Conditional Exception Request: To permit the following: 1) 6000 sq. ft. average lot area with 60 ft. average of frontage for each six contiguous lots in a block, with not less than 5000 sq. ft. area or 50 ft. frontage per lot; 2) Reduction of street rights of way in accordance with the standards recommended by the Director of Public Works and approved by the City Council 9/7/65; and, 3) 10 ft. minimum front yard setback for curved drives. The Acting Secretary read the Staff f report. Mr. Harlow made an oral presentation of the request. He suggested the hearing be re -opened for the benefit of the two ,Commissioners who were not present. The hearing was re -opened to the audience. Ron Wells, representing the applicant, - addressed the Commission and explained the request. James Place, resident of Fashion Shores, addressed the Commission and objected to the request on grounds that the property is master planned for residential and there is adequate commercial zoning provided for the area. was closed. RESOLUTION NO. 68-6 A Resolution of the City Planning Commission Recommending Denial of Zone Case No. 68-6 to the City Council. A.MOTION WAS MADE BY ROYER AND SECONDED BY BAZIL TO ADOPT RESOLUTION NO. 68-6 RECOMMENDING.DENIA.L OF ZONE CASE NO. 68-6 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The commercial planned for this site amounts to a service station site and a small site for professional offices; neither of which adds greatly to the commercial needs of the area. 2. It would be more desirable to have large commercial zoning on some corners rather than small commercial zoning on all corners. 3. The subject area is Master Planned for low density. Tentative Tract Request: 86 Lots on 19.6 Acres. Conditional Exception Request: To permit the following:, 1) 50' right-of-way streets as indicated in T.T. #5841; 2) 10' minimum front yard setbacks for fences not over 6' in height, for garages with side -on -to -street approach and for other -portions of a residence. (Front setback for garages entered directly from the street to be 22 ft. min.) 3) 10' minimum rear yard setback on irregular shaped lots providing an average rear yard depth of 20' is maintained. Existing concrete curb and sidewalk adjacent to Coast Highway between 5t and 6t Streets maybe used provided existing grades and construction meet with the approval of the Department of Public Works. However-, full street improvements shall be installed between 5b and 6t Streets prior to April 21 1971, or Conditional Exception Na. 68-15 shall become null and void. 7. Provisions shall be made to pay 'when exitting from the lot or a satisfactory method which will avoid traffic congestion shall be approved by, the Traffic'Engineer. 8. Driveway grades shall be approved by the Department of Public Works. 9. A grading plan shall be submitted to the City and approved. 10. Upon termination of CE#68-15 or when permanent development occurs-, a 20 ft. wide pedestrian and emergency vehicular accessway shall be provided to City requirements from Ocean Avenue to the public beach adjacent to the driveway opposite Sixth Street. While this conditional exception is in effect emergency access shall be through the main -drive opposite 6t Street and a 20 ft. wide pedestrian access way shall be provided adjacent to the westerly side of said main drive. 11. CE #68-15 shall become null and void on April 21 1973, unless condition #6 is not complied with, iil:which case CE #68-15 shall become null and void on April 2, 1971. 12. Approval of this request shall not effect the ultimate location of the service road. AND FOR THE FOLLOWING REASONS: 1. The subject request will be an improvement for the area. 2. The Staff is in the process of preparing a new zone for beach front property, but this will not be completed for sometime. 3. A temporary use such as a parking lot appears to be a good use of this property until such time as the new zone is prepared and the -highest and best use of this property can be determined. A letter submitted by Jack Rogoway, Planning and Zoning Administrator for the City of Westminster, was read by the Acting Secretary suggesting additional conditions of approval for Tentative Tract 6147. Jack King, representing the developer, addressed the Commission and stated that there were no objections to the conditions suggested by the Subdivision Committee Report. A MOTION WAS MADE BY MILLER AND SECONDED BY ROYER TO APPROVE TENTATIVE TRACT MAP NO. 6147 WITH THE FOLLOWING CONDITIONS: 1. The Tentative Map received March 4, 1968, shall be the approved layout. 2. It has been City policy to limit commercial zoning to the mile intersection with limited neighborhood commercial facilities at the half -mile intersection. 2. Jerry Malloy, 10052 Cutty Sark Lane6 addressed the Commission and submitted a petition of protest signed by 115 property owners. Mr. Malloy also asked the Commission if the site could be used as a park site. the hearing was closed. Mr. Leffler stated that this type of use will not interfere with neighborhood television sets or radios. There being no other comment the hearing was closed. A MOTION WAS MADE BY MILLER AND SECONDED BY ROYER TO APPROVE CONDITIONAL EXCEPTION NO. 68-18 UPON THE FOLLOWING CONDITIONS: 1. The site shall be enclosed with a 6 ft. high chain link fence. AND FOR THE FOLLOWING REASONS: 1. The Huntington Beach Ordinance Code does not have zoning provisions for this type of use. 2. This use is compatible with uses permitted in the M-2-0 District. Mr. Shane stated that this proposal will cost approximately one million dollars. ,E. S. The applicant shall provide one, on -site fire hydrant at a location approved by the Fire Department. 2. Dedication for the future right -of -,way shown on Precise Plan o.f Street Alignment No. 67-4 shall be accomplished prior to issuance of a building permit. AND FOR THE FOLLOWING REASONS: 1. A higH rise ordinance is under study and this request will conform to the criteria outlined in the ordinance. 2. USE VARIANCE NO. 67-63 - Continued Applicant - Orange County Tile Mfg. Co. To permit a commercial and manufacturing use to be located in the R-3 Limited Multiple Family Residence District. The Staff Report was read by the Acting Secretary. A report submitted by the Building Depart- ment pertaining to the building was read by the Acting Secretary. A petition signed by 40 property owners within the area objecting to the request was submitted to the Secretary. The hearing was opened to the audience. William Carlson, representing the applicant, addressed the Commission and displayed various sketches showing how the structure will be remodeled. Mr. Carlson stated that this property has been used for many years as a business for ceramic tile. The following property owners addressed the Commission and objected to the request: W. M. McCubbin, 228 Frankfort Ave., K. Howell, 607 Alabama Street, Fred Hernon, 705 Alabama Street, Mr. Brown, 601 Huntington Street and Albert Garpanan, 230 Frankfort Street. There being no other comment the hearing was closed. It was noted by the Commission that the zoning within the immediate area is R-2 and R-3 and is primarily developed as such, with the exception of a small market on the southeast corner of Frankfort and Alabama. It was the consensus that this building will be out of character with surrounding developments. CODE AMENDMENT NO. 68-2 REVISION OF STREET WIDTHS FOR LOCAL STREETS The Acting Secretary informed the Commission that this code amendment pertains to revision of street widths for local streets. A MOTION WAS MADE BY LANE AND SECONDED BY TOM TO APPROVE CODE AMENDMENT NO. 68-2 AMENDING SECTION 9941.3.2 AND RECOMMENDS ADOPTION BY THE CITY COUNCIL. CODE AMENDMENT NO. 68-3 OVERHEAD UTILITIES FOR OIL WELLS The Acting Secretary informed the Commission that this code amendment pertains to allowing overhead utilities for oil wells under certain conditions specified in Section 9730.23B. Planning Commission Tuesday, April 2, 1968 Page No. 15 INFORMATION: The Acting Secretary informed the Commission -that Mr. Royce Goln, Service Area Manager for Building Industry Association, would like the Planning Commission to visit the Broadmore Exclusive development, designed by Richard Smith.
