WEDNESDAY, JULY 5, 1967 COMMISSIONERS PRESENT: Larkin, Miller, Worthy, Royer COMMISSIONERS ABSENT: Bazil, Lawson, Tom MINUTES: On motion by Miller and seconded by Royer, minutes of the May 16th and May 23rd meetings were accepted as transcribed and mailed by the Secretary. USE VARIANCE NO. 67-10 - Continued Applicant - Mills Construction Co. To allow the construction of a garden apartment complex in the R-2 Two Family Residence District. The Acting Secretary read a letter submitted by Bernard Solomon, applicant, requesting a with- drawal of Use Variance No. 67-10. The hearing was opened to the audience, there being no comment the hearing was closed. A MOTION WAS MADE BY MILLER AND SECONDED BY ROYER TO GRANT THE APPLICANT'S REQUEST. ROLL CALL VOTE: AYES: Larkin, Miller, Worthy, Royer NOES: None ABSENT: Bazil, Lawson, Tom THE MOTION CARRIED. COMMISSIONERS BAZIL AND LAWSON: Commissioner Bazil and Commissioner Lawson arrived at 6:25 P.M..and assumed their duties. TENTATIVE TRACT MAP NO. 4419 USE VARIANCE NO. 67-34 Applicant - Bankers Development Co. 75 lots on 16.6 acres To permit reduction in the minimum right-of-way widths of all interior streets from 60 feet to 46 feet and 52 feet except Greenview Lane as shown on TT Map No. 4419. 7/5/67. d Minutes: H. B. Planning Commission Wednesday, -July 5, 1967 Page No. 2 The Subdivision Committee Report and the Staff Report were read by the Acting Secretary. The hearing was opened to the audience. Jeffrey,Millet, engineer for the applicant, addressed the Commission and statedithat there were no objections to conditions suggested by the Subdivision Committee and Staff. ` The following property owners addressed the Commission and stated their opinion pertaining to the block wall, the fence along Heil Avenue, landscaping and traffic control: Jim Hillman, James Newman, Charles Farrow, F. B. Stroud, and Jo Ann Goodman. There being no other comment the hearing was closed. John Mandrell, Division Engineer, Public Works Department, addressed the Commission and explained the traffic flow on Heil Avenue. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO APPROVE TENTATIVE TRACT MAP NO. 4419 UPON THE FOLLOWING.CONDITIONS: 1. The Tentative Map received July 5, 1967, shall be the approved layout. 2. Approval of this Tentative Map shall be null and void unless Use Variance No. 67-34 is approved by the City Council. 3. All utilities shall be installed underground. 4. A petition for rezoning to R-1 shall be filed at the time the final map is submitted to the'City Council for approval'. 5. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. AND FOR THE FOLLOWING REASON: 1. The subject request is in compliance with policies -established to govern tract development. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO RECOMMEND APPROVAL OF USE VARIANCE NO. 67-34 TO THE CITY COUNCIL WITH THE FOLLOWING CONDITIONS: 1. All streets shall comply with standards proposed,hy the Department of Public Works and approved by both'the Planning Commission (August 3, 1965) and City Council (September 7, 1965). -2- 7/5/67. A.tree, equivalent to a 30 inch box tree, as approved by the Park Supervisor, shall be planted in the front yard of each lot and in the exterior side yard of each corner lot. 3. An 18 inch wide easement for utility purposes shall be provided adjacent to all sidewalks. Construction of any vertical structure within said easement shall be approved by the Department of Public Works. I I To allow the installation of overhead utilities in deviation to the required underground installation thereof. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. John Horner, representing the applicant, addressed the Commission and gave his reasons for the request. There being no other comment, the hearing was closed. A MOTION WAS MADE BY LAWSON AND SECONDED BY BAZIL TO APPROVE USE VARIANCE NO. 67-32 UPON THE FOLLOWING CONDITION: 1. Service panels on the houses -shall be installed to take underground utilities at a later date. AND FOR THE FOLLOWING REASONS: 1. There are existing overhead utility limes and poles along property lines. 2. In this case, the requirement for underground utilities will not serve any useful purpose. Koster To permit postponement of the require- ment to construct street improvements in accordance with Section 9730.15 until such time as adjacent property owners are required to install same. The Acting,Secretary read two letters favoring the request. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. The applicant addressed the Commission and spoke in favor of the request. hearing was closed. There being no other comment the The Commission held a discussion. A MOTION WAS MADE BY BAZIL AND SECONDED BY LAWSON TO DENY USE VARIANCE NO. 67-33 FOR THE FOLLOWING REASONS: 1. The request would deviate from policies and ordinances requiring street improvements.. ROLL CALL VOTE: AYES: Miller, Bazil, Worthy, Lawson, Larkin, Royer. NOES: None ABSENT: Tom THE MOTION CARRIED._ USE VARIANCE NO. 67-30 Applicant - Power. Inc. To allow the construction of a double paneled "V" sign (each panel 8' x 161) in the R-3 Limited Multiple Family Residence District. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. John Kuhl, representing the applicant, addressed the Commission and objected to condition #5 suggesting that UV #67-30 shall become null and void July 1, 1969. A MOTION WAS MADE BY MILLER -AND SECONDED BY ROYER TO APPROVE USE VARIANCE NO. 67-30 UPON THE FOLLOWING CONDITIONS; -4- 7/5/67. Minutes: H.B. Planning Commission Wednesday, July 5, 1967 Page No. 5 1. A $100.00 cash bond guaranteeing removal of the signs shall be posted with the Building Department. 2. -A $50.00 permit fee shall be paid to the Building Department. 3. All provisions of Article 869 shall be complied with. 4. The 50 ft. setback line along Beach Blvd. shall be complied with. 5. Use Variance No. 67-30 shall become null and void July 1, 1969. AND FOR THE FOLLOWING REASON: 1. The request follows policy which allows advertising signs with time limitations, during construction. ROLL CALL VOTE: AYES: Miller, Worthy, Bazil, Lawson, Larkin, Royer. NOES: None ABSENT: Tom THE MOTION CARRIED. USE VARIANCE NO. 67-29 Applicant - Geo. Weierbach, dba Pacific Shores Realty To allow the continued use of a real estate office in the R-A Residential Agricultural District. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience, there being no comment the hearing was closed. A MOTION WAS MADE BY LARKIN AND SECONDED BY LAWSON TO APPROVE USE VARIANCE NO. 67-29 UPON THE FOLLOWING CONDITIONS: 1. Talbert Avenue and Beach Boulevard shall be improved to City'and State Standards. Improvements shall include street trees, street lights and street signs, 2. All streets shall conform to City of Huntington Beach Standards. Master Plan of Arterial Streets and Highways Standards shall apply where applicable. Street sections shall be determined by soil "R" value and traffic index. 3. All provisions of Article 979 shall be complied with. 4. Use Variance No. 67-29 shall become null and void on July 11 1969. AND FOR THE FOLLOWING REASONS: 1. Lots in this area are very small and titles to all lots in the tract have not been cleared for development. 2. ZONE CASE No. 67-18 Applicant - Slater Development Co. Change of zone from R-3 Limited Multiple Family Residence District and R-A Residential Agricultural District to R-1 Single Family Residence District., The Acting Secretary informed the Commission that this application was required as a condition of approval for Tentative Tract Map No. 5923. The hearing was opened to the audience, -there being no comment the hearing was closed. RESOLUTION NO. 67-18 A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 67-18 to the City Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY LAWSON TO ADOPT RESOLUTION NO. 67"18 RECOMMENDING APPROVAL OF ZONE CASE NO. 67-18 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. This zone change complies with a condition of approval on Tentative Tract Map No. 5923. ROLL CALL VOTE: AYES: Miller, Worthy, Bazil, Lawson, Larkin, Royer NOES: None ABSENT: Tom THE RESOLUTION WAS ADOPTED. TENTATIVE TRACT MAP NO. 6277 —EXTENSION OF TIME Subdivider: Oakhurst Land ComDan7 The Acting Secretary read a letter submitted by R. M. Galloway and Assoc., engineers for the developer, requesting a one year extension of time for Tentative Tract Map No. 6277. A MOTION WAS MADE BY LAWSON AND SECONDED BY MILLER TO CONTINUE THE MATTER TO AUGUST 1, 19672 WITH THE APPLICANT'S CONSENT. DISUCSSION: Joe Evans, addressed the Commission and discussed the 50 ft. setback on' Beach Blvd. for a car wash. -6- 7/5/67- Minutes: H.B. Planning Commission Wednesday, July 5, 1967 Page No. 7 PROPOSED CODE AMENDMENT NO. 67-14 The Commission reviewed a proposed code amendment requiring a use permit for on -premise sale and consumption of alcoholic beverages and live entertainment.
