BOARD MEMBERS PRESENT: John Mandrell, Sam Ferguson,
Richard Harlow.
BOARD MEMBERS ABSENT: None
MINUTES: The Minutes of December 13, 209
279 1967 and January 3 and 10,
1968 were accepted as transcribed
and mailed by the Secretary.
USE PERMIT NO. 68-1
Applicant: Thomas A. Walker
To allow the construction of
an additional service facility and body shop to existing
sales and service facilities in the C-4 Highway Commer-
cial District. Located at 16555 Beach Boulevard and
legally description is on file in the Planning Department
Office.
The hearing was opened to the
audience.
Mrs. Shay, abutting property
owner, addressed the Board, and objected to the proposed
request. She stated that the existing body shop is con-
ducted in the open; therefore causing an over -abundance
of noise. She also stated that the lighting causes much
disturbance to the surrounding property owners.
Mr: Terhall and Mr. Walker,
representatives of the applicant, answered various
questions regarding the proposal and explained to
Mrs. Shay that a great deal of the disturbance would
be controlled.
It was noted by the Board that
a more detailed plot plan showing off-street parking
should be submitted to the Planning Department.
There being no other comment,
the hearing was closed to the audience.
Further Board discussion followed.
A MOTION WAS MADE BY FERGUSON
AND SECONDED BY MANDRELL TO APPROVE USE PERMIT.NO. 68-1
SUBJECT TO THE FOLLOWING CONDITIONS:
1. Lighting shall be directed away from nearby -residen-
tial property. I -

2. Sound deadening shall be provided on the exterior doors
of the body shop.
3. The body shop operation shall be conducted within the
building behind closed doors.
4. The portion of the building facing the west shall be
limited to service facilities only.
5. An off-street parking plan shall be submitted to
the Planning Department for approval prior to issuance
of a building permit.

THE MOTION CARRIED.
The Chairman stated that the next
five items on the agenda pertain to the same request.
He stated that the hearing was opened to the audience
on all five items.
It'was noted by the Secretary that
the Planning Commission approved the proposed code amend-
ment allowing storage of merchandise within the setback
area on January 16, 1968. He also stated that the Planning
Commission recommended to the Board that they continue
the proposed requests until a final decision is made by
the City Council on February 5, 1968.
AREA VARIANCE NO. 67-72
Applicant: Rick Baldino's Mobile World
To allow storage and/or display of
Mobile Homes and Travel Trailers within the front 50 ft.
setback area in the C-4 Highway Commercial District.
Located on the east side of Beach Boulevard, approximately
230 ft. north of Yorktown Avenue. Legal description on
file in the Planning Department Office.

The Secretary read a communication submitted
by the Orange County Planning Commission regarding County
Variance No. 6005, which would permit the conversion of
an existing single family dwelling with attached garage to
a duplex having off-street parking of less than the required
width in the R-4 "Suburban Residential" District.
The Board reviewed the matter.

AND SECONDED BY MANDRELL TO INSTRUCT THE PLANNING
DEPARTMENT TO WRITE A LETTER TO THE ORANGE COUNTY
PLANNING COMMISSION RECOMMENDING THAT USE VARIANCE NO.
6005 COMPLY WITH THE STANDARDS RECOMMENDED IN THE
SUNSET BEACH-SURFSIDE STUDY.
