TUESDAY, APRIL 16, 1968 COMMISSIONERS PRESENT: COMMISSIONERS ABSENT: Worthy, Bazil, Tom, Miller, Lane, Larkin, Royer None MINUTES: On motion by Tom and seconded by Worthy the Minutes of the Huntington Beach Planning Commission of February 27, 1968, as corrected were accepted an.mailed by the Secretary. CONDITIONAL EXCEPTION NO. 68-9 Continued TENTATIVE TRACT MAP NO. 6575 Continued To permit the following: 1. 6000 sq. ft. average lot area with 60 ft. average of frontage for each six contigu- ous lots in a block, with not less than 5000 sq. ft. area or 50 ft. frontage lot; 2. Reduction of street rights of way in accordance with the standards recommended by the Director of Public Works and approved -by --the City Council 9/7/65; and 3. 10 ft. minimum front yard setback for curved drives. The Staff Report and the Subdivision Committee Report were read by the Acting Secretary. The hearing was opened to the audience. Robert Galloway, representing the subdivider, addressed the Commission and stated that there were no objections to the conditions suggested by the Staff. There being no other comment, the hearing was closed. A MOTION WAS MADE BY MILLER AND SECONDED BY WORTHY TO RECOMMEND APPROVAL OF CONDITIONAL EXCEPTION NO. 68-9 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS: 1. All streets shall comply with standards proposed by the Depart- ment of Public Works and approved by both the Planning Commission (August 3, 1965) and City Council (September 7, 1965). 2. The minimum front yard shall be 10 ft. except the minimum front yard for garages entered directly from the street shall be 22 ft. This condition of approval is not general in nature and a - precise plan shall be submitted to the Planning Department for approval prior to issuance of any building permits. A tree, equivalent to a 30 inch box tree, as approved by the Street Tree Supervisor, shall be planted in the front yard of each lot and in the exterior side yard of each corner lot. 4. The minimum lot frontage shall not be less than 50 ft. wide with 5000 sq. ft. of lot area. An average lot width of 60 ft. of frontage with 6000 sq. ft. of lot area shall be provided for each six contiguous lots in a block. 5. An 18 inch wide easement for utility purposes shall be provided adjacent to all sidewalks on streets having less than 54 ft. of right-of-way. Construction of any vertical structures within said easement shall be approved by the Depart- ment of Public Works. AND FOR THE FOLLOWING REASONS: 1. The plan is a continuation of a tract under construction. 2. Other developments in the area which were built by this developer have been constructed to these same standards. 3. The proposed street widths conform to the requirements of Code Amendment No. 68-2 which has been approved by the City Council. A MOTION WAS MADE BY WORTHY AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO. 6575 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received March 13, 1968, shall be the approved layout. 2. Approval of this Tentative Map shall be null and void unless Conditional Exception No. 68-9 is approved by the City Council. 3. Zone Case No. 68-5 shall be adopted by the City Council prior to the time a final map is recorded. 4. All utilities shall be installed underground. 5. The proposed pedestrian easement shall be designated as a lettered lot and dedicated to the City of Huntington Beach. The right-of-way width of Atlanta Avenue shall be" increased to accommodate a slope easement along Atlanta Avenue or a retaining wall shall be constructed to Department of Public Works Standards. 7. TENTATIVE TRACT MAP N0. 5559 Subdivider: The Colwell Company The Subdivision Committee,Report was read by the Acting Secretary. Hugh Halderman, Engineer for the developer addressed the Commission and explained the project. A MOTION WAS MADE BY WORTHY AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO. 5559 UPON THE --FOLLOWING CONDITIONS: 1. The Tentative Map received April 10, 1968, shall be the approved layout. 2. All provisions of Use Variance No. 768 shall be complied with. 3. Drainage, lighting and sewer plans shall be approved by.the Department of Public Works. 4, The water and fire hydrant system shall be approved by the Department of Public Works -and Fire Department. 5. Ten foot easements over the sewer and water mains shall be' dedicated to the City of Huntington Beach on the final tract map. 6. Lighting systems shall be installed on all private drives with illumination at least equal -_to lighting on public streets and all lighting on private drives and common areas shall be approved by the Department of Public Works. 7. All public streets shall comply with City Standards. 8. Private street structural sections shall comply with Planning Commission Standards. 9. All utilities shall be installed underground. 10. The location of rubbish collection areas shall meet the approval of,the Department of Public Works. 11. All,provisions for a community association and for perpetual maintenance of the common area and recreation area shall be approved by the Planni.ng-Department and Legal Department. 13. The Edison Company-right=of-way shall -fie brought up to standards required by the-Ci-ty Recreation and Park Department and the Edison Company. A bond shall be posted with the City to assure compliance with this condition11)ior to final inspection of the dwellings•., t` 14. CONDITIONAL EXCEPTION NO. 68-17 TENTATIVE TRACT MAP NO. 6331 SUBDIVIDER: Calah Construction Corp. To permit the following: 1. Standard streets as approved by the Department of•Public Works, 8/3/65 and of the width -shown on T.T. //6331. 2. Minimum front yards of 10 feet and minimum setback of 22'ft. for garages entered directly from the street. The Staff Report and the Subdivision Committee Report were read by the Acting Secretary. The hearing was"opened to the audience. Paul Calvo, representing the applicant,.addressed the Commission and stated there were no objections to the -conditions suggested by the Staff. There being no other,comments, the hearing was closed. A petition for rezoning to Rl shall be filed prior to the time the final map is submitted to,the City Council for approval. 7. A Division of Land application, adjusting lot lines in this area shall be filed with the City, approved and the conditions of approval complied with. 8. Cameo Lane shall be dedicated'and'improved to City Standards: 9. Lots 15 through 19 inclusive shall be dedicated in fee to -the owners of lots 35 through 39 inclusive of Tract No. 6332 and the deeds of such lots shall provide that they cannot be separated. Wording of the deeds shall be approved by the Legal Department and Planning Department. 10. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. CONDITIONAL EXCEPTION NO. 68-13 Applicant - Green Hills Development To allow: 1. 616" high walls to be located 6' from the front property line in deviation to the required!15' front yard setback. 2. Straight -in garages to be setback 6' from the front property line in deviation_ to the required 22' i§etback. 3. Deduction of the side yard setback to 0' on one side of the lot. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. Bill Wren, representing the applicant, addressed the Commission and explained the reasons for the request. Mr. Wren stated there is a hardship on the property due to the existing oil field. -5-. 4/16/68 Minutes: H.B. A lengthy discussion was held by the A MOTION WAS MADE BY LANE AND SECONDED BY WORTHY TO APPROVE CONDITIONAL EXCEPTION NO. 68-13 UPON THE FOLLOWING CONDITIONS: 1. A precise plan shall be submitted to the Board of -Zoning Adjustments prior to issuance of building permits. 2. The "0" side yard setback shall be permitted provided a 10 ft. setback is maintained on the opposite side of the lot. Except for swimming pools, normal landscaping, a maximum eave encroachment of 3 ft. and removable patia covers extending to within 5 ft. of the side yard, no other architectural features or structures shall be permitted. This provision shall not apply to garden walls or fences crossing such setback provided such fence or wall is equipped with a gate and does not exceed a height of six (6) feet. The CC & Rs shall contain an irrevocable provision which will assure compliance with this requirement. 3. Building walls on the "0" side yard shall be of masonry construction. 4. The 2 stofy portion of any dwelling shall be setback 10 ft. from the property line. 5. Any house wall along the arterial highways shall be setback on private property. 6. No.portion of the dwelling may project over abutting property. 7. Walls along arterial highways shall be approved by the Department of Public Works. 8. Garages which are setback 6 ft. shall be equipped with electric garage dooroopeners. 9. The walls along the property frontage shall be substantially the same as those shown on photos submitted by -the applicant. 10. The cone of vision shall be such that the driver of the car can see the full width of the sidewalk within a distance of 10 ft. measured along the inside edge of the sidewalk from edge of driveway before the car encroaches onto the sidewalk. -6- 4/16/68 Minutes: H.B. There is a hardship on the subject property due to physical obstacles of oil operation and the open space provided by the golf course off -sets any reductions requested by the applicant. The Acting_ Secreta_ ry .suggebted,--,this -case be continued in order to allow the Staff to study the present Master Plan for the area. The hearing was opened to the audience. The applicant addressed the Commission and stated there were no objections to the continuance. There being no other comment, the hearing was closed. SITE PLAN NO. 68-1 Applicant - Siu Loong Yee To allow,a Chinese restaurant and cocktail lounge in the C-2 Community -Business District. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. The applicant addressed the Commission and gave his reasons for the request. John Pelate, 8952 Clipper Drive, Huntington Beach, addressed the Commission and objected to the request. There being no other comment, the hearing was closed. A MOTION WAS MADE BY ROYER AND SECONDED BY WORTHY TO APPROVF,SITE PLAN NO. 68-1 FOR, THE FOLLOWING REASON: -7- 4/16/68 I Minutes: --H.B. The Police Department, as well as other members of the City Staff, reviewed this request and does not find the use objectionable. CONDITIONAL EXCEPTION NO. 68-20 Applicant - Harold Harper To allow the construction of a 70,000 sq. ft. building to be used as a retail department store in the R-A Residential Agricultural District., The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. Joseph Aidlin, Attorney, representing the applicant,'addressed the Commission and explained the request. There being no other -comment, the hearing was closed. A MOTION WAS MADE BY ROYER AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO. 68-20 UPON THE FOLLOWING CONDITIONS: 1, A rezone application to C-4 shall be filed for the commercial building and related parking facilities prior to issuance of building permits. The remaining property to the rear shall 'be zoned R-5 to conform to the zoning to the north. 2. A revised plot plan conforming to the requirements -of the 0-4 zone and other city requirements shall be submitted to the Board of Zoning Adjustments for approval prior to issuance of building permits. AND FOR THE FOLLOWING REASON:- 1. There is a hardship on the property because peat conditions exist. The attorney for the applicant addressed the Commission and explained the request. There being no other comment, the hearing was closed. Commission discussion was held. It was noted that this property is master planned and zoned for single family residential purposes. A MOTION WAS MADE BY ROYER AND SECONDED BY BAZIL TO DENY CONDITIONAL EXCEPTION N0. 68-21 FOR THE FOLLOWING REASONS: 1. There is no apparent hardship on the property. 2. The proper location for this type of use is the M-1 zone. ROLL CALL VOTE: AYES: Worthy, Bazil, Tom, Larkin, Royer NOES: Lane, Miller ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 68-22 Applicant - Paul Patton To permit home care for five non -ambulatory, crib age, exceptional (mentally retarded) children. The Staff Report was read by.the Acting Secretary. Mrs. Patton, applicant, addressed the Commission and gave her reasons for the request. The following property owners addressed the Commission and stated their opinions: Larry Smith, 10211 Valley Forge Drive, Huntington Beach, Jack L. Ayars, 1594 Maplewood Street,'Costa Mesa, Pat Morrison, 3189 Sicily Avenue, Costa Mesa and L. D. Smith, 19622 Cambera Lane,'Huntington Beach. There being no other comment, the hearing was closed. A lengthy discussion followed. A MOTION WAS MADE BY LANE 1ND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO. 68-22. THE MOTION WAS WITHDRAWN. Rurther discussion was held. The Acting Secretary suggested to the Commission the request be continued to allow the Staff time to perform a Master Plan Study of the area bounded by Bolsa Chica Street, Heil Avenue, Graham Street and Warner Avenue. The hearing was opened to the audience. The applicant addressed the Commission and stated there were no objections to the continuance. There being no other comment, the hearing was closed. A MOTION WAS MADE BY -TOM AND SECONDED BY LARKIN TO CONTINUE CONDITIONAL EXCEPTION NO. 68-23 TO MAY 71 1968, WITH THE CONSENT OF THE APPLICANT. MASTER PLAN AMENDMENT NO. 68-2 Master Plan Amendment identifying non- structural blighted areas within the City. Floyd Belsito, Associate Planner, addressed the Commission and made a presentation of the Non-structural Blight Element -of the Master Plan. These areas qualified as blight under State Redevelopment Law because they contain: .1. small lots, 2. inaccessible lots and 3. long, narrow lots. Mr. Belsito stated these lots should be consolidated; thereby creating a developable area. The hearing was opened to the audience. There being no comment, the hearing was closed. MASTER PLAN AMENDMENT STUDY AREA III A MOTION WAS MADE BY LANE AND SECONDED BY WORTHY TO INSTRUCT THE SECRETARY TO SET A PUBLIC HEARING ON MASTER PLAN AMENDMENT - STUDY AREA III FOR THE AREA BOUNDED BY BOLSA CHICA STREET, GRAHAM STREET, HEIL AND WARNER AVENUES FOR THE MAY 7 1968, HEARING. ' ROLL CALL VOTE: AYES: Worthy, Bazil, Tom, Larkin, Royer, Lane, Miller NOES: None ABSENT: None THE MOTION CARRIED. DISCUSSION: The Planning Director discussed the possibility of requiring underground gas meters. It was the consensus of the Commission that the Staff investigate such requirement for possible incorporation into the Code. INFORMATION: The Acting Secretary informed the Commission that the following items will be discussed at the next' -- study session: 1. Public hearing - C.E. No. 68-24; 2. Care of non -related persons; 3. Subdivision ordinance; and 4. Master Plan of Land Use - Study Area III. ichard A.
