DISCUSSION: USE PERMITS

Proposed Code Amendment requiring a
Use Permit for on premise sale -and consumption of alcoholic bev-
erages and live entertainment.
The Planning Director informed the Commis-
sion that the City Council initiated this proposal which will allow
bars and establishments having live entertainment to be controlled
through zoning requirements. He stated that this code amendment
will control distance from: 1) residential uses 2) public
facilities and '3) other bars and establishments providing live
entertainment. He also reviewed the other factorsto be considered
when reviewing these applications.
The Commission discussed the proposed code
amendment.
A MOTION WAS MADE BY LAWSON AND SECONDED
BY BAZIL TO REFER SAID AMENDMENT TO THE PLANNING STAFF AND CITY
ATTORNEY FOR FURTHER STUDY.

THE MOTION CARRIED.
DISCUSSION: PUBLIC HEARINGS - Lou Ann Marshall
Assistant City Attorney, Lou Ann Marshall
discussed a report pertaining to procedures for conducting public
hearings.
DISCUSSION: UNDERGROUND UTILITIES
The Acting Secretary distributed copies
of a proposed list to clarify the intent of Section 9730.23 -
Underground Utility Facilities.
The Commission reviewed the proposed list.
A MOTION WAS MADE BY LARKIN AND SECONDED
BY LAWSON TO SEND A LETTER TO THE•CALIFORNSA P.U.C., ASSEMBLYMAN
ROBERT BURKE, STATE SENATOR JOHN SCHMITZ, LEAGUE OF CITIES AND
THE EDISON COMPANY INFORMING THEM OF THE CITIES POSITION REGARDING
UNDERGROUND UTILITIES.,

FOR MORE STUDY AND INSTRUCT THE STAFF TO CONTACT KERN COUNTY
REGARDING THEIR UNDERGROUND UTILITIES ORDINANCE.
