Tuesday, January 2, 1968
Mayor Shipley called the regular meeting of the City Council of the
City of Huntington Beach to order at 4:30 P.M.
The Pledge of Allegiance was given by -all present in the Council
Chamber.
The Invocation was given by Reverend Lawrence Young, Minister of the
Community Methodist Church.

On motion by Bartlett, the minutes of the regular meeting of December 18.,
1967, were approved and adopted as prepared and mailed by the City
Clerk. Motion carried.

ZONE CASE No 67-31
The Clerk presented a communication from the Planning'Department
transmitting Zone Case No. 67-31 for change of zone from.R2 to R5
on property located north of Newman Avenue, approximately 284 feet
east of.Cameron Street, The Planning Commission recommended denial.
On motion by Green, Council directed the City Clerk to set a public
hearing.for Monday, January 15, 1968; to publish notice of same,
and to notify all property owners on Newman Avenue, east of Beach
Boulevard. Motion carried.
TRACT MAP NO. 6528 - APPEAL TO C2NDITIONS'OF PLANNING COMMISSION
The Clerk presented an appeal by Dutch Haven Homes to the conditions
imposed by the Planning Commission in their ,approval of Tentative
Tract Map No. 6528.
Mr. John Horner, representing Dutch Haven Homes, addressed the Council
and discussed the reasons his company was appealing the conditions.
On motion:by Coen, Council sustained the Planning -Commission recom-
mendation and -approved Tentative Tract Map 6528, with the conditions
imposed by the Planning Commission-. Motion carried.

UV 67-74 - CONDITIONAL EXCEPTION - DUTCH HAVEN DOMES
The Clerk presented a transmittal from the Planning Department of
Conditional Exception - UV 67-74 - Dutch Haven Homes, located on the
northeast corner of Slater Avenue and Coldenwest Street. The Planning
Commission recommended approval, with conditions.
On motion by Coen, Council approved UV 67-74., with conditions 1
through 5 as recommended by the Planning Commission; deleting
Conditions 6 and 7 and replacing Condition 6, with the following,
The length of B Circle and all lot depths shall be substantially
the same as shown on the approved map; and directed the City Attorney
to prepare a Resolution approving UV 67-74., with conditions as
heretofore stipulated by the Council. Motion carried.

TRACT 6326 - DEDICATION OF IMPROVEMENTS
The Clerk presented a communication from the Director of Public Works
recommending acceptance of dedicated improvements, authorization for
release of the Improvement and Monument Bonds, and termination of the
Subdivision Agreement on Tract No. 6326 - S.D.C. Incorporated.
On motion by Stewart, Council. -accepted improvements dedicated for
public use in Tract No. 6326; authorized the release of Improvement
and Monument Bonds and termination of the Subdivision Agreement, and
directed that the developer be notified by the City Clerk and the
bonding company be notified by the City Treasurer. Motion carried.
CC-064 - NOTICE OF COMPLETION- REX W MURPHY
The Clerk presented a communication from the Director of Public Works
stating that work on the Warner Avenue and Golden West Street bridge
widenings had been satisfactorily completed, and recommending Council
accept the work on project CC-064.
On motion by Stewart, Council accepted the work on Project CC-064 -
Warner Avenue and Golden West Street Bridge widenings, completed by
Rex W. Murphy, and directed the City Clerk to file a Notice of Comple-
tion with the Orange County Recorder. Motion carried.

CC-085 TRAFFIC SIGNALS - VARIOUS INTERSECTIONS
The Clerk presented a transmittal from the Director of Public Works
of plans, specifications, Notice Inviting Sealed Bids and Resolution
for the installation of traffic signals - at Warner. Avenue at Newland
Street, Springdale Street at Heil Avenue, and Edinger Avenue at Gothard
Street.
On motion by Stewart, Council approved the plans and specifications.
for the construction and installation of traffic signals at said inter-
sections, and directed the City Clerk to advertise for bids when
directed by the Director of Public Works Motion carried.
The Clerk read Resolution No. 2676 by title "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING THE GENERAL-
PRE-VAILING RATE OF HOURLY WAGES FOR EACH CRAFT�OR TYPE,OF WORKMAN OR
MECHANIC NEEDED FOR THE CONSTRUCTION OF STREET IMPIOVEMENTS, CHANNELIZA-
TION, AND SIGNALIZATION OF THE FOLLOWING INTERSECTIONS- WARNER AVENUE

CLAIM NO.34-67--HOWARD M PORTER

The Clerk presented a claim filed by Farmers Insurance Exchange on
behalf of Howard M..Porter for -alleged damages to vehicles on or
about September 27, 1967, caused by Bitumas Spray.
On motion by Bartlett, Council denied the claim filed for Howard
M. Porter, and referred same to the City Attorney and the City
Insurance Carrier. Motion.carried.
QUIET TITLE ACTION
The Clerk presented a request from the City Attorney to file quiet
title actions or to obtain.deeds on Lot 7, Block 1801, Vista Del
Mar Tract, and Lots 9, 11, 13, 15, Block 515,. 17th Street Section..
On motion.by Stewart, Council authorized the City Attorney to proceed
with the Quiet Title action to secure deeds on said lots.. Motion
carried.

OIL BOND - INDIVIDUAL OIL OPERATORS
Mr. A. C. Marion, 18892 Main Street, City, addressed the Council and
discussed the oil bond requirements, stating that the bond appeared to be
more of a total -compliance bond than the suggested cleanup bond.
Mr. Miller, City Administrator, discussed with the Council a survey of
surrounding cities in regard to oil bonds.
Councilman Coen made a motion to direct the City Attorney to revise
the oil bond form to delete the total compliance clause and to make
it a cleanup bond only. When put to,a vote the motion failed.
RECESS
Mayor Shipley called a recess of the Council at 6:15 P.M. The
Council was reconvened at 7:30 by the Mayor.
RESOLUTION NO. 2675 - ADOPTED - ACQUISITION OF PROPERTY
The Clerk had read Resolution No. 2675 by title during the afternoon
session of the Council meeting, with action being deferred to the
evening session.
Mr. Joseph Ferm, 17581 Gothard Street, City, addressed the Council
and requested information about the present real estate prices and
values of the property being purchased by the City.
Mr. Brander Castle gave a report on the reasons for the purchase of
certain property by the City.
On motion by. Stewart, Council waived further reading of Resolution
No. 2675, and passed and adopted same by the following roll call
vote,

Mayor Shipley announced that this was the day and hour set for a
public hearing on Zone Case No. 67-35, on property located at the
southeast corner of Warner Avenue and Graham Street, and directed
the Clerk to read the legal notice,
The Clerk read notice of public hearing on Zone Case No. 67-35, as
published in the Huntington Beach News on December 21, 1967, setting
the hour of 7:30 P.M., or as soon thereafter as possible, on Tuesday,
the 2nd day of January, 1968, in the Council Chamber of the Civic Center,
Huntington Beach, California, as the time and place for a public hearing
for the purpose of considering a petition for a change of zone to
regulations of the Districting Ordinance from R3 Limited Multiple Family
Residence District, to RI Single Family Residence District.

The Clerk informed the Council that they had been provided with copies
of the Planning SecretaryFs transmittal, recommending approval, and
stated that he had received no communications or written protests to
Zone Case No. 67-35.
Mayor Shipley declared the hearing open
There being no one present to speak on the matter, and there being no
protests filed, either oral or written, the hearing was closed by the
Mayor.
On motion by Kaufman, Council directed the City Attorney to prepare
an Ordinance effecting the change of zone in Zone Case No. 67-35.

Mayor Shipley announced that this was the day and hour set fora public
hearing on.Zone Case No. 67-36, on property located at the northeast
corner of Banning Avenue and Bushard Street, and directed the Clerk to
read the legal notice.
The Clerk read notice of.public hearing on Zone Case No. 67-36, as
published in the Huntington Beach News on December 21, 1967, setting
the hour of 7�30 P.M., or as soon thereafter as possible, on Tuesday,
the 2nd day ofJanuary, 1968, in the Council Chamber of the Civic
Center, Huntington Beach, California, as the time and place fora
public hearing for the purpose of considering a petition for a
change of zone to regulations of the Districting Ordinance from R2
Two Family Residence District to RI Single Family Residence District.
The Clerk informed the Council that they had been provided with copies
of the Planning Secretary's transmittal, recommending approval, and
staged that he had received no communications or written protests to
Zone Case No. 67-360
Mayor Shipley declared the hearing open.
There being no one present to speak on the matter, and there being no
protests filed, either oral or written, the hearing was closed by the
Mayor,
On motion by Stewart, Council directed the City Attorney to prepare an
Ordinance effecting the change of zone to Zone Case No. 67-36. Motion

PUBLIC
HEARING - UV 67-29 m APPEAL - PACIFIC SHORES REALTY - APPROVED
Mayor Shipley announced that this was the day and hour set for a public
hearing on an appeal by Pacific Shores Realty to conditions stipulated
by the Planning Commission in granting Use Variance 67-69, located at
the corner of Talbert Avenue and Beach Boulevard, and directed the
Clerk to read the legal notice.
The Clerk read notice of public hearing on Use Variance No. 67-69, as
published in the Huntington Beach News on December 21, 1967, setting
the hour of 7030 P.M., or as soon thereafter as possible, on Tuesday,
the 2nd day of January, 1968, in the Council Chamber of the Civic
Center, Huntington Beach, California, as the time and place for a
public hearing on an appeal to conditions stipulated by the City
Planning Commission in granting Use Variance No. 67-69, requesting.a
waiver of the conditions, as follows-

1. Talbert Avenue and Beach Boulevard shall be improved to City and
State Standards. Improvements shall.include curb, gutter, pavement,
street trees and street signs.
2. All Streets shall conform to City of Huntington Beach standards.
Master Plan of Arterial Streets and Highways shall apply where
applicable. Street sections shall be determined by soil "R"
value and traffic index.
3. All provisions of Article 979 shall be complied with except the
required screen wall may be eliminated..
4. Use Variance No. 67-69 shall become null and void on January 1,
1970.
The Clerk informed the Council that they had been provided with copies
of the Planning Secretary's transmittal, recommending.approval with
conditions, and that he had received no communications or written
protests other than the letter of appeal.
Mayor Shipley declared the hearing Qpen-
Mr. Bert Harding, representing Pacific Shores Realty, addressed the
Council and explained why the Pacific Shores Realty Company had
appealed the conditions stipulated by the Planning Commission.
Mr. R. Williams, Lakewood, addressed the Council and stated he felt
the property owners should be required to improve the.property rather
than the tenants. He also discussed the interest of the present
property owners in acquiring other lots in the area.
There being no one further to speak on the matter., and there being
no further protests filed, either oral or written, the hearing was
closed by the Mayor.
Councilman Green made a motion to sustain the Planning Commission
and deny the appeal to conditions on Use Variance No..67-69. When
put to a vote the motion failed.
On motion by Gisler, Council overruled the decision of the Planning
Commission and granted Use Variance No. 67-69 for one year from the
date of this meeting, waiving all conditions except the requirement
that the property be landscaped as required under Article 979 of
the Huntington Beach Ordinance Code. Motion carried..
ACCIDENT VICTIMS - COMMENDATION
The City Administrator read a letter from parents of victims of a
fatal traffic accident at the corner of Lake Street and Adams
Avenue, commending the work on various City employees in the Safety
Departments for their fast action in the emergency.
DOWNTOWN PROPERTY OWNERS & MERCHANTS
The City Administrator informed the Council that letters had been
sent to the downtown property owners and merchants informing them
of the meeting with the Council to be held on January 11, 1968.

NOTICE OF TRASH COLLECTION FEES
The City Administrator informed the Council that notification of the
proposed Trash Pick -Up Fee would be sent to every homeowner in the City
within the next week, with the fee to begin in February.

SALES OFFICE n OFFER TO CITY
The City Administrator presented an offer from Mr. William Lyons of
Dutch Haven Homes, Incorporated, to donate their sales.office building
at Banning and Bushard Streets to the City of Huntington Beach.
On motion by Gisler, Council directed the Administrator and staff to
secure estimates on the cost of moving the sales office building to
another location for City use. Motion carried.

OIL TAX s PUBLIC HEARING SET
On motion by Kaufman, Council directed that the Ordinance concerning
the Oil Business License be submitted to Council for a first reading
at an adjourned meeting to be held January 29, 1968, and directed the
City Clerk to set a public hearing on said Ordinance prior to the first

�T C SALE NO. 1015 - COUNTY OF ORANGE
The Clerk presented a letter from the Orange County Tax Collector
requesting that the City of Huntington Beach consent or object to
the sales of property designated as Huntington Beach City - Lot 7,
Block 319, and Lot 207, Tract 264, with the condition that the City
meet a minimum bid in the amount of $3,050.00. The City Administrator
recommended the City object to this sale.
On motion by Stewart, Council directed the City Clerk to notify the
County Tax Collector of the C ity's objection to the To C. Sale No. 1015;
authorized the Mayor and City Clerk to execute an agreement to purchase
Lot 7, Block 319 and Lot 207, Tract 264, for a minimum bid of $3,050.00
pursuant to provisions of Division 1, Part 6, Chapter 8 of the
Revenue and Taxation Code; and agree to guarantee expenses of purchase
and sale as set forth in Section 3793.6 of said code, by the following
roll call votes

SIGNAL OIL AND NEWLAND FAMILY

The Clerk read a letter from Rutan and Tucker, Attorneys at Law,
informing the Council that the disagreement between the Signal Oil
Company and the Newland Family concerning a proposed subdivision
development had been resolved.
On motion by Bartlett, Council received the letter from Rutan and
Tucker, Attorneys at Law, and ordered same filed by the Clerk.
Motion carried.

CI`'TY HISTORIAN - BUD HIGGINS APPOINTED
On motion by Kaufman, Council directed the City Attorney and the
Staff to prepare a Resolution establishing the position of City
Historian, with the appointment by Council of.Delbert G. Higgins,
further directed the City records be made available to him as needed
and that a fund not to exceed $500 annually be made available to him
for research purposes, with said fund to be administered by the
City Administrator, Motion carried.
MEAN HIGH TIDE LINE
On motion by Kaufman, Council directed the City Staff to survey and
extablish a mean high tide line along the City beach. Motion carried.

COMPLAINT - TRASH PICKUP
Mrs. Ann Fancher, 18041 Gulf Lane, City, addressed the Council and
complained about the trash pickup during the past two weeks. She
informed the Council the that the lack of trash pickup was very
inconvenient, especially during the Christmas holidays. She urged
the Council to think seriously of establishing a better holiday
system when passing the proposed trash contract.
INFORMAL MEETING
The Clerk reminded the Council of the.informal meetings called by
Mayor Shipley for January 8, 1968 and January 11, 1968.
ADJOURNMENT
On motion by Bartlett, the -regular meeting of the City Council
of the City of Huntington Beach adjourned. Motion carried.
