the City of Huntington Beach's
water system.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
4. The property shall participate in the local drainage
assessment district.
5. Preliminary and final soil reports shall be submitted by -
an approved private soils engineer to the City prior to
the issuance of building permits.
6. A plan copforming to the grading ordinance shall be sub-
mitted to the Department of Public Works for approval prior
to the issuance of a building permit.

7. All utilities shall be installed underground.
8. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
9. Fire alarm system conduit and appurtenances shall be in-
stalled by the developer at locations and to specifica-
tions provided by the Fire'Department.
10. Off-street parking facilities including landscaping, arrange-
ment, access paving and striping shall conform to Article
979.
11. A masonry wall shall be constructed along the rear pro-
perty line. The heigght of said wall shall be such that
the top -will be six K) ft. above the highest ground surface
within twenty (20) ft. of the common property line.
12. A copy of the recorded 40 ft. easement providing ingress
and egress to the subject property from Ellis Avenue shall
be submitted to the Planning Department -for approval.
Said easement shall be paved .to a minimum width of 25 ft.
to Building Department Standards.
13. The 10' wide driveway located behind the building on the
north property line shall be posted "ONE WAY, DO NOT ENTER."
14. Off-street parking shall be based on the following ratio:
2nd floor -one space per 300 sq. ft. of floor area.
1st floor -one space per 200 sq.ft. of floor area for 75% of
the 1st floor and one space per 300 sq. ft. of floor area
for the remaining 25%.
15. The Fire Department shall approve the plot plan.
16. A revised plot plan conforming to the above conditions
shall be submitted to the Planning Department prior to
issuance of a building permit.

Annlicant: Carley Lepak
To allow a'home occupation for the purpose
of conducting an office for the sale of household furnishings.
Located at 10291 Meredith Drive and legally described as Lot 68
of Tract 5197.
The hearing was opened to the audience.
Mr. Lepak, the applicant, explained the
request to the Board. pe stated that the business would be
limited to a phone and there would be no personal contact.
He also stated that he will comply with the ordinance regul-
ating home occupations.
There being no other comment, the hearing was
closed to the audience.

AREA VARIANCE NO. 67-23 - continued
Annlicant: Air -Vent Aluminum Awning Company
To allow an addition to a single
family dwelling to encroach into the required minimum open
space causing the minimum dimension to be reduced to
14 ft. in deviation to the required 20 ft. Located at
16751 Heritage Lane, Huntington Beach, and legally des-
cribed as Lot 42 of Tract 5735.
The hearing was opened to the
audience.
Mary Hall, representing the appli-
cant, explained the request to the Board. She stated
that if the patio cover was designed to fit the ordinance
the post supporting the cover would be in front of the
sliding door.
It was the consensus of the Board
that a patio cover could be installed to conform to the
ordinance without a hardship.
There being no other comment, the
hearing was closed to the audience.

THE FOLLOWING REASON:

PLOT PLAN AMENDMENT NO. 67-1

To allow a plot plan amendment
for the purpose of using an existing building for indus-
trial purposes. Said building was designed for industrial
purposes but authorized to be used as a temporary labor
camp building under Use Variance No. 657. Located on
the west side of Gothard Street, &pproximately1317ft.
south of Talbert Avenue. Legal description on file in
the Planning Department Office.
The hearing was opened to the
audience.
The Secretary stated that the
applicant requested a one week continuance.

FERGUSON TO CONTINUE PLOT PLAN AMENDMENT NO. 67-1, UNTIL
APRIL 12, 1967.

AREA VARIANCE NO. 67-25
Applicant: James Schuler
To allow a 7 ft. front yard setback at one corner
of a building -on -Lot 14 - of. Tract 5500 and to allow a 5 ft. rear
yard setback for a portion of a main dwelling constructed over
a garage having.a 5 ft. setback in devia tion'to the required
10 ft. rear yard setback for dwellings in the R-3 Limited Mul-
tiple Family Residence District for Tract 5500. Located on
the east side of Pinehurst Lane, approximately 410 ft. south
of Warner Avenue -and -legally. -described as Lot 14 of Tract 5500.
The hearing was opened to the audience.
Don Kavanaugh, 'owner of the subject property,
explained the request to the Board. He stated that the en-
croachment only occured-at one corner of the house which was
brought about by a change in street plans while the street was
under construction.
It was the consensus of the Board that a code
amendment should be prepared.to allow the second story of an
apartment to setback 5 ft. from the rear property line when
abutting an alley.
There being no other comment, the hearing was
closed to the'audience.

A MOTION WAS MADE BY FERGUSON AND SECONDED
BY HARLOW TO PREPARE A CODE AMENDMENT RECOMMENDING THAT THE
SECOND STORY OF AN APARTMENT ABOVE A GARAGE BE PERMITTED TO
EXTEND TO WITHIN 51 OF THE REAR YARD WHEN ABUTTING AN ALLEY.

DIVISION OF LAND NO. 67-12
Applicant: J. Trinidad Hernadez
To allow a Division of Land into
3 separate parcels. Located at the southeast corner of
Jefferson Lane and Slater Avenue and legally described
as Lot 18 of Tract 439.
The hearing was opened to the
audience.
The suggested conditions of
approval were reviewed and accepted by Mr. Hernadez, the
applicant.
There being no other comment,
the hearing was closed*to the audience.

SECONDED BY MANDRELL TO -APPROVE DIVISION OF LAND NO. 67-12
SUBJECT TO THE FOLLOWING CONDITIONS:
1. Jefferson Street and Slater Avenue shall be dedicated
and fully improved to City standards at the time each
parcel is developed. Improvements shall include street
trees, street signs, and street lights.
2. All streets shall conform to City of Huntington Beach
Standards. Master Plan of Arterial Streets and Highways
Standards shall apply where applicable. Street sections
shall'be determined by soil "R" value and traffic index.
3. Water supply shall be through the City of Huntington
Beach's watersystem at -the time each parcel is developed.
4. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time each parcel is devel-
oped.
5. The property shall participate in the local drainage
assessment district, -at the time each parcel is'developed.
6. "Preliminary and final soil reports shall be submitted
by an approved private soils engineer to the City prior
to issuance of building permits.
7. All utilities shall be installed underground.
8. The water, sewer, and fire hydrant system shall be
approved by the Department of Public Works and Fire
Department.
9. An alley shall be prov-rded along.the.rear of parcels A,
B & C to Department of Public Works standards.
10. Vehicular access rights to Slater Avenue sha11 be
dedicated to the City of Huntington Beach.
11. The Division of Land shall not be effective until an
agreement is signed and recorded agreeing to the
conditions listed above.

ARplicant: Argus Homes, Inc.
The Secretary informed the Board that this
item and the next three items on the Agenda were similar
requests which pertain to the same area. He suggested that
the hearing be opened to the audience on all -four items.
The hearing was opened to the audience on
Division of Land Nos. 67-85 67-95 67-10, and 67-11.
Ron Miller, representing the applicant,
explained the request to the Board. He stated that the
original houses intended for these lots have been replaced
by new models which no longer fit,the lots, thereby neces-
sitating an adjustment in lot lines.
There being no other comment, the hearing
was closed on all four items.

DIVISION OF LAND NO. 67-8 - To allow the adjustment
of lot lines between Lots 6 and 7 on Tract 6003. Located -
on -the west side of -Suburbia Lane, approximately 119 ft.'
