Mayor Shipley called the regular meeting of the City Council of the
City of Huntington Beach to order at. 4:30 P.M.
The pledge of Allegiance was given by all present in the Council Chambers.
The Invocation was given by Mr. Willis Loar, ,Minister of the First
Baptist Church.

1967, were approved and adapted as prepared and mailed by the City Clerk.

final form of 'tract Map No. 6277 for adoption as follows: Developer:
Capistrano LandCo.; Location: west of Edwards street, north of Talbert

the Director of Public Works and the Secretary to the Planning Commission
to he true and correct in accordance with provisions of the City

recommending that payment of ,944,0 , plus 7% interest, he paid to
Henry H. Bruderliu and, Newport -Balboa Savings and Lean Association,
after the court order is signed by the presiding judge
On motion by Steuart, Council authorized the Director of Finance to
prepare a warrant in the amount of $4, 44.00, plus °fie interest payable
to Henry H. Bru.derliu and Newport -Balboa Savings and Loan Association,
for payment when than court order is received. Motion carried.

144 between the City and Doyle Development Company, and authorized
the Mayor and City Clerk to execute same on behalf of the City.

the Agreement -in -Lieu of Bond and the Subdivision Agreement, and authorized

The Clerk presented a communication from the Director of Public Works
acceptance of dedicated improvements, authorization for

Doyle Development Company,,
On motion by Green, Council accepted improvements dedicated for public
use in Tract No. 6136; authorized the release of Mbnument Bond, termin-
ation of the Agreement -in -Lieu of Improvement Bond and the Subdivision
Agreement; and directed the CiLy Clerk to notify the developer and the

FENCING - VTESTINSTER .CHANNEL - C04
The Clerk presented a communication from the Director of Public Works
recommending that the City of Huntington Beach install curbs and gutters
on Edinger and Bolsa Avenues. In exchange the Orange County Flood
Control District will install a2 chain link fence along the Westminster
Channel m Project C04, adjacent to Edinger ,Avenue, Springdale Street,
and Eolsa Avenue,
On motion by Green, Council approved the installation of the curbs and
gutters on Edinger and Eolsa Avenue, subject to the approval of the
City .Administrator and the availability of funds, and -authorized the
Department of Public Works to proceed with the plans and specifications.
Motion carried.

PROPERTY EXCHANGE m SO CALIF ED IS ON CO
The Clary presented a communication from the Director of Public Works
recommending that the City exch�nge 0.84 acres of land adjacent to
and soutbekly of Edison property for 1..20 acres of right-of-way for
future extension of Magnolia Street.
On motion by Green, Council accepted the deed from the Southern
California Edison Company and directed the Elork to record same;
approved a, deed to exchange to Southern California Edison Company and
authorized the Mayor and City Clerk to execute sane on behalf of
the City. Motion carried,
CC-079 SIGNALIZATION - WARNER AVEMJE - Ells AWARD
The Clerk road a communication from the Director of Public Works
stating that bids for the construction of traffic signal systems at
the intersections of Warner Avenue and Gothard Street and 'earner
Avenue and Springdale Street, had been opened at 9:00 A.M. on Monday,
October 2, 1967, in the Council Chamber by the City Clerk, City
Attorney and the Director of Public Works, and that E. D. Johnson,
Anaheim, was the low bidder with a bid in. the amount of $30, 500.00.
r. Wheeler recommended that the Council ,award the bid to E. D Johnson
and Company, and reject all other bids. The lids submitted were
as follows:

On motion by Green, Council awarded the contract for Project -079
to E. D. Johnson and Company, the lmgest responsible bidder, for the
bid amount of $3 , 00.00; rejected all other bids and directed the
Clerk to notify the unsuccessful bidders. Motion carried.

The Clark presented a_a claim filed by .Attorney Herbert M. Porter on
behalf of Lee Hochman, et al, for alleged personal injuries and
property damage.
On motion by Bartlett, Council denied the claimfiled by Herbert M.
Porter on behalf of Lea Hoclmuan, et al, and referred same to the
City Attorney and the City's insurance carrier. Motion carried.

fT RASH CONTRACT
Councilman Green reported to the Council on a meeting which was held
September 27th between Councilmen Green and Coen, as a special
committee of the Council, and the City Attorney, Director of Public
Works and the: City Administrator, to discuss the proposed trash and
garbage contract. He stated that the Committee suggested that
the City renew a revised and, clarified contract for residential
pickups, and establish an ordinance providing for the issuance ance of
certificates of need and necessity under which any contractor could
contract for commercial pickups. Councilman Green stated that he
believed that the terminology of residential and coiimiercial pickups
should be defined in e manner to leave no doubt as to the difPerentia-
t ion,
Following discussion by the Council on this matter, a motion was ade
by Green, that the present trash collection contract with Rainbow
Disposal Company be extended on a month to month basis until problem
in connection therewith can be resolved. When put to vote, the motion
carried.

SUBDIVISION WALL PEDESTRIAN OPENINGS
The City Administrator presented a letter from Vice Mayor Jack Green
discussing, a problem encountered in the closing of pedestrian openings
in subdivision walls. Mr. Green pointed out that 1 00% participation
of local homeowners is presently required in order to proceed with the
closings
On motion by Stewart, Council referred this item to the City attorney
to study the procedures required in the closings of the pedestrian
openings in subdivision walls. Motion carried.

HARBORS AND BEACHES BUILDING m PLANS AND SPECS
The Director of Public Wore presented the plans and specifications for
the Harbors and Peach Maintenance Building to be built on the rear
portion of the present Driftwood property, adjacent to Pacific Coast
Highway.
On motion. by Stewart, Council approved the plans and specifications
for the Maintenance Building and directed the Public Works Department
to proceed with constriction of this project. Lotion carried.

Powers Agreement for the West Orange County Water Board and requested
Council', approval of same,
On motion by Green, Council approved the Revised Joint Powers ,Agreeraient
for the West Orange County 'eater Beard, and authorized the Mayor and
City Clerk to execute same on behalf of the City, Motion carried.

COMPLAINT - TAXI CAB_ RATES

The Clerk presented a letter from Mrs. Edith A, Cooper, 938 m 1 th
Street, City, complaining of the high rates charged by the taxi cab
service in the City.
r. Tatum) manager of the Yellow Cab Company, addressed the Council
and expressed his concern at the complaint of Mrs. Cooper, and
informed the Council that his rates are comparable to other cities
in Orange County.
On motion by Stewart, Council directed the City, Attorney to amend the
Ordinance Code to extablish the rates to he charged by taxi companies
with said rates being subject to change by Resolution following the
adoption of such Ordinance, Motion carried,

Mayor Shipley announced that this was the day and hour set for a public
hearing € n Zone Case No. 368, on property generally located east o
Beach. Boulevard, west or Newland Street, north of Garfield ,avenue and
south of Ellis Avenue, and directed the Clergy to read the legal notice.

hour of 7.30 FM., or as soon thereafter as possible, on Monday, the

HEARING OF EVIDENCE I=PING OF WAT
Mayor Shipley announced that this was the day and hour set for a
hearing of evidence to determine whether or not any permit authorized
or issued to keep a bobcat should he denied or revoked to a Mr. illial
Gurnee, 9051 ermuda Drive, City.
The City Clerk informed the Council that he had received one petition
with 29 signatures objecting to the keeping of the bobcat, and also a
petition with 55 signatures of residents who do not object to his
keeping of the bobcat, The Clerk presented a letter frn Mr. Gee
submitting a certification by a veterinarian that his bobcat had been
decla ed, dafangad, and neutered, and requesting that the permit be
allowed for the animal,

The Clem also presented a letter from Mr. Herbert Garrett concern-
ing the law that regulate the keeping of wild animals.
Mayor Shipley declared the hearing open.
Mr. William Gurnee, owner of the bobcat, addressed the Council and
requested that a permit be granted.
Mr. Bob SharkeyDirector of the Huntington Beach Humane Society,
addressed the Council and informed Council of the trouble already
experienced by the Humane Society concerning the bobcat.
Mr. James J. Spellman, 9021 Bermuda Drive, City, addressed the Council
and informed them of the gentleness of the eat and of his approval of
same in the neighborhood,.
There being no one further to speak on the matter, and there being no

William Gurnee to 'peep a bobcat, subject to the compliance with the
County Ordinance regarding rabies, and the conditions stipulated by
the Animal Control Officer of the Huntington Beach Humane Society.

Mr. George Shibata, Attorney representing the owners of the con-
denmed building at the corner of Maih Street and Ocean Avenue,
addressed the Council and requested guidance on the disposition o
the building, and discussed the parking problem in the downtown area
of the City.
Thayer Shipley appointed Councilmen Bartlett, Kaufman, and Stewart
as a Committee of the Council to talk with the downtown property
owners in regard to a Parking District.
Mrs. Martha Holt, owner of the condemned building, addressed the
Council and displayed an artists rendering of a proposed plan for
the corner of Main Sheet and Ocean Avenue.
Mr. George McCra.ken, 8562 Glasgow, City, addressed the Council
and inquired whether the City might wive parking requirements in
the downtown area

Mr a Jim Oiwen, Balboa., owes of apartments on Georgia Street, addres-
sed. the Council and requested that Counc.i.l approve street lighting
for Georgia. Street.
The City Administrator informed Mr. Owen that street lighting for
Georgia Street is scheduled in the Budget for 1 - 8 and that the
project should be started within the next few months. There was no
action on this matter.

Councilman Green discussed the new design: for the L ke Park Clubhouse
and requested the Recreation and Parks Department and Commission compile
a study of the projected needs for the Clubhouse and the size building

Mrs. Wesley h, Cray, 9061 Bermuda Drive, City, addressed the Council
and explained that she was unable to come to the meeting earlier, and
therefore missed the hearing on the bobcat owned by William Gurnee. She
informed the Council that she objected to this cat and requested Council
not issued the permit for the bobcat. No further action was taken by
the Council

Councilman Green requested information as to whether the committee
studying the new proposed Civic Center was studying the amount of area
needed for the facilities for each department in the City s

Site, ULI Citizens Steering Committee;, addressed the Council and assured

CITY COED OIL WELLS
Council requested the City Administrator and Oil Superintendent to make
an inventory of the City owned Cif Well lots and make recommendation as
to the 'best financial method of cleaning up the property. Council was
informed that this had already been done and the reports would he sent
to each Councilman. .
INFORMAL MEETING
Mayor Shipley called an informal meting of the Council as a Committee -
of -the -Whole for Thursday, October 12, 1967, at 7:00 PX� in the Council
Chambers to discuss the Capital Improvements Program and Beach con-
cessions.
