TUESDAY, MARCH 19, 1968, COMMISSIONERS PRESENT: Worthy, Bazil, Tom, Royer COMMISSIONERS ABSENT: Larkin, Miller, Lane. MINUTES: On motion by Worthy and seconded by Tom the Minutes of the January 30 and February 6, 1968;meeting were accepted as transcribed and mailed by the Secretary. COMMISSIONER L ARKIN: Commissioner Larkin arrived at 7:02 PM and assumed his duties. CONDITIONAL EXCEPTION NO. 68-15 Applicant: Huntington Pacific Corporation To permit a parking lot and beach concessions in the C-1 with the following variations to the Ordinance. 1) Allow 5 gallon myoporium on 4' centers to form a continuous hedge in lieu of a masonry wall. 2) Delete the 4" base coarse under the 2" thick A.C. paving. 3) Landscaped areas to be separated from the A.C. by 'redwood header boards and protected by pre -cast concrete bumpers in lieu of raised curbs throughout. 4) Use of the existing concrete curb and sidewalks adjacent to the Coast Highway between5th and 6th Streets — The Acting Secretary suggested that the Commission continue this matter to April 2, 1968, to allow time for the City Council to review the proposal. The hearing was opened to the audience. Bill Wren, representing the applicant, addressed the Commission and stated that he had no objection to the continuance. The Acting Secretary stated that this case was continued from the March 5th"meeting to allow time for the applicant to investigate the possibility of providing additional water facilities. The hearing was opened to the audience. There being no comment, the -hearing was closed. Change of zone from R-1 Single Family Residence District to R-5 Office -Pro- fessional District and C-2 Community Business District with a 50 ft. setback from the ultimate right of way line. The Acting Secretary informed the Commission that Zone Case No. 68-5 and Zone Case No. 68-6 should be considered prior to taking action on Conditional Exception No. 68-9 and Tentative Tract No. 6575• -2- 3/19/68 Minutes: H.B. Robert Galloway, representing the applicant of Zone Case No.�68-5, addressed the Commission and gave his reasons -for the'request. Ron Wells, representing the applicant of Zone Case No. 68-6, addressed the Commission and explained the request. Mery Johnson, applicant of Zone Case No. 68=6,addressed the Commission and further explained the reasons -for the request. Mr. Tom Eagen 21122 Brookhurst Street, Huntington Beach., and Mrs. P. Llyer,, 21121 Brookhurst Street, Huntington Beach, addressed the Commission and ob- jected to the proposed service stations. There being no other comment the hearing was closed. A lengthy discussion was held. RESOLUTION NO. 68-5 A Resolution of the City Planning Commission Recommending Denial of Zone Case No. 68-5 to the City Council. A MOTION WAS MADE BY ROYER AND SECONDED BY TOM TO ADOPT RESOLUTION NO. 68-5 RECOMMENDING DENIAL OF .ZONE CASE NO. 68-5 TO THE CITY COUNCIL IfOR~ THE FOLLOWING'REASONS: 1. The Master Plan of Land Use designates this area for commercial use. 2. This request would result in a deficit of almost 5 acres of commercial property necessary to maintain a proper ratio of commercial to residential.. _ROLL CALL VOTE: AYES: Worthy, Bazil, Tom, Royer. The commercial planned for this,site amounts to a service station site and a small site for professional offices; neither of which adds greatly to the commercial needs of the area. 2. Planning Commission Tuesday, March 19, 1968 CONDITIONAL EXCEPTION NO. 68-12 TENTATIVE TRACT MAP NO. 5841 SUBDIVIDER: Fashion Homes, Inc. To permit the following: 1) 50' right -of -way -streets as indicated in TT #5841; 2) 10' minimum front yard setbacks for fences not over 6' in height, for garages with side -on -to street approach acid for other portions of a residence; (Front setback for garages entered directly from the street to be 22 ft. min.) 3) 10' minimum rear yard setback on irregular shaped lots, providing an average rear yard depth of 20' is maintained. The Subdivision Committee Report was read by the Acting Secretary. Robert Galloway, engineer for the developer, addressed the Commission and explained the proposal. A MOTION WAS MADE BY WORTHY AND SECONDED BY TOM TO APPROVE TENTATIVE TRACT MAP NO. 6576 UPON THE FOLLOWING CONDITIONS: 1. All utilities shall be installed underground. 3. -The tract shall be approved for construction of single family homes only. 4. A petition for rezoning to R-1 sh"all be filed approxi- mately at the time the final map is recorded. 5. The 10 ft. wide drainage easement shall be deleted and drainage from the subdivision shall be through "D" Avenue. 6. A lettered lot shall be provided at the southerly end of "A" Street to provide for the southerly extension of "A" Street into the 150 ft. wide strip of land south of this subdivision. Said letter lot shall be deeded in fee to the City. 7. The 150 ft. wide area designated on the map as a Buffer Zone shall be included in the final map as a numbered lot or a Division of Land application separ- ating this lot from the remaining property shall be filed with the City, approved and recorded. 8. Provisions shall be made to have the west 40 ft. of "D" Street dedicated to the City and fully improved to City Standards. 9. Paved access as approved by the Department of Public Works and Planning Department shall be provided to Newland Street. 10. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. 11. One 15 gallon tree, as approved by the Street Tree Supervisor, shall be planted in the parkway at the front of each lot and an additional 15 gallon tree, as approved by the Street Tree Supervisor, shall be planted in the parkway at the side of each corner lot. Don Loeffler,, Surfside, California, addressed the Commission and spoke in favor of the proposal. There being no other comment., the hearing was closed. A MOTION WAS MADE BY WORTHY AND SECONDED BY TOM TO RECOMMEND APPROVAL OF CONDITIONAL EXCEP- TION NO.'68-11 TO THE CITY COUNCIL UPON THE FOLLOWING CONDI- TIONS: 1. All streets shall comply with standards proposed by the Department of Public Works and approved by both the Planning Commission (August"3, 1965) and City Council (September 7, 1965). 2. The minimum front yard shall be 10 ft. except the minimum front yard for garages entered directly from the street shall be 22 ft. This condition 'of approval is not general in nature and a precise plan shall be submitted to the Planning Department for approval prior to issuance of any building permits.. Said plan shall delineate the house location on each lot. 3. A tree, equivalent to a 30 inch box tree, as approved by the Street Tree Supervisor, shall be planted in the front yard of each lot and in the exterior side yard of each corner lot. 4. The minimum lot frontage shall not be less than 50 ft. wide with 5000 sq. ft. of lot area. An average lot width of 60 ft. of frontage with 6000 sq. ft. of lot area shall be provided for each six contiguous lots in a block. 5. An 18 inch wide easement for --utility purposes shall be provided adjacent to all sidewalks on streets less than 54 ft. wide. Planning Commission Tuesday, March 19, 1968 A MOTION WAS MADE BY TOM AND SECONDED BY WORTHY TO -APPROVE TENTATIVE-TRACT•MAP NO. 6156 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map 'receive''Februar 16, 1968, shall be the approved layout. 2. Approval of.this Tentative Map shall be null and void unless Conditional Exception No. 68-11 is approved by the City Council. 3. All utilities shall be installed underground. 4. Telephone conduit from a telephone vault shall be provided at the southwest corner of Yorktown Avenue and Brookhurst Street to facilitate the installation of a fire alarm box. 5. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. ROLL CALL VOTE: AYES: Royer, Tom, Bazil, Worthy, Larkin. NOES: None. ABSENT: Lane, Miller. THE MOTION CARRIED. ZONE CASE NO. 68-7 Applicant: Fernhill Homes Change of zone from C-2 Community Business District to R-3 Limited Multiple Family -Residence District. The Acting Secretary gave an analysis of commercial needs within the area. He suggested that al- though there was a,slight siir-olu.s of commercial -zoning in the area, the Planning Commission should reduce the comm. zoning on other property which is less desirable for commercial development. The hearing was opened to the audience. Jack•Koebig, representing the applicant, addressed the Commission and gave his reasons for the request. Mac Bangoy, 6081 Annette Circle, Huntington Beach, addressed the Commission and spoke in favor of the request. There being no other comment, the hearing was closed. A lengthy discussion was held by the Commission. The location of the future freeway will reduce the amount of the projected population resulting in a surplus of commercial zoning in the area. ROLL CALL VOTE: AYES: Royer, Tom, Bazil, Worthy, Larkin. The hearing was opened to the audience. The applicant addressed the Com- mission and offered to answer questions.. There being no other comment, the hearing was closed. A MOTION WAS MADE BY ROYER AND SECONDED BY TOM TO APPROVE CONDITIONAL EXCEPTION NO. 68-13 UPON THE FOLLOWING -CONDITIONS: 1. Conditional Exception No. 68-13 shall be approved for a veterinary hospital only. 2. There shall be no outside kennel runs. ROLL CALL VOTE: AYES: Royer, Tom, Bazil, Worthy, Larkin. NOES: None. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. Dale Dowdy, representing the applicant, addressed the Commission and -gave his reasons for the request. There being no other comment, the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY BAZIL AND SECONDED BY LARKIN TO DENY CONDITIONAL EXCEPTION NO. 68-14 PER STAFF RECOMMENDATION AND FOR THE FOLLOWING REASONS: 1. THE MOTION -CARRIED. COMMISSIONER LARKIN: RECESS CALLED: COMMISSION RECONVENED: Commissioner Larkin was excused from further participation at 9:45 P.M. The Chairman called a recess at 9:56 P.M. The Commission was reconvened at 10:00 P.M. DISCUSSION: A discussion was held pertaining to present street widths.. It was the consensus of the Commission to prepare a code amendment which will provide for a modified street section. DISCUSSION: The Assistant Building Director dis- cussed the problem of interpretation of the code regarding installation of underground utilities for oil wells. It, was the consensus of the Commission that the Staff prepare an amendment to the ordinance. A MOTION WAS MADE BY TOM AND SECONDED BY WORTHY TO INSTRUCT THE SECRETARY TO SET A PUBLIC HEARING FOR A "CODE AMENDMENT TO THE UNDERGROUND UTILITIES ORDINANCE. ROLL CALL VOTE: AYES: Worthy, Bazil, Tom, Royer. NOES: None., ABSENT: Larkin, Miller, Lane. THE MOTION CARRIED. REQUEST FROM THE ACTING SECRETARY: The Acting Secretary asked the Commission if it would be possible to bring their packets to the meetings, which are mailed to them prior to the meeting, to avoid duplication.
