National Bank Building Huntington Beach, California Wednesday, November 29, 1967 BOARD MEMBERS PRESENT: John Mandrell, Richard Harlow, Sam Ferguson. BOARD MEMBERS ABSENT: None The Chairman stated that the next three items on the Agenda pertain to the same parcel of land and suggested that the hearing be opened to the audience on all three items. AREA VARIANCE NO. 67-89 Applicant: Charles Franklin To allow a detached sign, approximately 174.5 sq. ft. in area, to be located in the front yard setback in deviation to the maximum 140 sq. ft. of sign area. Located on the north side of Edinger Avenue, approximately 300 ft. east of Edwards Street. Legal description on file in the Planning Department Office. DIVISION OF LAND NO. 67-35 Applicant: Charles Franklin To allow into 2 separate parcels located of Edinger Avenue, approximately Edwards Street. USE PERMIT NO. 67-42 Applicant: Charles Franklin a division of land on the north side 250 ft. east of To allow construction of a drive-in restaurant in the C-4 Highway Commercial District. Located on the north side of Edinger Avenue, approximately 250 ft. east of Edwards Street. The hearing was opened to the audience -on Area Variance No. 67-89, Division -of Land No. 67-35 and Use Permit No. 67-42. Mr. Franklin, the applicant, explained the requests. L. Salveneschi and Louis Berman, representing McDonald's Drive-in Restaurant, addressed the Board and explained that the lighting system will be oriented away from the abutting residential property. They -also stated that their building will be setback 200' from the abutting residential property. Robert DeGuise, abutting residential property owner, asked various questions regarding the proposal. AREA VARIANCE NO. 67-89 A MOTION WAS MADE BY FERGUSON AND SECONDED BY MANDRELL TO DENY AREA VARIANCE NO. 67-89 FOR THE FOLLOWING REASON: 1. The applicant failed to demonstrate sufficient hardship. ROLL CALL VOTE: AYES: Mandrell, Ferguson, Harlow NOES: None ABSENT: None THE MOTION CARRIED. USE PERMIT NO. 67-42 A MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL TO APPROVE USE PERMIT NO. 67-42 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Driveway locations shall be approved by the Traffic Engineer. 2. Outside lighting shall be directed away from abutting residential uses. 3. There shall be no outside speakers. 4. Two blacktop berms shall be installed within the easement located along the north and east property lines for speed control. Said berms shall be placed no more than 100 ft. on center. 5. Edinger Avenue shall be fully improved to City Standards. ROLL CALL VOTE: AYES: Mandrell, Ferguson, Harlow NOES: None ABSENT: None }THE MOTION CARRIED. DIVISION OF LAND NO. 67-35 A MOTION WAS MADE BY MANDRELL AND SECONDED BY HARLOW TO APPROVE DIVISION OF LAND NO. 67-35 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Edinger Avenue shall be fully improved to City Standards at the time each parcel is developed. Improvements shall include street trees and street lights. 2. A parcel map shall be filed with the City and recorded. 3. Division of Land No. 67-35 shall not be effective until an agreement is signed and recorded agree- ing to the conditions listed above. , ROLL CALL VOTE: AYES: Mandrell, NOES: None ABSENT: None THE MOTION CARRIED. Planning Commission Wednesday, November 29, 1967 Page No. 3 AREA VARIANCE NO. 67-80 Applicant: Anthony Bartoli To permit a 4' exterior side yard setback; garages entered off an alley setback 61; garages entered directly off a street setback 4'; waive 10' alley corner cut-off; 8 garages facing a street with 125' of property frontage. Located on the southeast corner of Walnut Avenue and 8th Street and legally described as Lots 20, 22, 24, 26, 28 of Huntington Beach Tract, Block 107. The hearing was opened to the audience. There being no one present to speak: -for or against the matter, the hearing was closed. _ It was noted that a revised plot plan has been submitted to the Planning Depart- ment which conforms to the code with the exception of a 4' exterior side yard setback and a 20' setback for garages entered from the street. Lengthy discussion was held on the revised plot plan. A MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL TO APPROVE THE REVISED PLOT PLAN FOR AREA VARIANCE NO. 67-80 SUBJECT TO THE FOLLOWING CONDITIONS: 1. A 10' x 10' corner cut-off shall be provided where the driveways exist on Walnut Avenue. 2. The garages shall be setback 22' ROLL CALL VOTE: AYES: Mandrell, Harlow, Ferguson NOES: None ABSENT: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 67-6 Applicant: William L. Jones To allow a variation to the screen wall requirements as set forth in Sec. 9792.1.1.1, Off -Street Parking. Located 7660 Liberty Avenue and legally described as Lot 8 of Tract 5899. The proposed request was reviewed and discussed by the Board. A MOTION WAS MADE BY FERGUSON AND SECONDED BY MANDRELL TO APPROVE ADMINISTRATIVE REVIEW NO. 67-6 SUBJECT TO THE FOLLOWING CONDITIONS: 1. A cap shall be provided along the top and bottom of the fence. 2. The fence shall be boxed in and adequate post supports installed. -3- 11/29/67 Minutes: H.B.
