TUESDAY, JUNE 18, lc COMMISSIONERS PRESENT: Larkin, Bazil, Lane, Royer COMMISSIONERS ABSENT: Miller, Worthy, Tom CONDITIONAL EXCEPTION NO. 68--36 Applicant - Mills Construction Co. To allow street widths as shown on Tentative Tract Map No. 6231 in deviation to the required 60 feet where local streets intersect Arterial Highways. The ,Staff Report was reqLd by the Secretary. The hearing was opened to Lthe audience. Bernard Solomon, applicant, addressdd the Commission and offered to answer any questions. There being no other comment, the hearing was closed. Discussion followed. It was the consensus of the Commission to table this item until Tentative Tract Map No. 6151, a 10 acre subdivision adjacent to this tract is considered by the Commission. There being no comment, the hearing was closed. A MOTION WAS MADE BY ROYER AND SECONDED BY LARKIN TO APPROVE THE EXTENSION OF TIME FOR TENTATIVE TRACT MAP NO. 6151 UPON THE FOLLOWING CONDITIONS: 1. All conditions of the previously approved tentative tract map shall be complied with. 2. Lot 41 shall front on Prairie Street and the south line of Lot 42 shall be extended westerly to the tract boundary, or a 10 ft. by 10 ft. corner cut-off shall be provided where the east line of Lot 41 intersects with Prairie Street and such area shall be included within lot 40; also a 6 ft. high masonry wall shall be ,constructed along the south line of lot 41 and along the corner ,cut-off. The design and building materials of such wall shall be approved by the Planning Commission and Department of Public Works. 3. CONDITIONAL EXCEPTION NO. 68-33 DIVISION OF LAND NO. 68-24 Applicant - La Cues„ta Homes To permit the adjustment of lot lines on an existing tract which will result in such lots being below the minimum require- ments of the R2 Two Family Residence District. The Staff Report was read by the Secretary. The hearing was opened to the audience. Mike Jager, developer, addressed the Commission and gave his reasons for the request. Bob Galloway, engineer for the developer, addressed the Commission and explained the project. There being no other comment the hearing was closed. i COMMISSIONER TOM: Commissioner Tom arri'*ed at 7:35 P.M. and assumed his duties. A MOTION WAS MADE BY ROPER AND SECONDED BY LANE TO_,APPROVE CONDITIONAL EXCEPTION NO. 68-33 AND DIVISION OF LAND NO. 68-24 UPON THE FOLLOWING CONDITIONS: 1. A zone change application to R1 shall be filed with the City prior to issuance of building permits. 2. The proposed alleys shall "T" between Lots 11, 12, 26 and 27 in both Blocks B and C. ZONE CASE NO. 68-21 Applicant - Meine Construction Change, ,of zone from R-A Residential Agricultural District to R-1 Single Family Residence District. The Staff Report was read by the Secretary. The hearing was opened to the audience. Don Conklin, developer, addressed the Commission and explained the proposal. There being no other comment, the hearing was closed. RESOLUTION NO. 68-21 A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 68-21 to the City Council. A MOTION WAS MADE BY ROYER AND SECONDED BY TOM TO ADOPT RESOLUTION NO. 68-21 RECOMMENDING APPROVAL OF ZONE CASE NO. 68-21 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. This zone case was filed because a condition of approval on Tentative Tract No. 4419 required the applicant to submit a petition for rezoning to R-1. ROLL CALL VOTE: -AYES: Larkin, Bazil, Lane, Royer, Tom NOES: None ABSENT: Worthy, Miller THE RESOLUTION WAS ADOPTED. ZONE CASE NO. 68-22 Applicant - George Capron Change of zone from R-A-O Residential Agricultural District combined with oil production and R-3 Limited Multiple Family Residence District to C-4 Highway Commer- cial District with a 50 ft. setback from the ultimate right-of-way line, and R-3 Limited Multiple Family Residence District. -3- 6/18/68 Minutes: H.B. Lefelen, addressed the Commission and displayed various sketches of the proposal. Dave Cross, architect, addressed the Commission and explained the proposal. There being no other comment, the hearing was closed. A lengthy discussion was held by the Commission. A MOTION WAS MADE BY LANE AND SECONDED BY LARKIN TO APPROVE ZONE CASE NO. 68-22 PER APPLICANT'S REQUEST. ROLL CALL VOTE: AYES: Lane, Larkin, Royer NOES: Tom, Bazil ABSENT: Worthy, Miller THE MOTION DID NOT CARRY, THEREFORE, ZONE CASE NO. 68-22 WAS AUTOMATICALLY CONTINUED TO JULY 27 1968. CONDITIONAL EXCEPTION NO. 68-34 Applicant - Donald England To permit a motorcycle park for conducting sportsman scrambles, safety school and sport riding in the Ml Light Industrial District. The Staff Report was read by the Secretary. The hearing was opened to the audience. The following people addressed the Commission and spoke in favor: Donald England, 13671 Sutter Drive, Westminster; Ron Sloane, 670 Monterey Road, Monteray Park; Jack Mathis, 16422 Oakmont Lane, Huntington Beach; Mike Capatile, 1544 Washington, Huntington Beach; Howard Hill, 520 Parker, Orange, and Janice Curtis, 2307 Dahl Lane, Santa Ana. Mrs. Vesta Marlin, 315 So. Rose, Los Angeles, addressed the Commission and objected to the request. There being no other comment, the hearing was closed. A lengthy discussion was held by the Commission. A MOTION WAS MADE BY BAZIL AND SECONDED BY ROYER TO DENY CONDITIONAL EXCEPTION NO. 68-34 FOR THE FOLLOWING REASONS: 1. The subject area is zoned M-1 which does not permit this type of use. 2. There will be a considerable noise and dust problem. 3. Street improvements and the required off-street parking improvemen will not be complied with. Planning Commission • Tuesday, June 18, 1968 Page 5 CONDITIONAL EXCEPTION NO. 68-35 Applicant - Frank Duvall To allow a pre-school and day care nursery for children in the Rl Single Family Residence District. The Staff Report was read by the Secretary. The hearing was opened to the audience. Jack Koebig, representing the applicant, addressed the Commission and explained the request. Mr. Koebig submitted a letter signed by Gomer Sims, an adjacent property owner, endorsing the proposal. There being no other comment, the hearing was closed. Commission held a discussion. A MOTION WAS MADE BY TOM AND SECONDED BY ROYER TO APPROVE CONDITIONAL EXCEPTION NO. 68-35 UPON THE FOLLOWING CONDITIONS: 1. All vehicular access shall be from the "private road". Said "Private road" shall be dedicated now and improved upon 60 days notice from the Department of -Public Works. A letter plus a bond shall be submitted to the Department of Public Works guaranteeing improvements. 2. Heil Ave. and Graham St. shall be dedicated now. Heil and Graham shall be fully improved to City Standards, unless a parcel map is filed separating this parcel from the remaining property under the same owner, then the conditions of a division of land shall,prevail. Improvements shall include street trees, street signs, street lights and fire hydrants. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district at the time said parcel is developed. 7. All utilities shall be installed underground. 8. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 9. A masonry wall shall be constructed along the south property line. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. 10. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 11. All applicable City Ordinances shall be complied with. 12. There is a definite need for pre-school and day nurseries in this area. 2. The net depth of the subject property is only 91 feet and it is fronting on a secondary highway. ZONE CASE NO."68-20 Continued Applicant - Doyle Development Change of zone from R-A Residential Agricultural District to C-2 Community Business District with a 50 ft. setback from the ultimate right of way line. The Secretary informed the Commission that the applicant requested a continuance to July 2, 1968. The hearing was opened to the audience. There being no comment, -the hearing was closed. COMMUNICATION: The Secretary read a legislative bulletin on AB 1217 pertaining to zoning and its application to dchool buildings. Planning Commission Tuesday, June 18, 1968- Page 7 INFORMATION: The Secretary stated the City Council referred a portion of the sign ordinance back to the Commission for review and recommendation. , It was the consensus to continue any discussion to the Study Session on June 25, 1968. COMMUNICATION: The Secretary read a communication submitted by the American Institute of Planners relating to adoption ofa Housing Element to the Master Plan. The communication was reviewed. A MOTION WAS MADE BY ROYER AND SECONDED BY TOM: TO PREPARE A HOUSING ELEMENT FOR THE MASTER PLAN. COMMUNICATION: The Secretary read a letter submitted by Ben Deane, requesting that a master plan study be made of the area bounded by Atlanta on the south, Adams on the north, Newland on the west and Xdgnoli-a b71_ they _eApt. The Commission reviewed the request. A MOTION WAS MADE BY ROYER AND SECONDED BY LARKIN FOR THE SECRETARY TO WRITE A LETTER TO MR. DEANE INFORMING HIM HIS REQUEST WAS DENIED.
