BOARD MEMBERS PRESENT: Sam Ferguson, Richard Harlow,
Charles Spencer.
BOARD MEMBERS ABSENT: None.
AREA VARIANCE NO. 67-55
Applicant: Kenneth Halverson
To allow the construction of an un-
enclosed patio in the rear yard area causing a reduction of
the required 900 sq. ft. of open space. Located at 16521
Fountain Lane and legally described as -Lot 86 of Tract No.
5557.
The hearing was opened to the audience.
There being no one present to speak for or against the matter,
the hearing closed.
It was noted by the Board that a
code amendment allowing this type of request has been initi-
ated; by the Planning Commission and will soon be in effect.

Applicant: K-D Venture
To permit the construction of a shopping
center in the C-4 Highway Commercial District. Located on
the southeast corner of Atlanta Avenue and Beach Boulevard.
Legal description on file in the Planning Department Office.
The hearing was opened to the audience.
Jerry King, the applicant, explained the
request. He also asked if the Board could grant permission
to use the property to the south for C-2 purposes.
The Board explained to Mr. King that they
could not approve that part of the request because a plot
plan has not been submitted for review, however, C-2 uses
are permitted in the C-4 Zone subject to approval of a
Use Permit.
Frank Richardson, representing the applicant,
further explained the request to the Board.
,The conditions -of approval were reviewed.
There being no other comment,• the' hearing
was closed to the audience.

A MOTION WAS MADE BY HARLOW AND SECONDED BY
FERGUSON TO APPROVE USE PERMIT NO. 67-29 SUBJECT TO THE
FOLLOWING CONDITIONS:
1. Atlanta Avenue and the frontage road along Beach Boulevard
shall be dedicated and fully improved to City and/or State
Standards at the time said parcel is developed. Improve-
ments shall include street trees, street signs, and street

2. All streets shall conform to City of Huntington Beach-.
Standards. Street sections shall be determined by soil

4. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time said parcel is developed.
5. The property shall participate -in the local drainage
assessment district at'the time said parcel is developed.
6. Preliminary and final soil reports shall be submitted by
an.approved.private soils engineer to -the City prior to
issuance of building permits .
7. The flood control channel shall be fenced to Flood Control
District Standards and City Standards at the time said
parcel is developed.
8. All utilities shall be installed underground at the time
said parcel'is developed.
9. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
10. Fire alarm system conduit and appurtenances shall be in-
stalled by the developer at locations_.and to specifications
provided by the Fire Department.
11. Off-street parking facilities including landscaping, arrange-
ment, access, paving and striping shall conform to Article
979.
12. Access to said parcel shall'be approved by the Traffic
Engineer.

DIVISION OF LAND NO. 67-23
Applicant: K-D Venture
To allow a division of land into 4 separate
parcels. Located on the southeast corner of Atlanta Avenue
and Beach Boulevard. Legal description -oil file in the Planning
Department Office.
The hearing was opened to the audience.
Jerry King, the applicant, explained the fequest.
It was noted by the Board that Lot No. 4 only
has 46' of-_ f-rontage and a- minimum --frontage of 100' is required
in the C-4 Zone. -This matter was discussed with the applicant
and it was decided that the Secretary should check with the
City Attorney for approval inasmuch as Lot 4 also has 513' of
frontage road.
The condition requiring underground utilities
was discussed. It -was the consensus that utilities should be
installed underground in the same manner as agreed to under
Division of Land No. 66-24.

BY FERGUSON TO APPROVE -DIVISION OF LAND NO. 67-23 SUBJECT
TO THE FOLLOWING CONDITIONS:

Mrs. Lambright, the applicant, stated that she
will be using her home for office purposes only and that she
will not be preparing food on the premises.-

To allow the use of the existing masonry
wall separating the commercial from the residential property
to satisfy the requirement for a 6! .high .separation wall.
Located'on the southwest corner of-Goldenwest Street and
Edinger Avenue. Legal description on file in the Planning
Department Office.
The -hearing - was opened to the audience.
Mr. Hoffman, representing the applicant,
explained,the reasons for this request.
Don McCallon, 6841 Nyanze Drive, submitted a
petition signed by 13 property owners, favoring the proposed
request subject -to the conditions stated-in'the petition."

the Board, .and .ob,jected to _the proposal. 'He. asked Mr. Hoffman
various questions regarding this matter.

A MOTION WAS MADE'BY FERGUSON-AND SECONDED •
BY SPENCER TO APPROVE.AREA VARIANCE NO. 67-57 SUBJECT TO
THE FOLLOWING CONDITIONS:
1. The wall on the south shall be raised in accordance
with the plans submitted.
2. Temporary pipes or buwi s shall be installed where
there are no -bumpers. -
FOR THE FOLLOWING REASONS:
1. The wall - 'along the west property line will provide
adequate separation between the residential and!
commercial uses.
2. There ' are ,no communication f rom - the owners to the
west except for one person whb objected to the
request, however he agreed that there is adequate
separation between the uses.
3. All property owners along the -south property line
agree to the request.
4. Protection of the wall is provided by pipes and -bumper
'logs,on the'south and bumper logs and a retaining wall
on the west.

3. Sewage disposal shall be through the'City of Huntington
Beach's sewage system -at the tima said parcel is developed
or the developer shall enter into an agreement agreeing
to install said sewage system to the satisfaction of the
Department of Public Works and City Attorney -Is Office.
4. The property shall participate in the local drainage
assessment district at the time said parcel is developed.
5. Preliminary and final soil reports shall be submitted by
an approved private soils engineer to the City prior to
issuance of building permits . ,

FOLLOWING CONDITIONS:
1. Beach Boulevard shall be fully improved to State
Standards at the time, said parcel is developed.
Improvements shall include street trees, street
signs, and street lights.
2. Water supply shall be through the City of Huntington
Beach's water system at the time said parcel is
developed.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time said parcel is de-
veloped.
4. The property shall participate in the local drainage
assessment district at the time said parcel is developed.
5. Preliminary and final soil reports shall be submitted
by an approved private soils engineer to the City prior
to issuance of building permits.
6. All utilities shall be installed underground at the time
said parcel is developed.
7. The water, sewer, and fire hydrant system shall be ap-
proved by the Department of Public Works and Fire Depart-
ment.
8. Off-street parking facilities including landscaping,
arrangement, access, paving and striping shall conform
to Article 979.
9. A masonry wall shall be constructed along the alley
except at the driveway entrance and exit. The height
of said wall shall be such-, that the top will be dix
feet above the highest ground surface within twenty
(20) feet of the common property line.
