The Tentative Map received July 6, 1966, shall be the approved layout. 2. Approval of this Tentative Map shall be null and void unless UV #67-41 is approved by the City Council. 3. The property line radius of all cul-de-sac streets shall be 46 feet. 4. All public streets shall comply with City Standards. 5. All utilities shall be installed underground. 6. .All provisions of Article 998 shall be complied with. 7. All "Standard Conditions of Approval`•' for tentative tracts that are applicable shall be complied with. All streets shall comply with standards proposed by the Department of Public Works and approved by both the Planning Commission (August 3, 1965) and City Council (Sept. 7, 1965). 2. The minimum front yard shall be 10 ft. except the minimum front yard for garages entered directly from the street shall be 22 ft. This condition of approval is not general in nature and a precise plan shall be submitted to the Planning Department for approval prior to issuance of any building permits. Said plan shall delineate the house location on each lot. 3. A tree, equivalent to a 30 inch box tree, as approved by the ; Park Supervisor, shall be planted in''the front yard of each lot and in the exterior side yard of each corner lot. 4. The minimum lot frontage shall not be less than 50 ft. wide with 5000 sq. ft. of lot area. Ari average lot width of 60 ft. of frontage with 6000 sq. ft. of lot area shall be provided for each six contiguous lots in a block. 5. Holtz Change of zone from R-A Residential Agricultural District to C-1 Neighborhood Commercial District with setback provisions. • The Planning Director informed the Commission that this case was continued from the February 7, 19672 meeting in order to review the C-1 zone and make it more restrictive. Mr. Reynolds stated that this has been done and the City Council will have their second reading of the ordianance on August 7th. There being no other comment RESOLUTION NO. 66-65 A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 66-65 to the City Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY LAWSON'TO ADOPT RESOLUTION NO. 66-65 RECOMMENDING APPROVAL OF ZONE CASE NO. 66-65 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. Wilson & Assoc. To permit a canopy for a car wash to encroach to within 25 ft. of the front property line in deviation to the required 50 ft. setback. .The Planning Director informed the Commission that this item was referred to the Planning Commissio by the Board of Zoning Adjustments. Mr. Reynolds stated that the Board of Zoning Adjustments recommend approval for the following reasons: 1. The setback of the structures on the property to the north is such that the setback of this building will not adversely affect the intent of the 50' setback along Beach Boulevard. 2, Car wash will be setback a minimum of 90 ft. from the property to the south due to the separation of the lots by Aldrich Ave. 3. Access to Beach Boulevard will for all practical purposes be eliminated except for one driveway which will have limited use. 4. This use will cause consolidation of 3--lots fronting on Beach Blvd. all of which would normally have two curb breaks. 5. The entire front yard setback will be landscaped in lieu of a blacktop parking lot. Thereby enhancing the aesthetic appearance of the area and the entry to the City. Robert Nagle, addressed the Commission and questioned the 50 ft. setback line being maintained along Beach Blvd. Bob Wilson, representing the applicant, addressed the Commission and explained the reason for requesting a 25 ft. setback from Beach Blvd. Mrs. Effie Neiderheiser, adjacent property owner, addressed the Commission and opposed the request. Joe Evans, representing three property owners of the subject property, addressed the Commission and spoke in favor of the proposal. There being no other comment the hearing was closed. Visual observation of other cities demonstrates the value of a 50 ft. setback. 2. Encroachment has not been allowed under any conditions since the ordinance was adopted over 5 years ago. -8- 8/1/67. There being no other comment the hearing was closed. A MOTION WAS MADE BY LAWSON AND SECONDED BY ROYER TO APPROVE USE VARIANCE NO. 67-42 UPON THE FOLLOW- ING CONDITIONS: 1. Garfield Avenue shall be dedicated to City Standards. 2. The applicant shall enter into an agreement with the City agreeing to dedicate and install street improvements within six (6) months after requested to do so by the Department of Public•Works. 3. The property shall be enclosed with a six (6) ft. high chain link fence. 4. The storage yard shall be screened with adequate planting. ,5. With the exception of driveways, the entire storage yard shall be oiled. Application of said oil shall be 0.25 gallons of SC - 70 per square yard on sterilized soil. 6. Driveways between the street pavement and the entrance to the storage yard, shall be improved to Building Department Standards. ,7. Such yard shall only be used as a contractors storage yard. 8. Use Variance No. 67-42 shall become null and void on August 1, 1970. 9. A precise plot plan shall be submitted to the Planning Depart- ment for approval prior to issuance of any building permits. Improvements shall include street trees, street signs and street lights. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The property shall participate in the local drainage assessment district. 5. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 6. All utilities shall be installed underground. 7. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 8. Off-street parking facilities including the rear wall shall conform to Article 979. 9. All provisions of Section 9201.3.5 (a) shall be complied with.
