COMMISSIONERS PRESENT: Miller, Worthy, Bazil, Royer
COMMISSIONERS ABSENT: Larkin, Lawson, Tom
MINUTES: On motion by Miller and seconded by
Royer, the Minutes of the Huntington
Beach Planning Commission of May 2, 1967, were accepted as
transcribed and.mailed by the Secretary.
COMMISSIONERS LAWSON AND TOM: Commissioner Lawson and Com-
missioner Tom arrived at 6:20 P.M.
and assumed their duties.
USE VARIANCE NO. 67-22 - Continued

The Staff Report was read by the
Acting Secretary.
The Planning Director explained the
proposal. He informed the.Commission that the Staff prepared
a zoning study for this entire area and it was their recom-
mendation that the central industrial area be extended
southerly to Clay Avenue between Golden West Street and
Huntington Avenue.
The hearing was opened to the audience.
The applicant addressed the Commission
and gave his reasons for the request.
There being no other comment the
hearing was closed.
A MOTION WAS MADE BY MILLER AND
SECONDED BY BAZIL TO APPROVE USE VARIANCE NO. 67-22 UPON
THE FOLLOWING CONDITIONS:
1. Provisions shall be made to provide a.20 ft. wide vehicular
access way to Garfield Avenue. Said access way shall be
paved to Building Department Standards.
2. All provisions of Article 951, Ml-A District, shall be
complied with. However, the required side yard setback
along the east property line need not be provided.

3. A plan incorporating the above conditions shall be
submitted to the Planning Department for approval.
AND FOR THE FOLLOWING REASON:
1. The required side yard setback along the east property
line need not be provided because it abuts the City
Reservoir and would serve no purpose.

TENTATIVE TRACT MAP NO. 6084 - Continued
EXTENSION OF TIME
USE VARIANCE NO. 66-59 - Continued
Applicant - Deane Brothers
To permit the following:
1) 46 ft., 50 ft. and 54 ft. right-of-way streets as indicated
on TT. 6084. Subject streets are in compliance with
standards delineated on a memorandum from the Deputy
Director of Public Works, 8/3/65.
2) 10 ft. minimum front yard setbacks for fences not over
six feet in height and for garages with a side approach.
3) A minimum three ft. side yard on one side of a lot pro-
vided the abutting side yard of the adjoining lot is not
less than five feet.
4) A 15 ft. minimum rear yard setback on irregular shaped
lots and on other lots only where a front patio is
provided. (Patio being defined as a paved area enclosed
with a fence.)
5) Lots in each block to average 60 ft. in width with 6000
sq. ft. of lot area. Minimum lot will not be less than
50 feet in width, with 5000 sq. ft. of lot area.
6) 45 ft. property line radius on cul-de-sacs, with 40 ft.
curb return radius on cul-de-sacs.
The Acting Secretary informed the
Commission that litigation has not yet been worked out and
the developer has requested an additional continuance to
December 19, 1967.

there being no comment the hearing was closed.

SECONDED BY LAWSON TO CONTINUE THE DECISION ON TENTATIVE TRACT
MAP NO. 6084 AND USE VARIANCE NO. 66-59 TO DECEMBER 19, 19679
AT THE REQUEST OF THE DEVELOPER.

TENTATIVE TRACT MAP NO. 6404
Subdivider: Barry Berkus
The Subdivision Committee Report was
read by the Acting Secretary.
Barry Berkus, applicant, addressed
the Commission and explained the proposal.
A.MOTION WAS MADE BY TOM AND SECONDED
BY ROYER TO APPROVE TENTATIVE TRACT MAP NO. 6404 UPON THE
FOLLOWING CONDITIONS:
1. The Tentative Map received June 15, 1967, shall be the
approved layout.
2. A11 applicable conditions of Use Variance No. 67-16
shall be complied with,
3. Approval of Tentative Tract No. 6404 shall apply only
to the approved plot plan for Use Variance No. 67-16.
4. All "Standard Conditions of Approval" for tentative
tracts that are applicable shall be complied with.

ZONE CASE NO. 67-17
Applicant - Barry Berkus
Change of zone from C-4 Highway
Commercial District to R-2 'Two Family Residence District.
The Acting Secretary informed the
Commission that both Tentative Tract Map No. 6404 and Zone
Case No. 67-17 were required as a condition of approval on
Use Variance No. 67-16.
The hearing was opened to the audience.
Barry Berkus, applicant, addressed
the Commission and offered to answer any questions.
There being no other comment the
hearing was closed.
RESOLUTION NO. 67-17 A Resolution of the City Planning
Commission Recommending Approval of
Zone Case No. 67-17 to the City Council.
A MOTION WAS MADE BY TOM AND SECONDED
BY ROYER TO ADOPT RESOLUTION NO. 67-17 RECOMMENDING APPROVAL
OF ZONE CASE NO. 67-17 TO THE CITY COUNCILFOR THE FOLLOWING
-REASONS:
1. The zone change will be compatible with the proposed use
of property.
2. This is a condition for approval of Use Variance No. 67-16.

The Subdivision Committee Report and
the Staff Report were -read by the Acting Secretary.
The hearing was opened to the audience
on Use Variance No. 67---28: -
Charles Middleton, representing the
applicant, addressed the Commission and offered to answer
questions.
There being no other comment the
hearing was closed.
A MOTION WAS MADE BY BAZIL AND SECONDED
BY MILLER TO APPROVE TENTATIVE TRACT MAP NO. 6151 UPON THE
FOLLOWING CONDITIONS:
1. The Tentative Map received May 31, 1967, shall be the
approved layout.
2. Approval of this Tentative Map shall be null and void
unless Use Variance No. 67-28 is approved by the City
Council.
3. All utilities shall be installed underground.
4. Vehicular access rights from Lot 41 to Prairie Street
shall be dedicated to the City and a 6 ft. concrete
block wall shall be constructed to City Standards along
the south line of Lot 41.
5. A-1-1 "Standard Conditions of Approval" for tentative
tracts that are applicable shall be complied with.

NO. 67-28-TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS:
1.----All streets shall comply -with standards proposed by the
Department of Public Works and approved by both the
Planning Commission (august 3, 1965) and City Council
(Sept. 7, 1965).

2. A tree, equivalent to a 30 inch box tree, as approved
by the Park Supervisor, shall be planted in the front
yard of each lot and in the exterior side yard of each
corner lot.
3. Extend a 6 ft. masonry wall 20 ft. north along the east
line of lot 41.
4. Access to the garage on lot 40 shall be along the easterly
1/2 of the property.

NO. 67-13-BY THE CITY COUNCIL.

PROPOSED CODE AMENDMENT NO. 67-14

of alcoholic beverages. He suggested that the Commission
take said amendment home and discuss it at their next meeting.

PRECISE PLAN OF STREET ALIGNMENT NO. 67-2
The Planning Director informed the
Commission that the Precise Plan of Street Alignment No. 67-2
was referred back to the Commission for reconsideration.
The Commission reviewed the Precise
Plan of Street alignment.

SECONDED BY TOM TO RECOMMEND ADOPTION OF THE PRECISE PLAN
OF STREET ALIGNMENT NO. 67-2 AS MODIFIED TO THE CITY COUNCIL.
