COMMISSIONER TON: USE VARIANCE NO. 67-69 - Continued Applicant - Bert Harding Commissioner Tom arrived at 7:05 P.M. and assumed his duties. To permit the following: 1) A real estate office in the R-A. Residential Agricultural District; 2) Waiver of balance of required street improvements; 3) Waiver of the installation of underground electrical and telephone utilities, and 4) Waiver of the requirement to construct a -screen wall per Article 979. This case had been set aside to enable the applicant to appear and express his opinions. TENTATIVE TRACT MAP N0. 5603 - Continued USE VARIANCE NO. 67-53 Subdivider - Deane Brothers To permit the following: 89 Lots on 17.7 Acres. 1) Reduction of street rights of way widths from 60' to 56' and modification of knuckles and cul-de-sacs as shown on T.T. #5603. 2) Reduced minimum lot frontage on cul-de-sacs and knuckles as shown on typical plan. (Exhibit B) 3) Reduction of minimum front yard setbacks to "zero" on cul-de- sacs and knuckles and 10' on standard rectangular lots. 4) Reduction of minimum side yard setbacks to 0'--on one side of a lot, provided 10' minimum. side yard is maintained on the opposite side of the same lot. 5) Encroachment of architectural features into the required 30 inch setback along a side yard where the setback has been re- duced to 0, with the provision that no architectural features may project beyond any side property line. NOTE: Items 3, 4 and 5 are requested to permit a dwelling and/or garage to be constructed on a designated side property line. Planning Commission Tuesday, December 5, 1967 Page No. 5 Robert Galloway, engineer for the subdivider addressed the Commission and stated there were no objections to the suggested conditions for Tentative Tract No. 6317 and Use Variance No. 67-71. A petition signed by 65 property owners objecting to the proposal was submitted to the Commission. John Richards, Fountain Valley Planning Department, addressed the Commission and objected to the proposal on behalf of,the City of Fountain Valley. Mr. Arneson, 18986 Santa Catherine, Fountain Valley, and Richard Lefleche, 18985 Santa Catherine, Fountain Valley addressed the Commission and objected to the proposal., Robert Raab, applicant, addressed the Commission and explained the project. There being no other comment, the hearing was closed. A MOTION WAS MADE BY MILLER AND SECONDED BY LANE TO GRANT A ONE YEAR EXTENSION OF TIME FOR TENTATIVE TRACT MAP NO. 6317 UPON THE FOLLOWING CONDITIONS: 1. All conditions of approval of the previous tentative tract map shall be complied with. 2. All provisions of Article 998, Park and Recreational Facilities shall be complied -with. 3. Approval of this tentative map shall be null and void unless Use Variance No. 67-71 is approved by the City Council. A MOTION WAS MADE BY MILLER AND SECONDED BY LANE TO RECOMMEND APPROVAL OF USE VARIANCE NO. 67-71 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS: 1. All streets shall comply with standards proposed by the Department of,Public Works and approved by both the Planningg Commission (August 3, 1965) and City' -Council (Sept. 7, 1965). 2. The minimum front yard shall be 10 ft. except the minimum front yard for garages entered directly from the street shall be 22 ft. This condition of approval is not general in nature and a precise plan shall be submitted to the Plan- ning Department for approval prior to issuance of any build- ing permits. Said plan shall delineate the house location on each lot. 3. A tree, equivalent to a 30 inch box tree, as approved by the Street Tree Supervisor, shall be planted in the front -5- 12/5/67. An 18 inch easement for utility purposes shall be provided adjacent to all sidewalks. Construction of any vertical structure within said easement shall be approved by the Department of Public Works. Mr. Harlow also submitted a report outlining the cost of full street improvements along Beach B1vd.,and Talbert -Ave. The hearing was opened to the audience. 11, Bert Harding, applicant, addresse the Commission and stated his reasons for the request and for the waiver of street improvements. Mr. Harding stated that he will provide the required landscaping. There being no other comment the hearing was closed. A FURTHER_ MOTION WAS MADE BY LANE AND SECONDED BY MILLER TO APPROVE USE VARIANCE NO. 67-69 UPON THE FOLLOWING CONDITIONS: 1. Talbert Avenue and Beach Blvd. shall be improved to City and State Standards. Improvements shall include curb, gutter, pavement, street trees and street signs. 2. All streets shall conform to City of Huntington Beach,Standards. Master Plan of Arterial Streets and Highways shall apply where applicable. Street sections shall be determined by soil "RIf value and traffic index. 3. All provisions of Article 979 shall be complied with except the required screen wall may be eliminated. 4. The City Council overruled the Planning Commissions previous decision and waived all,requirements for the subject property. ZONE CASE NO. 67-34 Applicant - J.E. Kettler Change of zone from R-A-Residential Agricultural District to C-2 -8- 12/5/67 Minutes: H.B. Planning Commission Tuesday, December 5, 1967 Page No. 9 Community Business District with a 50 ft. setback from the ultimate right-of-way lime. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. Frank Clendenen, .representing the applicant, addressed the Commission and asked for clarifi- cation of the C-4 zone. There being no other comment the hearing was closed. It was noted that the Master Plan of Land Use designates this property for retail commercial use. RESOLUTION NO. 67-34 A Resolution of the City Planning Commission Recommend- ing Approval of Zone Case No. 67-34 for a C-4 zone rather than C-2 to the City Council. A MOTION WAS MADE BY TOM AND SECONDED BY ROYER TO ADOPT RESOLUTION NO. 67-34 RECOMMENDING APPROVAL OF ZONE CASE NO. 67-34 TO THE CITY COUNCIL FOR A C-4 ZONE RATHER THAN C-2 AS REQUESTED FOR THE FOLLOWING REASON: 1. -The Master Plan of Land Use designates the subject property for retail commercial use. ZONE CASE NO. 67-33 RESOLUTION OF INTENT Change of zone from Ml Light Industrial District to R-3 Limited Multiple Family Residence. The Acting Secretary made a presentation of the proposal. The hearing was opened to the audience. R. C. Rayley, representing the Pacific Railroad, Anaheim, addressed the Commission and objected to the proposed R-3 along the railroad property. McFadden Avenue -shall be dedicated -to City Standards. 2. McFadden Avenue and Gothard Street shall be fully improved when requested by the Department of Public Works. 3. The Commission reviewed the proposal and it was their unanimous opinion to recommend approval of the R-T portion of the request adjacent to the Single Family homes in Huntington Beach.
