The Acting Secretary read a letter submitted -by Milton Anderson,,engineer for the subdivider, request- ing a continuance for 30 days. ZONE CASE NO. 67-24 - Continued Applicant: William Landis Change of zone from R-5 Office - Professional District and R-3 Limited Multiple Family Residence District to C-4 Highway Commercial District with a 50 ft. setback from ultimate right of way line. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. The applicant addressed the Com- mission and gave his reasons for the request. Mr. Landis stated that most all major intersections along Warner Avenue are zoned Commercial. COMMISSIONER LARKIN: Commissioner Larkin arrived at 7:10 P.M. and assumed his duties. CHAIRMAN WORTHY: Chairman Worthy excused himself from participation on this matter due to a conflict of interest. There being no other comment the A lengthy discussion was held. A MOTION WAS MADE BY BAZIL AND SECONDED BY ROYER TO CONTINUE ZONE CASE NO. 67-24 TO WOVEMBER 79 196 FOR THE FOLLOWING REASONS: 1. The continuance will allow time for Shell Oil Company to submit a letter to guarantee that a service station will not be constructed on the northwest corner of Warner Avenue and Gothard Street if this request is approved. 2. The City Attorney shall submit an opinion regarding the legality and validity of the letter from Shell Oil Company. TENTATIVE TRACT MAP NO. 5813 Subdivider: Decon Corporation The Subdivision Committee Report was read by the Acting Secretary. The hearing was opened to the audience, there being no one to speak for or against the matter, the hearing was closed. A MOTION WAS MADE BY LAWSON AND SECONDED BY BAZIL TO APPROVE TENTATIVE TRACT MAP NO. 5813 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received September 14, 1967, shall be the approved layout. 2. Drainage, water, and sewer plans shall be approved by the Department of Public Works. The fire hydrant system shall be approved by the Department of Public Works and Fire Department. 3. A lighting system shall be installed on all private streets and common areas with illumination at least equal to lighting on public streets. Said lighting shall be approved by the Department of Public Works. 4. Disposition of the existing storm drain shall be approved by the Department of Public Works. 5. A fire alarm system shall be installed by the developer at locations and to specifications provided by the Fire Department. 6. All utilities shall be installed underground. 7. The property line radius at the intersection of the private street and Highway #1 shall be approved by the Department of Public Works. 9. Private street structural sections shall comply with Department of Public Works Standards. 10. The park and recreational fee shall be based on the number of dwelling units. 11. All "Standard Conditions.of Approval" for tentative tracts that are applicable shall be complied with. 12.. All conditions of approval for Use Variance No. 870 shall be complied with. The Acting Secretary informed the Commission that this is a reversion to acreage of a portion of Final Tract No. 5481 which will allow recordation of Final Tract Map No. 6405. Mr. Harlow stated that the request has been published twice in the Huntington Beach News as required by the State Law. A MOTION WAS MADE BY BAZIL AND . TENTATIVE TRACT MAP NO. 5017 USE VARIANCE NO. 67-58 Subdivider: Tustin Village, Inc. 100 Lots on 20 Acres. To permit reduction of the minimum right of way widths and reduced lot frontages as shown on Tentative --Tract Map No. 5017 and to permit a 10 ft. front yard setback for houses having side entry garages. The Subdivision Committee Report and the Staff Reperrt were read by the Acting Secretary. The hearing was opened to the audience, there being no comment the hearing was closed. A MOTION WAS MADE BY TOM AND SECONDED BY BAZIL TO APPROVE TENTATIVE TRACT MAP NO. 5017 UPON THE FOLLOW- ING CONDITIONS: -3- 10/17/67. Minutes: H.B. Planning Commission Tuesday, October 17, 1967 Page No. 4 1. The Tentative Tract Map received September 29, 1967 shall be the approved layout. 2. Approval of Tentative Tract Map 5017 shall be null and void unless Use Variance No. 67-58 is approved by the City Council. .3. A 6' high masonry wall shall be constructed along the south boundary of the tract. 4. A 10' setback shall be provided along the south boundary of the tract. 5. All utilities shall, be installed underground. 6. All oil wells on the property shall be abandoned and all equipment removed in accord with Division`of Oil and Gas. # regulations and Huntington Beach Ordinance Code. 7. A 10 ft. wide walkway connecting the subdivision to the school property shall be provided at the end of the most easterly cul-de-sac. 8. A MOTION WAS MODE BY TOM AND SECONDED BY BAZIL TO RECOMMEND APPROVAL OF USE VARIANCE N0. 67-58 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS: 1. All streets shall comply with standardsproposed by the Depart- ment of Public Works and approved by both the Planning Commis- sion (August 3, 1965) and City -Council (September 7, 1965). 2. The'minimum front yard shall be 10 ft& except the minimum front yard for garages entered directly from the street shall be 22 ft. This condition of approval is not general in nature and a precise plan shall be submitted to the Planning De art• ment for approval prior to issuance of any building permdts. Said plan shall delineate the house location on each lot. 3. A tree, equivalent to a 30 inch box tree, as approved by the Park Supervisor, shall be planted in the front yard of each lot and in the exterior side yard of each corner lot. 4. Lot sizes shall be as shown on Tentative Tract No, 5017. 5. An 18 inch wide easement for utility purposes shall be pro vided adjacent to all sidewalks. A MOTION WAS MADE BY LAWSON AND SECONDED BY BAZIL TO ADOPT RESOLUTION NO. 67-26 RECOMMENDING API'ROVAt OF ZONE CASE NO. 67-26 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. The subject zone change is in compliance with the Commission intent to rezone 0-1 property to more appropriate zones. Bradley Change of zone from R-A=0 Residential - Agricultural -District combined with oil production to M-1 Light Industrial District. - The Acting Secretary reviewed a display of the proposal. The hearing was opened to the audience. Mr. Ernest Delaney, 5042 Warner Avenue, City, addressed the Commission and explained the request. There being no other comment the hearing was closed, The Commission held a lengthy dis- cussion. The existing planted area along Warner Avenue shall be maintained. 2. A 5 ft. setback from Warner Avenue shall be provided and such area shall be landscaped. 3. Lighting for the tennis courts shall be directed away from abutting property, 4. A driveway between the parking bays shall be provided along the west side of the tennis courts to replace the existing driveway eliminated by the tennis courts. 5. The parking requirements established by Use Variance No. 505 shall be complied with. 6. The drivswV north of the tennis courts shall have a minimum Width of_ 20 ft. for two, wady traffic. 7. A revised plot plan depicting the parkinglotlayout and landscaping shall be submitted to the Planning Department for ;.appr'dval prior to issuance of a building permit. The hearing was opened to the audience. Mr. Sol Sher, applicant, addressed the Commission and gave his reasons for the request. He further objected to the dedication of a future street extending through the proposed development. Bill Hartge, Deputy Director of Public Works, explained the need for a connector street in the area. There being no other comment the hear - ing was closed. It was the consensus of the Commis- sion to continue said item to November 7, 1967, in order to study a precise plan of street alignment. SETBACK AND DOES NOT SPECIFICALLY STATE STRUCTURES; THEREFORE, THE INTENT OF THE ORDINANCE COULD HAVE BEEN MISINTER- PRETED BY THE APPLICANT. Mr. Harlow explained that said amendment will permit 8 ft. high fences in certain instances and will provide for physical protection for fences in parking lots.
