USE PERMIT NO. 68-22 - Continued Applicant: Foodmaker, Inc. To permit the construction of a drive-thru restaurant in the C4 Highway Commercial District. Located at the northeast corner of Beach Blvd. and Ellis Avenue. Legal description on file in the Planning Depart- ment Office. The hearing was opened to the audience. Bob Harvey, representing the. applicant, addressed the Board and presented a revised plot plan. Charles Young, property owner-, answered various questions regarding ultimate location of the property line, fencing requirements, and sight angle clearance. Mrs. McMurray, adjancet property owner, questioned the fencing requirements and driveway locations. There being no further comment,, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY HARLOW TO APPROVE USE PERMIT NO. 68-22 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Driveway locations and number shall be approved by the Traffic Engineer. 2. Beach Blvd. and Ellis Ave. shall be dedicated and fully improved to City and/or State Standards at the time said parcel is developed. Improvements shall include street trees, street signs, street lights and fire hydrants. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 4. Sewage disposal shall be through the 'City of Huntington Beach's sewage system at the time said parcel is developed. 8/7/68 Minutes: H.B. Easements for utilities orswalkways stall be provided to Department of Public Works Standards.- 7. The property shall participate in the local drainage assessment district at the time said parcel is developed. 8. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of bulding permits. 9. All utilities shall be installed underground at the time said parcel is developed. 10., Fire alarm system conduit and appurtenances shall be iro-7alled by the developer at locations and to specifications provided by the Fire Department. 11. A 6 ft. high masonry wall shall be constructed along the east property line. 12. Off-street parking facilities shall conform to Article 979. 13. No structures other than those shown on the approved plot plan shall be constructed within the project and said structures shall conform to Section 9432.6.5 of the Huntington Beach Ordinance Code. 14. All applicable City Ordinances shall be complied with. 15. A Division of Land application shall be filed with the City, approved and the conditions of approval complied with. 16. Use Permit No. 68-22 shall be approved substantially as submitted on revised plot plan. A revised plot plan incorporating the above conditions shall be submitted to the Planning Department prior to issuance of building permits. Said plan shall be substantially the same as -the approved amended plot plan. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow NOES: ? 'Noiie ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 68-37 Applicant: R. Ward Renshaw To allow the conversion of a 3 car garage into a den and double garage having dimensions of 17,2" x 19, garage. Located at 17112 St. Andrews Lane in the R1 Single Family Residence District. Legally described as Lot 172 of Tract No. 5792. The hearing was opened to the audience. Ward Renshaw, applicant, addressed the Board and explained the request. There being no further comment, the hearing was closed. -2- 8/7/68 Minutes: H.B. Board of Zoning Adjustments Wednesday, August 7, 1968 Page No. 3 A MOTION WAS MADE BY MCFARLAND AND SECONDED BY COOK TO APPROVE CONDITIONAL EXCEPTION NO. 68-37 FOR THE FOLLOWING REASON: 1. Location of wall is based on structural support established at the time of original construction. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow NOES: None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 68-38 Applicant: Cox Neon Corp. To allow an electrical advertising sign to be constructed 6 ft. from the side property line in deviation to the required 20 ft. setback. Located on the east side of Beach Blvd., approximately 660 ft. south of Ellis Ave. in the C4 Highway Commercial District. Legal description on file in the Planning Department Office. The hearing was opened to the audience. Roger Slates, representing the applicant, addressed the Board and explained the request. He also stated that the owners of this center were negotiating for the purchase of the property to the -.-....- south and if acquired, the application would not be necessary He also stated that if the sale did not go through that the property owner would move the sign to comply with the ordinance. Mr. Cox stated the reasons for the request. He stated that if the sign,had to, be moved at a later date it would not present a problem. hearing was closed. There being no further comment, the Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 68-38'SUBJECT TO THE FOLLOWING CONDITION: 1. If the pending sale of the property to the south does not occur, the sign shall be moved to conform to the ordinance. AND FOR THE FOLLOWING REASON: 1. The owner is negotiating to purchase the property to the south for extension of the shopping center. Located on the north side of Edinger Avenue, approximately 290 ft. west of Gothard Street in the M1 Light Industrial zone. Legal description on file in the Planning Department Office. The hearing was opened to the audience. John Horner, representing the applicants, addressed the Board and answered various questions. He stated that the existing trailer would be removed. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY COOK AND SECONDED BY HARLOW TO APPROVE ADMINISTRATIVE REVIEW NO. 68-21 SUBJECT TO THE FOLLOWING CONDITION: 1. The applicant shall conform to Sectnn 9730.25.1 of the Huntington Beach Ordinance Code. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow NOES: None ABSENT: None THE MOTION CARRIED.
