HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS

BOARD MEMBERS PRESENT: Sam Ferguson, Richard Harlow,
Charles Spencer.
BOARD MEMBERS ABSENT: None.
AREA VARIANCE NO. 67-58
Applicant: Richard Ashby
To allow a 5' rear yard setback
in deviation to the required 10' rear yard setback.
Located at 16782 Sea Witch Lane and legally described
as Lot 92 of Tract No. 5050.
The hearing was opened to -the
audience.
Mr. Ashby, the applicant, ex-
plained the request to the Board. He stated that a
variance had been granted for the same type of request
at his present address, 16882 Sea Witch Lane.
It was noted that the abutting
lot is oriented in such a manner that it will probably
front on Sea Witch Lane causing the common lot line to
act as a side yard rather than a rear yard.
There being no other comment,
the hearing was closed.
Further Board discussion

A MOTION WAS MADE BY HARLOW AND
SECONDED BY SPENCER TO APPROVE AREA VARIANCE NO. 67-58
SUBJECT TO THE FOLLOWING CONDITION:
1. The 61 high fence cannot project beyond the front
of the house.
FOR THE FOLLOWING:REASON:
1. The configuration of this lot and the adjacent lot is
such that the common lot line will serve as a side
lot line rather than a rear property line.
ROLL CALL VOTE:
AYES: Ferguson, Harlow, Spencer.
NOES: None.
ABSENT: None.
THE MOTION CARRIED.
DIVISION OF LAND NO. 67-24
Applicant: Cornelius Zeilenga
To allow a division of land into
2 separate parcels located on the southeast corner of
Cypress Street and Elm Street. Legal description on file
in the Planning Department Office.

A MOTION WAS MADE BY SPENCER AND SECONDED
BY FERGUSON TO APPROVE -DIVISION OF LAND NO. 67-24 SUBJECT
TO THE FOLLOWING CONDITIONS:
1. Cypress Avenue and Elm Street shall be dedicated and
fully improved to City Standards at -the time each parcel
is developed. Improvements shall include street trees,
4treet signs, and street lights.
2. All streets shall conform to City of Huntington Beach
Standards. Street sections shall be determined by
soil "R" value and traffic index.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time each parcel is developed.
4. The property shall participate in the local drainage
assessment district at the time each parcel is developed.
5. Preliminary and final soil reports shall be submitted -by
an approved private soils engineer to the City prior to
issuance of building -permits.
6. All utilities shall be installed underground at the
time each parcel, Xs developed.
7. The Division of Land shall not be effective until an
agreement is signed and recorded agreeing to the condi-
tions listed above.
