FILE IN THE PLANNING DEPARTMENT OFFICE. TUESDAY, SEPTEMBER.26, 1967 - STUDY SESSION COMMISSIONERS PRESENT: Miller, Bazil, Lawson, Larkin, Royer. COMMISSIONERS ABSENT: Worthy, Tom. USE VARIANCE NO. 67-54 - Continued - Applicant - Freeway Industrial Park o permit the construction of a coffee shop restaurant in the M-1 Light Industrial District. The Acting Secretary presented a proposed code amendment which will expand the permitted uses in industrial zones to include certain professional and commer- cial uses. The -list was reviewed by the Commission. It was the consensus of the Commission that further revisions of the code -amendment are necessary and that professional and commer- cial uses should only be permitted as an adjunct to an industrial use. The Staff Report pertaining to Use Variance No. 67-54 was read by the Acting Secretary. COMMISSIONER TOM: Commissioner Tom arrived at 7:10 P.M. and assumed His u ies. The -hearing was opened to the audience. Jack Murdy, applicant, addressed the Commission and gave his reasons for the request. James Crowl, representing the applicant, addressed the Commission and spoke in favor of the request. There being no other comment the hearing was closed. A MOTION WAS MADE BY LARKIN AND SECONDED BY BAZIL TO -DENY USE VARIANCE NO. 67-54 FOR THE FOLLOW- ING REASONS: 1. The applicant failed to show sufficient hardship. 2. There is ample commercial property in the area where a restaurant use could locate. 9/26/67. Minutes H.B. APPEAL: SUBDIVISION DIRECTIONAL SIGN LOCATED AT 20022 PORT CIRCLE The cuing Secretary informed the Commission that an appeal pertaining to a temporary Subdivision Directional Sign located at 20022 Port Circle has been filed. He stated that the owner of the property upon which the sign is located has been notified of the hearing along with the sign company, the developer and the persons filing the appeal. A letter submitted by Mrs. Donald Rhodes opposing the sign was read by the Acting Secretary. Dean Hanson, of Deane Brothers addressed the Commission and stated that this is the only sign location available to direct people south on Bushard Street to their development. Mark Porter and Joe Callaci, addressed the Commission and opposed the sign structure. Harry Fulton of Columbia Outdoor Advertising Company, addressed the Commission and spoke in .favor of the sign. Mr. Arttelt, owner of the property upon which the sign is located, addressed the Commission and spoke in favor of the sign. He also submitted 13 letters from adjacent property owners stating that they had no objection to the sign location° The Commission discussed the sign structure at length. A MOTION WAS MADE BY ROYER AND SECONDED BY TOM TO UPHOLD THE APPEAL AND DENY THE SIGN LOCATION FOR THE FOLLOWING REASONS: to The sign is objectionable to the neighborhood and surrounding area. 2. The new sign ordinance will prohibit the placement of Sub- division Directional Signs in established residential areas. ROLL CALL VOTE: AYES: Bazil , .Royer, Lawson, Larkin, Tom. NOES: Miller. ABSENT: Worthy THE MOTION CARRIED SETBACKS IN C ZONES DISCUSSION: The Acting Secretary gave a slide presentation on the kind of encroachments presently permitted in the 50 ft. setback in "C" Zones. He also showed several slides indicating possible setback variations within the setback area which included setbacks for canopys9 "0" setback for -2- 9/26/67s Minutes-: H.B. Planning Commission Tuesday, September 26, 1967 Page No® 3 commercial buildings when they back up to residential lots and outdoor display -of merchandise in connection with automobile agencies, trailer sales and uses generally having outside storage. The Commission reviewed the slides and it was their consensus that the'Staff should perform further studies of the setback variations and bring back recommendations at another meeting. BENCHES IN PUBLIC RIGHT-OF-WAY Floyd Belsito, Associate.Planner, made a presentation and displayed various slides pertaining to benches and other types of street furniture in public right-of-way. A discussion was held by the Commission. A MOTION WAS MADE BY BAZIL AND -SECONDED BY ROPER TO INSTRUCT THE SECRETARY TO WRITE A LETTER TO THE CITY COUNCIL RECOMMENDING --THAT THE COUNCIL: 1) TAKE NECESSARY STEPS TO REMOVE ALL BUS BENCHES THAT ARE NOT ONAN MISTING BUS ROUTE, 2) ELIMINATE ALL ADVERTISING ON BENCHES, ANDS 3) AREPLLACE EXISTING BENCHES WITH BENCHES OF A MORE ROLL CALL .VOTE: AYES: Miller, Lawson, Larkin, Bazil, Royer. NOES: Tom ABSENT: Worthy THE MOTION CARRIED. COMMISSIONER TOM: Commissioner Tom stated that his reason for voting against the motion was because the motion should be more specific. A FURTHER MOTION WAS MADE BY ROYER AND -SECONDED BY LAWSON TO INSTRUCT THE STAFF TO EXPLORE DIFFERENT DESIGNS OF STREET FURNITURE AND TO 'PRESENT AT LEAST THREE OR MORE DESIGNS TO THE PLANNING COMMISSION FOR CONSIDERATION. ROLL CALL VOTE: AYES: Miller, Bazil, Lawson, Larkin, Royer, Tom. NOES: None ABSENT: Worthy THE MOTION CARRIED. COMMISSIONER-ROYER: A MOTION WAS MADE BY ROYER THAT THE MUST -LING CONTAINERS BE REPLACED BY THE CITY WITH A MORE SUBSTANTIAL TYPE HAVING A BETTER DESIGN. Mr. Royer withdrew his motion and suggested that the Staff bring back specific recommendations pertaining to trash containers and receptacles. PROPOSED CODE AMENDMENT NO. 67-18 The Acting Secretary distributed copies of a proposed code amendment to Article 910 which will increase the maximum height for fences, walls and hedges to 8 feet in the R-1 zone when abutting commercial, professional, and industrial property or when abutting open public land. Said amendment also pertains to Article 979 and will require physical protection from vehicle damage for fences in off-street parking areas. -3- 9/26/67 Minutes: H.B. ROLL CALL VOTE: AYES: Miller, Bazil, Lawson, Larkin, Royer, Tom. NOES: None ABSENT: Worthy THE MOTION CARRIED. ASSISTANT BUILDING DIRECTOR: Sam Ferguson, Assistant Building Director, addressed the Commission and discussed roofed structures within the side yard setback in the Deane Homes development. Mr. Ferguson asked the Commission about the'type of structures which could be permitted. It was the consensus of the Com- mission that anything which does not require a permit and certain portable structures would be permitted, however, Deane Brothers representative should present sketches at the October 3rd meeting. INFORMATION: The Acting Secretary informed the Commission that interviews for Planning Commission vacancies will be conducted October 3, 1967, for Commissioners Tom, Miller and Lawson. DISCUSSION: SECTION 9730.17 -The Acting Secretary distributed copies of a proposed change to code amendment No. 67-16 pertaining to separation wall require- ments for professional, commercial and industrial uses. He stated that the change specifies the type of protection to be provided for the walls when they are constructed on abutting residential property. Mr. Harlow informed the Commission that a public hear- ing was held on the matter, however, the Assistant City Attorney suggested that standards for Administrative Review be included. Mr. Harlow stated that the proposal has incorporated these changes, however, rather than require Administrative Review, determination of the type of protection to be used will be made by the Building Director. The Commission reviewed the proposed code amendment. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO ADOPT CODE AMENDMENT NO. 67-16 INCLUDING THE FOUR METHODS OF PROTECTIONS FOR SEPARATION WALLS.
