Mayor Shipley called the regular adjourned meeting of the City Council
of the City of Huntington Beach, to order at 4:30 PM.
The Pledge of Allegiance was given by all present in the Council Chamber.

On motion by Bartlett, the minutes of the regular meeting of October 2,
19671, and the regular eating of October 1.6, 1967, were approved and
adopted as prepared and riled by the City Clerk. Motion carried.

The Clerk Clerk introduced Miss Ann Martin, City Clergy of La Mirada,
California, who visited the City Council meeting.

The Clerk presented a transmittal from the Planning Director submitting
final form of Trutt '-mao 6354 for ado do as follows.- Developer, Helen
Investment Company, Inc. , Location: Southeast curer of Yorktown Avenue
and Bush rd Street-, Acreage: 8 9 05 ; Lots- 41; that the map had been
certified by the Director of Public: Works and the Secretary to the
Planning Commission to be true and correct in accordance with provisions
of the City Subdivision Code.

BUS BENCHES
The Clerk presented a communication from the Planning Commission re-
commending removal, of all bus benches not on existing bus routes, and
benches on bus routes displaying advertising, and replacement of same
with benches of a more aesthetic appearance.
On motion. by Kaufman, Council directed the City Staff to stu.'dy the cost
of removing bus benches and replacing the€ with a bench of more
aesthetic design. Motion carried.

The Clerk presented a transmittal from the Planning Director submitting
final form of Tract Map 6404 for adoption as follows: Developer: Bs A
Berkus, Association; Location: south of ,Admiralty Drive, oast of Highway
#1; acreages 1.3927; Lots: 10& that the map had been certified by
the Director of Public Works and the Secretary to the Planning Commission
to be tans and correct in accordance with provisions of the City
Subdivision Code.

The Clerk presented a. communication from the Director of public Works
stating that work on the Adams Avenue Bridge extension had been
satisfactorily completed, and recommending that Council accept the. work
on Project CC -050,
On motion 'by Kaufman, Council accepted the work on Project CC-05G
Adam-s Avenge Bridge extension, completed by Galloway & Christopher,
and directed the City Clerk to file a Notice of Completion with.. the
Orange County Recorder. Motion carried.
SUBDIVISION AGREENT - STATER DEV CO - TRACT 5923
The Clerk presented a transmittal from the Director of Public Works:
of - Monument Bond, Improvement Bonds and Subdivision ,Agreement for
`:bract 923 - Slater Development Company.
On motion by Kaufman, Council accepted Monument Bond No. 15-3-8 -84,
1 pro -Fervent Bond No. 1-.3-8883 - Continental Nationale Ias ranee. Group;
approved Subdivision Agreement for Tract 5923, and authorized the Mayor
and City Clerk to execute the document on behalf of tie City. Motion
carried.
REASSIGNMENT - REIMBURSEMENT AGREEMENT „NO__110
The Clerk presented a document transmitted from. the Director of Public
Works which reassigns Reimbursement Agreement No. 110 for drainage
purposes from the Huntington -Valley Bank back to Oka Brothers
On motion by Kaufman, Council accepted the Reassignment Agreement for
Reimbursement Agreement No. 11.01,and directed the City Clerk to file
same, Motion carried.
CC- 0 2 .n NOTICE OF CO3MPLETION - YOD R & SONS
The Clerk presented a communication from the Director of Public Forks
stating that work on. Nichols Street had been satisfactorily completed,
and recommending that Council accept the work on project CC-072R
an motion by Kaufman, Council accepted the work on Project C-072
Nichols Street Improvements, completed by Yoder and Sons, and directed
the City Clerk to file a Notice of Completion with the Orange County
Recorder. Motion. carried.

The 'Clerk presented a transmittal from the Director of Public: Works
of plans, specifications, Notice Inviting Sealed Bids and Resolution
for the construction of Storm Drain facilities on Seventh. Street, Kim
Lees, and Frankfort Avenue.
On motion by Kaufman, Council approved the plans and specifications
for the construction of storm drain facilities on Seventh Street, Kim
Lane and Frankfort Avenue, and directed the City Clerk to advertise

on or about July 23, 1967, in an automobile collision with. a City
vehicle.
On motion by Green, Council denied the claim filed for Carolyn Bowden,
and referred saes to the City Attorney and the City' insurance car Lars

The Clerk presented a clefs filed by Robert Quint for -alleged damages
to his car by a City vehicle on or about October 14, 1967.

and referred same to the City Attorney and the City's Insurance

ONO TERMINATION
The Clerk presented a recomendation from the Oil Superintendent that
Snyder and Weaver Clean Up Bond $240078 and Drilling Bond #240076
Well. "Tov .tt #111, on Lots 9 and 10, Block 107, Huntington Reach Tract,
be exonerated.
On otion by Stewart, Council authorized the termination of the
Drilling Bond and Clean 'Up Bond, mid directed the Oil Superintendent
to notify the bonding Company. Motion carried.

BOND TERMINATION
The Clerk presented a recommendation from the Oil Superintendent that
Signal Associates Drilling and Clean-'11p Bond Nos. 12 910 and 122911
e exonerated as subject bonds have been replaced by surety frond
v218801.
On motion by Stewart, Council authorized the termination of the Drilling
and Clean Up Bonds, and directed the Oil Superintendent to notify the
Bonding Company. Motion carried.

The Clerk presented,a communication from the Assistant City attorney
requesting authori.Eation to Tile Civil Action on Mrs. Frances R.
gage, Mr. Joe L. Bo all, and Mrs. inn Meyer to recover casts of
repairing damaged City property.
On motion by Bartlett, Council authorized the filing by the City
Attorney's Office of civil actions against said defendants. Motion
carried.

SENATE BILL NO 1306
The City Administrator informed Council of the desirablUty for the City
to support Senate Fill Nos 1306, which..would permit commercial hanks
to underwrite and invest in m-u,nici.pal revenue bonds.
On motion. by Stewart, Coimcil en,dpraed Senate bill No. 1306 znd directed
the Cites Attorney to prepare a Resol.u.tion t6 be forwarded to the Senate
Banking and Currency gomittee 4 urging passage of Senate Fill No1306

BEACH_ XETFR _PARKING
The City Administrator presented a comniunication from the Di.ractur of
Harbors and Beaches recommending that the ,parking meter fee for those
meters paralleling Ocean Boulevard be in -creased from 5 cents per half
hour to 25 cants per hour, with a 6 .ham maxum, 'on 'a 2_4 hour basis.
On :motion. by Kaufman,, Council directed the Attorney to prepare au
Ordinance authorizing the necessary mechanical alterations to the meters
on Ocean Boulevard, and an the east ,side of First Street from Ocean.
to Atlanta Avenue, to require a 2 cent an hour parking fee; said ordinance
to become effective when the rates for the new beach parking 'Lot" become
effective: Motion carried.

BEACH CONCESSION _ RENEWAL LEASES
The City Administrator informed the Council that all the beach con-
cessionaires have signed leases with the City wherein they agree
to rebuild their structures to than satisfaction of the City in

On motion by' Kauf an, Council adopted the following minute action: -
"It is agreed that 'whew. the City has approved the plan and specifications
and the proper -permits are issued and the building; is constructed in
substantial compliance with the plans, specifications and permits,
that this will be deemed to be the extent of the duty of the lessee
under the agreement and the lessee will theca. be given the new lease
and option without any further obligation on his part.
"It is further agreed that the option to renew for an additional tan
years will be solely at the option of the lessee, upon the terms
indicated in our present agreement.
"It is further agreed that in the event a lender foreclosed against
the lessee '�- interest in the structure or improvements, that the
le der ould have the right to transfer the assets to a responsible
third party, providing the City. approves the purchaser and. the terms
of the present agreement are met." Motion carried.

The City Administrator informed the Council that a public hearing
would be held Friday, December Ist, at 10a00 A.M. in the Huntington
Beach High School Auditorium by the State Division of Highways
concerning the proposed route of the Huntington Beach ---Freeway.
Councilman Green made a motion to set a. public hearing in the Council
Chambers on November 20th to determine the City' position an the
proposed route, but the motion was wi.thdra�,m before being put to a vote

The City. Administrator presented a request from the Public Works
Department to purchase one motor grader.
On motion by Gisler, Council authorized the purchasing department
to negotiate the purchase of a motor grader for the aum of
$17,500.00 plus applicable taxes. Motion carried.

BID AWARD, - PARING AREA ON BEACH
The City Administrator informed the Council that bids had been received
for the paving and resurfacing of the parking area on the ,beach and
recommended Council accept the low bidder.
On motion by Bartlett, Council authorized the; acceptance ofthe low
bid for the paving of the parking area on the beach, subjedt to the
acquisition of the title to than property. Iviotion carried.

The City Administrator informed the Council that all interviews for
the vacant positions on the Planning Commission had beea-compaeted
and that the appointments could be made by the Co nci L
On motion by Green, Council approved the appointments of Ricbard Lane
Toms Cx R. Miller, and Charles -Lane to fill the vacated positions on
the PlanningCommission, with tee expiring gone 30, 1971; and directed
the Clark to prepare a service plaque for the retiring Czmmiasioner,
Kenneth Lawson. Motion carried.

concerning the mandatory retirement age. Motion carried.

had been completed by the Robert H. Grunt Company, and ,the Public Works

The Clerk presented a Letter from Jerry S. Gillespie, Safety Chairman,
for Surfaide Assoc. 1 requesting police enforcement of the State
Vehicle Code on non -dedicated streets, painting of white center line
on certain dedicated streets, placement of strap signs and posting
of speed li. its
. motion by Coen, Council received the letter from fir. Jerry S a
Gillespie, ordered same filed by the Linty Clerk, and directed the
Administrator to send copies of the Staff Report to Mr. Gillespie.

The Clerk presented a Lotter from the Board of Directors of the Villa
Pacific Community Association requesting an opportunity for one of
their Directors to appear before Council to discuss obtaining police
patrol service on their streets and allays
Mr. William Thompson, 9736 Bluereef Drive, City, addressed the Council
and discussed the problems of not having polies enforcement on their
streets, .
Council discussed the problem with Mr. Thompson a.n.d requested the City
Attorney to supply Mr. Thompson with information concerning the
patroling of private t eta,,as stipulated in the Vehicle Code. Thera
was no action taken on the matter at this time.

PROTEST - ISSUANCE OF PERMITS m WATERFRONT'PROPERTY
The Clerk presented a letter from Gerald A. Jones stating that residents
and property Hers of waterfront property along the canal in Sunset
Beach,, requesting the City of Huntington Beach to deny issuance of
building permits for ducks, floats, moorings or other structures in
the Ramora Channel - Lot A, Tract 55 m until public hearings are
bald and a pier bead line established,
Ch-i motion by Green, Council xeferred the request of Gerald A. Jones
to the City Attorney for disposition. Motion carried.
APPLICATION - BUSINESS LICENSE - RUBBISH REMOVAL
The Clerk presented a letter and application from. Dee 's Rubbish
Service,, 2113 Canyon Drives Gaeta Mesas for a business -license to
pick Grp conmer .ial. and industrial rubbish. The Clark informed the
Council that neither an application for Certificate of Nand and
Necessity, a bond, nor filing fee had been received, as required
by Article 325 for the Huntington Beach Ordinance Coda.
On motion by Bartlett, Council tabled the application for a business
license forte; Dewey's Rubbish Service, and directed that the firm be
informed of the need for an application for a Certificate of Need
and Necessity. Motion carried.

Q,UEST TO STEAM WELL - ELDORADO OIL CO
The Clerk pre-:,,,,,ted a letter from Eldorado Oil Company requesting per-
mission to,steam a well at 17th Street and Magnolia Avenue for a period
of ten days, with only temporary fencing ratherthan a. block wall fence
Mr,, Ralph Olivette, General Manager of Eldorado Oil Company, addressed
the Council requesting permission to ;steam the well and informed the
Council of the precautionary steps that would be taken by his firm in
performing the operation.,
On motion by Green, Council granted permission for the steaming of
the well for a period not to exceed three weeks, subject to the erection
of a temporary interweaving chain link fence, approval of the Fire and
Oi.l. Departments, and with the stipulationthat all fees on wells on

The Clergy presented petitions from R R N. and Marcia M. Pyles, Harold
Harper and Melvin Harper, and Thelma Ceibau h and Teo Johnson, requesting

and east of the eastern boundary of the City of Huntington Beach, This
property comprises five acres and has been approved by the Local Agency
Formation Comiission,

PUBLIC HEARING ZONE CASE NO 67-25 APPROVED
Mayor Shipley announced that this was the day and hour set for a public:
hearing on Zone Case No,, 67-25, can property located on the north side

Mr. Jerry Matney, 19846 Leighton Lane, City, addressed the Council and
stated his objection to the subdivision -sign being place in a residential
tract.
City Attorney Dale Bush informed the Council that the sign had been
erected in accordance with all the stipulations sat forth in the
Subdivision sign ordinance, and it was his opinion that the Planning
Commission lacked the authority to act on the removal of the sign.
Mr. Mark porter, 1 842 ,Providence lane, City, addressed the Council ,and
informed them that he believed that various sections of the ordinance
coda in relation to this matter were conflicting, and that abui.ldin
permit should not have been issued for the erection of the subdivision
sign,
Mr. Richard Volpert, an Attorney representing Deane Brothers, addressed
the Council and informed them that the applicant had obta&ned a building
permit as required by ordinance, and the sign had already been constructed
at an approximate cost of $2200. Mrs Volpert stated that Deane Brothers
had complied with all necessary requirements for the erection of said

and requested Council to overrule the decision of the Planning
Commission. He stated that this ,was the only glace they couldput

result in hardship for the developer, and stressed its importance
to the City. He informed Council that the lake ,area would be developed
into a park area and dedicated to the dity.
Mr, Don Owen, an employee of the orange County Water District, addressed
the Council and informed them of the water situation in the area, and
that because ®f the favorable conditions, the lake old remain, at its
present level.
Mr. Richard Bigler, representing, Richard's and Associates, addressed
the Council and stated that be believed this to be a great asset to
the City if it were to be developed properly.
Mrs,, Lorraine Faber, a 'member of the City Recreeti on, and parks
Comission, addressed the Council and requested Council'' approval of
the Use Variance and Tentative Tract Map.

FENC I G OF STANDING WATER.
Councilman Green requested information from the Director of Building.
and Safety on the progress of the fencing of standing water -and
dangerous areas in the City. Mr. Cleveland - informed the Council that
the fencing and filling in of the gravel pit area in the vacinity of.
Springdale was being completed and that other areas were being
handled.
On motion by Green, Council directed the Director of Building and.
Safety to-follaw through with the fencing and posting of signs, at
the area standing water between Delaware Street and Huntington
Street, Motion carried.

MAID STREFr - DRAINAGE
Councilman Bartlett informed the staff of a drainage problem on Main
Street in the area. of Huntingtcm Beach High School and requested the
Public Works department to make a study and report back try Council.
CHARTER AMENDMENTS
On motion by Coen, Council directed the Attorney to contact Harry
Williams to prepare amendr nts to the present City Charter to make
the present elected officials, appoifttive¢ i.e. City Clergy, City
Attorney, and the City Treasurer. Motion carried.

Mayor Shipley called an informal meting of the City Coancil of October 30th,
1967, at 7:30 P.M. in , the Council Chambers for the purpose of discussing
the new proposed Lake Park Clubhouse.
