BOARD MEMBERS PRESENT: John Mandrell, Sam Ferguson, Richard Harlow. BOARD MEMBERS ABSENT: None. AREA VARIANCE NO. 67-27 - Continued Applicant: Forbeck-Montgomery To allow the following: 1) A 5 ft. front yard setback in deviation to the required 15 ft.; 2) A 6 ft. rear yard setback in deviation to the required 10 ft.; 3) Projection of the second floor, open deck, to within 2 ft. of the front property line; 4) A waiver of the required 900 sq. ft. of open space; 5) A front entry garage to be set- back 5 ft. from the front property line in deviation to the required 22 ft. setback; 6) To exceed the maximum lot coverage of 50%; 7) To allow architectural features to encroach into the required setback for architectural features. Located at 16868 Bayview Drive and legally described as the SE/4 of Lot 7, Block 412, Tract 21 and Lot 9 of Tract No. 5829. The hearing was opened to the audience. Ron Montgomery, the applicant, explained the request to the Board. He answered various questions asked by the Board. He stated that two off-street parking spaces, which consist of one garage and one open space will be provided. It was noted by the Board that this request exceeded the standards set forth by the community association and adopted by the Orange County Planning Commission for the Sunset Beach area. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO APPROVE AREA VARIANCE NO. 67-27 FOR THE FOLLOWING REASONS: 1) An in depth study of this entire area was performed by the Orange County Planning Department which resulted in a list of criteria for development of these sub- standard lots. The Orange County Planning Department has been approving variances based on the established criteria. In this case the applicant is providing greater set- backs than those set forth in the report. 2) Although a 22' setback is required for garages, the depth of the lot is such that if the set- back were provided it would provide an undue hardship on the property owner. Also an adequate turning radius is provided for the one garage entered from the street. 3) Houses in the surrounding area are in poor condition, and this new construction could be the encouragement needed to have other property owners improve their land. A FURTHER MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL TO FORWARD THE ORANGE COUNTY TECHNICAL REPORT OF SUNSET BEACH - SURFSIDE STUDY TO THE PLANNING COMMISSION FOR THEIR CONSIDERATION. AREA VARIANCE NO. 67-28 - Continued Applicant: Forbeck-Montgomery To allow a 7 ft. 6 in. rear yard setback in deviation to required 10 ft. in the R-1 Single Family Residence District. Located at 17123 Roundhill Drive and legally described as Lot 107 of Tract No. 4880. The hearing was opened to the audience. Mr. Montgomery, the applicant, explained the request to the Board. It was noted by the Board that an investigation of the property revealed that the adjoining lot to the rear is 6 ft. lower in elevation, and has a 6 ft. high fence on the rear property line at the top of the slope thus providing visual and sound separation between the houses. -2- 4/26/67. A MOTION WAS MADE BY MANDRELL AND SECONDED BY HARLOW TO APPROVE AREA VARIANCE NO. 67-28 SUBJECT TO THE FOLLOWING CONDITION: 1. The height of the proposed addition shall not exceed one story. FOR THE FOLLOWING REASON: l..The adjoining lot to the rear is 6 ft. lower in elevation and has a 6 ft. high fence on the property line at the top -of the slope, providing both visual and sound separation between houses. Schuler To allow a 5 ft. rear yard setback for a portion of a main dwelling constructed over a garage having a 5 ft. setback in deviation to the required 10 ft. rear yard setback for dwellings in the R-3 Limited Multiple Family Residence District. Located on the northeast corner of Goldenwest Street and Norma Drive. Legally described as all of Tract No. 6371. The hearing was opened. James Schuler, the applicant, explained the request. It was noted by the Board that a code amendment has been -initiated to allow this type of request. The hearing was closed to the audience. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL TO APPROVE AREA VARIANCE NO. 67-29 FOR THE FOLLOWING REASON: 1. AREA VARIANCE NO. 67-30 Applicant: Decon Corporation To allow a temporary on -site 10' x 30' subdivision directional sign to be located within the required 50 ft. front yard setback in the C-2 Community Business District at the southeast corner of Mariner Drive (a private street) and Pacific Coast Highway and legally described as Lot 1 of Tract 5864. The hearing was opened to the audience. Peter Vogel, representing the applicant, stated that this request is a renewal for an exist- ing sign which was originally approved in March-1966. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY FERGUSON AND SECONDED BY MANDRELL TO APPROVE AREA VARIANCE NO. 67-30 SUBJECT TO THE FOLLOWING CONDITION: 1. The sign shall be removed by April 26, 1968 or as soon as the tract is sold, whichever is sooner. ROLL CALL VOTE: AYES: Mandrell, Ferguson, Harlow. NOES: None.. ABSENT: None. THE MOTION CARRIED. DIVISION OF LAND NO. 67-14 Applicant: Heisel D. Martin, Jr. To allow the adjustment of lot lines between Lots 12 and 13 of Tract No. 6239. Located on the west side of Burnham Circle, 269 ft. south of Weymouth Lane. Legal description on file in the Planning Department Office. The hearing was opened to the audience. USE PERMIT NO. 67-13 Applicant: Terrence Behlmer To permit a home occupation for the purpose of conducting a printing business. Located at 15862 Standish Lane and legally described as Lot 10 of Tract No. 4144. The hearing was opened to the audience. Mr. Behlmer, the applicant, stated that he can comply to the ordinance regulat- ing home occupations. He further stated that the use will be separated from the garage by partitions. The hearing was closed. Board discussion followed. A MOTION WAS MADE BY FERGUSON AND SECONDED BY MANDRELL TO APPROVE USE PERMIT NO. 67-13. ROLL CALL VOTE: AYES: Mandrell, NOES: None. ABSENT: None. THE MOTION CARRIED. Ferguson, Harlow. PLOT PLAN AMENDMENT NO. 67-2 Applicant: Armour Development Co. To permit a plot plan amendment for the purpose of amending "The Criteria as Guidelines for Approval of a Precise Plan" for Area Variance No. 67-8, which prohibits architectural features from projecting beyond the property line; to permit eaves to encroach one (1) foot over the adjoining lot. Located on the northeast corner of Magnolia Street and Atlanta Avenue. Legally described as Tentative Tract No. 6283. The hearing was opened. Mr. Armour, the applicant, showed various displays of the proposed request and explained them to the Board. He stated that there will only be a 1 ft. eave projection over the side property line. He further added that the existing conditions of approval will only provide a 7 ft. clear width between eaves of adjoining houses because eaves may project 3 ft.. into the required 10 ft. setback and that this proposal will provide an 8 ft. clear width between eaves. Earl Klatenbach, architect, also explained the request and pointed out several advantages of the eave projection. There being no other comment, the hearing was closed. -5- 4/26/67. It was the consensus of the Board to continue said matter for a special meeting on April 27 for further review.
