FOR THE FOLLOWING REASONS:
1. The continuance will allow time for Shell Oil Company to
submit a letter to guarantee that a service station will not
be constructed on the northwest corner of Warner Avenue and
Gothard Street if this request is approved.
2. The City Attorney shall submit an opinion regarding the legality
and validity of the letter from Shell Oil Company.

was read by the Acting Secretary.
The hearing was opened to the
audience, there being no one to speak for or against the matter,

A MOTION WAS MADE BY LAWSON AND
SECONDED BY BAZIL TO APPROVE TENTATIVE TRACT MAP NO. 5813 UPON
THE FOLLOWING CONDITIONS:
1. The Tentative Map received September 14, 1967, shall be the
approved layout.
2. Drainage, water, and sewer plans shall be approved by the
Department of Public Works. The fire hydrant system shall
be approved by the Department of Public Works and Fire
Department.
3. A lighting system shall be installed on all private streets
and common areas with illumination at least equal to lighting
on public streets. Said lighting shall be approved by the
Department of Public Works.
4. Disposition of the existing storm drain shall be approved by
the Department of Public Works.
5. A fire alarm system shall be installed by the developer at
locations and to specifications provided by the Fire Department.
6. All utilities shall be installed underground.
7. All streets within the project shall be private streets.
8. All private street widths and corner radii shall comply with

adopted Planning Commission Standards. The property line
radius at the intersection of the private street and Highway
#1 shall be approved by the Department of Public Works.
9. Private street structural sections shall comply with Department

10. The park and recreational fee shall be based on the number of
dwelling units.
11. All "Standard Conditions.of Approval" for tentative tracts
that are applicable shall be complied with.
12.. All conditions of approval for Use Variance No. 870 shall be
complied with.

twice in the Huntington Beach News as required by the State Law.

1. The Tentative Tract Map received September 29, 1967 shall be
the approved layout.
2. Approval of Tentative Tract Map 5017 shall be null and void
unless Use Variance No. 67-58 is approved by the City Council.
.3. A 6' high masonry wall shall be constructed along the south
boundary of the tract.
4. A 10' setback shall be provided along the south boundary of
the tract.
5. All utilities shall, be installed underground.
6. All oil wells on the property shall be abandoned and all
equipment removed in accord with Division`of Oil and Gas.

7. A 10 ft. wide walkway connecting the subdivision to the school
property shall be provided at the end of the most easterly
cul-de-sac.

67-58 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS:
1. All streets shall comply with standardsproposed by the Depart-
ment of Public Works and approved by both the Planning Commis-
sion (August 3, 1965) and City -Council (September 7, 1965).
2. The'minimum front yard shall be 10 ft& except the minimum
front yard for garages entered directly from the street shall
be 22 ft. This condition of approval is not general in nature
and a precise plan shall be submitted to the Planning De art•
ment for approval prior to issuance of any building permdts.
Said plan shall delineate the house location on each lot.
3. A tree, equivalent to a 30 inch box tree, as approved by the
Park Supervisor, shall be planted in the front yard of each
lot and in the exterior side yard of each corner lot.
4. Lot sizes shall be as shown on Tentative Tract No, 5017.
5. An 18 inch wide easement for utility purposes shall be pro
vided adjacent to all sidewalks. Construction of any vertical
structure within said easement shall be approved by the Depart.
ment of Public Works.

3. Lighting for the tennis courts shall be directed away from

4. A driveway between the parking bays shall be provided along
the west side of the tennis courts to replace the existing
driveway eliminated by the tennis courts.
5. The parking requirements established by Use Variance No. 505
shall be complied with.

Mr. Sol Sher, applicant, addressed
the Commission and gave his reasons for the request. He further
objected to the dedication of a future street extending through
the proposed development.
Bill Hartge, Deputy Director of
Public Works, explained the need for a connector street in the area.
There being no other comment the hear -
ing was closed.
It was the consensus of the Commis-
sion to continue said item to November 7, 1967, in order to study
a precise plan of street alignment.
