A MOTION WAS MADE BY ROYER AND SECONDED BY SLATES TO AP'_ OVE =6NDITIONAL EXCEPTION NO. 68-45 UPON THE FOLLOWING CONDITION:. 1. Conditiona]L--Exe ion No. 68-45 shall become null and void on August 6, 1969. AND FOR THE FOLLOWING REASONS: 1. This will allow the Staff time to study and prepare a Code Amendment which may possibly allow the use in residential districts. •2. This approval will allow the business to remain in existence until the Planning Commission has had time to review the proposed code amendment. Planning Commission Tuesday, August 6, 1968 CONDITIONAL, EXCEPTION NO. 68-40 TENTATIVE TRACT MAP NO. 6675 SUBDIVIDER: B. A. Berkus Continued In Conjunction To permit the following: 1. The reduction in the garage setback to 20' in deviation to required 22 ft. 2. Front yard setback of 101 for dwelling in deviation to required 15► 3. A minimum of 10' rear yard setback with reduction in the 900 sq. ft. open space requirement in rear 2/3 of lot. 4. The reduction of street widths, cul-de-sacs and right-of-way as shown on Tentative Tract No. 6675 5. Lot size to average 3330 sq, ft,, with 37' of frontage in deviation to required 6,000 sq. ft. and 60' of frontage. The Staff Report and the Subdivision Committee Report were read by the Acting Secretary. The hearing was opened to the audience. B. A. Berkus, applicant, addressed the Commission and explained the proposal. The following property owners addressed the Commission and opposed: Bert Berra, 16581 Channel Lane, Brian Walsh, 3922 Bounty Circle and Bob James, 3302 Bounty Circle. There being no other comment the hearing was closed. A lengthy discussion was held. A MOTION WAS MADE BY LANE AND SECONDED BY MILLER TO RECOMMEND APPROVAL OF CONDITIONAL EXCEPTION NO. 68-40 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS: 1. Lot sizes shall be substantially the same as shown on the approved Tentative Map for alternate "B" received August 5, 1968. 2. The minimum front yard setback shall be 10 ft. 3. Rear yard setback of 10 ft. shall be permitted for waterfront lots only, and the 900 sq. ft. of open space need not be provided. 4. Common areas including private streets shall not be dedicated separate and apart from the individual parcel or dwelling unit. 5. All provisions for a community association and for perpetual maintenance of the common area and recreation area shall be approved by the Planning Department and Legal Department,, 6. The CC&R°s, Articles of Incorporation, By -Laws and Management. Contract shall be submitted to the Planning Department and Legal Department for approval. 7. The CC&R°s shall contain at least the following provisions: ao The recreation area shall be reserved for the exclusive use of residents within the project and their non-paying guests. -2- 8/6/68 Minutes: H.B. Owners and/or tenants shall be required to abide by association rules and there shall be penalties for violation of said rules. c. Any interest in the common area (including private streets) held by the individual parcel owners can not be devised, conveyed or dedicated separate and apart from the devise conveyance, and/or dedication of the individual parcel for a life in being plus 21 years, excepting this may be accomplished under the same conditions or grounds as are available under judicial partition. d. If the development is constructed in increments or several final maps, reciprocal CC&Rls and reciprocal management agreement shall be established that will cause a merging of increments as they are completed. The end result shall be one home association with common areas common to all and one management for the entire project. 8. A precise plan for development of lot 46 (the recreation area) shall be submitted to the Planning Department for approval prior to issuance of building permits. 9. A 6 ft. high masonry wall shall be constructed along the south side of Street A. 10. If the streets are private, a lighting system shall be installed within the project equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Public Works for approval. 11. Two fully enclosed garages shall be provided for each unit. Said garages shall be equipped with automatic garage door openers. 12. All applicable City Ordinances shall be complied with. 13. Approval of this conditional exception shall only apply to Tentative Tract Map No. 6675 alternate "B". AND FOR THE FOLLOWING REASONS: 1. The project will be an asset to the community. 2. The common area in conjunction with the lot will make each lot equivalent to the minimum standards used in Huntington Harbour. A MOTION WAS MADE BY LANE AND SECONDED BY ROYER TO APPROVE TENTATIVE TRACT MAP NO. 6675 UPON THE FOLLOWING CONDITIONS: -3- 8/6/68 Minutes: H.B. Planning Commission Tuesday, August 6, 1968 Page 4, (T.T. No. 6675 Cont) 1. The Tentative Map received August 5, 1968, entitled alternate "B" shall be the approved layout. 2. Approval of this Tentative Map shall be null and void unless Conditional Exception No. 68-40 is approved by the City Council. 3. The water and fire hydrant systems shall be approved by the Department of Public Works and the Fire Department. 4, Street widths and design shall comply with City Standards and Section 9941.3 (Street and Highway Widths) of the Huntington Beach Ordinance Code. 5. If the developer elects to install private streets, then private street structural sections shall comply with Department of Public Works requirements. 6m All utilities shall be installed underground. 7. All waterways shall be deeded in fee to the City. 8. All property within Tentative Tract Map No, 6675 shall annex to the Harbor Maintenance District when it is formed. 9. Telephone conduit shall be installed from a telephone vault to the northeast corner of Admiralty Drive and Pacific Coast Highway and to the northwest corner of Parcel B at the Pacific Coast Highway to facilitate the installation of fire alarm boxes. 10. The existing water line within the tract boundary shall be relocated and a water line shall be extended to the bulkhead in Parcel C to the satisfaction of the Department of Public Works. 11. A division of land application separating this property from the remaining property held under the same ownership shall be filed with the City, approved and the condition of approval complied with. 12. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. 13. A petition for rezoning from C-4 to R-1 shall be filed prior to submitting a final map to the City Council, 14. That portion of "D" Street between "A" Street and the Pacific Coast Highway shall be deleted. Planning Commission Tuesday, August 6, 1968 Page 5 ZONE CASE NO. 68-25 Applicant - Huntington Harbour Change of zone from R-1 Single Family Residence District to R-3 Limited Multiple Family Residence District. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. Don Byrnes, representing the applicant, addressed the Commission and explained the proposal. There being no other comment, the hearing was closed. RESOLUTION NO. 68-25 A Resolution of the City Planning Commission Recommending Approval of Zone Case No.- 68-25 to the City Council. A MOTION WAS MADE BY SLATES AND SECONDEI BY MILLER TO ADOPT RESOLUTION NO. 68-25 RECOMMENDING APPROVAL OF ZONE CASE NO. 68-25 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The subject property is adjacent to a R-3 zone. 2. The Master Plan of Land Use designates this property for medium density development. 3. The subject property was previously zoned R-3. ROLL CALL VOTE: AYES: Bazil, Lane, Royer, Slates, Miller, Tom NOES: None ABSENT: Duke THE RESOLUTION WAS ADOPTED. CONDITIONAL EXCEPTION NO. 68-43 Applicant - Harold C. Ramser To allow the re-establishment and operation of an existing idle oil well in the R-4 Multiple Family Residence District. The Acting Secretary stated that two letters of opposition and one letter in favor of the request were submitted to the Planning Commission. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. The applicant addressed the Commission and gave his reasons for the request, There being no other comment, the hearing was closed. Oil Field Superintendent, Herb Day, explained the status of the oil well and other wells in the area. Mr,.Day also pointed out that the "0" zone was removed from all lots within the area bounded by Ocean Ave, First St., Lake_St.,,Palm Ave., and the alley between 7th and 8th Street approximately 116 years ago. -5- 8/6/68 Minutes: H.B. Planning Commission Tuesday, August 6, 1968 Page 6. (C.E. No. 68-43 Cont) Fire Marshal Douglas Spickard, addressed the Commission and showed various slides of the subject property. Mr— Spickard stated the Fire Code requires that no oil well shall be drilled within 100 feet of any building not necessary to the operation of the well. A MOTION WAS MADE BY SLATES AND SECONDED BY TOM TO DENY CONDITIONAL EXCEPTION NO. 68-43 FOR THE FOLLOWING REASONS: 1. CONDITIONAL EXCEPTION NO. 68-44 Applicant - Valle-7 Tractor Service Acting Secretary. To permit the sale of top soil, sand and gravel and equipment rental in the R-A Residential Agricultural District for a period of one year. The Staff Report was read.by the The hearing was opened to the audience. Mr. Yoder, applicant, addressed the Commission and stated he cannot dedicate Goldenwest Street at the present time but will submit a letter agreeing to dedication when clear title to the property can be obtained. There being no other comment, the hearing was closed. A MOTION WAS MADE BY MILLER AND SECONDED BY TOM TO APPROVE CONDITIONAL EXCEPTION NO. 68-44 UPON THF,n FOLLOWING CONDITIONS: 1. Goldenwest Street shall be dedicated to City Standards when the applicant receives clear title to the property. 2. Conditional Exception No. 68-44 shall become null and void on August 1, 1969. DISCUSSION: The_Acting Secretary distributed sketches of fence height variation to the Commission. Mr. Harlow then made a presentation of the proposal. -6- 8/6/68 Minutes: H.B. Planning Commission Tuesday, August 6, 1968 Page 7. It was the consensus of the Commission to amend the ordinance to allow a variation in fence height over 12 ft. of fence run or between pilasters. A MOTION WAS MADE BY SLATES AND SECONDED BY ROYER TO INSTRUCT THE STAFF TO PREPARE A CODE AMENDMENT TO AMEND APPROPRIATE SECTIONS OF THE ORDINANCE AND SET THE MATTER FOR PUBLIC HEARING. Royer, Slates, Miller, Tom The Acting Secretary distributed copies of development standards for commercial, industrial and office -professional The Commission reviewed the proposed amendment. It was the consensus that the Staff amend appropriate sections of the code and bring back to the Commission for further review and discussion. THERE BEING NO FURTHER BUSINESS, THE MEETING ADJOURNED.
