BOARD MEMBERS PRESENT; Paul Cook, Sam Ferguson, Floyd Belsito BOARD MEMBERS ABSENT: None. MINUTES: The Minutes of June 28 and July 5, 1967 were accepted as transcribed and mailed by the Secretary. AREA VARIANCE NO. 67-48 Applicant: Daniel Schenong To allow an open fiberglass patio cover to be constructed 8' from the rear property line in deviation to the required 10' rear yard setback and to allow waiver of the required 900 sq. ft. of open space. Located at 17271 La Mesa Lane and legally described as Lot No. 78 of Tract No. 5638. The hearing was opened to the audience. The applicant addressed the Board and explained the request. It was noted that a code amend- ment allowing this type of request is being initiated and will soon be in effect. the hearing was closed. There being no other comment, Board discussion followed. A MOTION WAS MADE BY BELSITO AND SECONDED BY COOK TO APPROVE AREA VARIANCE N0. 67-48 FOR THE FOLLOWING REASON: 1. AREA VARIANCE NO. 67-49 Applicant: Tri-Delta Construction Co. To allow a wooden trellis patio cover to be constructed in the rear yard area causing a reduction of the required 900 sq. ft. of open -space. AREA VARIANCE NO. 67-51 Applicant: Marie Callendar's Pie Shop To allow a 175 sq. ft. detached sign to be located within the 50' front yard setback in deviation to the maximum sign area of 100 sq. ft. permitted in the C-2 District. Located on the south side of Edinger, approximately 440' west -of Beach Blvd. Legally described as Lots 19 and 20 of Tract No. 417. -2- 7/19/67• Minutes: H.B. Mr. Belsito read a letter from Sydney Sher Enterprises stating their objections to the proposed request. Juan Estrada, adjacent property owner, also objected to the proposed sign. Ernie Haynes, representing Heath and Company, designers of the proposed sign, presented a photograph of the sign and explained the request. It was noted by the Board that this would be against the policy of the Planning Commis- sion and would also set a precedent, if approved. Doug Dalton, owner of the property addressed the Board and stated his reasons for needing such a large sign in the front setback, and further he felt it was a hardship on the business to comply with ordinance requirements. Mr. Callender, the applicant, stated that a sign of this type would be an asset to the City even though it exceeded the amount of square footage allowed. There being no other comment, the hearing was closed to the audience. It was the consensus of the Board that the applicant failed to show sufficient hardship. A MOTION WAS MADE BY COOK AND SECONDED BY BELSITO TO DENY AREA VARIANCE NO. 67-51 FOR THE FOLLOWING REASONS: 1. The applicant fails to show sufficient hardship. Z. It would create a precedent to allow a sign of this size in the front yard setback. ROLL CALL VOTE: AYES: Cook, Belsito, Ferguson NOES: None ABSENT: None THE MOTION CARRIED.
