Located at the southeast corner of Heil Avenue and Sell Circll. USE PERMIT NO. 68-28 Applicant: Bernard Solomon To permit the construction of a 33 unit apartment project in the R3 Limited Multiple Family Residence District. Located on the southeast corner of Heil Avenue and Sell Circle. Legally described as Lot 5 of Tract 5904. The hearing was opendd to the audience on Use Permit No. 68-27 and Use Permit No. 68-28 in conjunction. Bernard Solomon, applicant, addressed the Board and explained the requests. the hearing was closed. There being no further comment, Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 68-27 SUBJECT TO THE FOLLOWING CONDITIONS: 1. A mutual driveway easement shall be provided on lots 5 and 6 between Sell Circle and the alley. 2. The water and fire hydrant systems shall be approved by the Fire Department. 3. All conditions of approval of Tract No. 5904 shall be complied with. 4. The Final Map shall be recorded prior to issuance of building permits. CONDITIONAL EXCEPTION NO. 68-39 Applicant: Byron Lasky Co. To allow construction of two garages 716" from the front property line in deviation to the required 20 ft. setback. (A) Located on the east side of Bolero Lane, approximately 120, south of Nalu Circle and legally described as Lot 67 of Tract 5050. (B) East side of Carousel Lane, approximately 120, south of intersection of Carousel and Wanderer Lane and legally described as Lot-313 of Tract 5481. It was noted that a letter requesting withdrawal had been received. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE THE REQUEST FOR WITHDRAWAL OF C.E. #68-39. To allow a 9 ft. front yard setback on Lot 8, and 8 ft. front yard setback on Lot 13 in deviation to the required 10 ft. front yard setback; and a 5 ft. rear yard setback for that portion of the main dwelling constructed over a garage in -deviation to the required 10 ft. rear yard setback. Located south of Heil Ave., approximately 1000 ft. east of Goldenwest Street in the R3 Limited Multiple Family Residence District. Legally described as Lots 1-15 of Tract 6682. The hearing was opened to the audience. Bill Phelps, representing the applicant, addressed the Board and answered various -questions. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY COOK AND SECONDED BY HARLOW TO APPROVE CONDITIONAL EXCEPTION NO. 68-43 FOR THE FOLLOWING REASONS: 1. Encroachment only involves one corner of each of the buildings. 2. A Code Amendment is being adopted to allow the main dwelling to project over the garages. -2- Minutes: H.B. Loca'ted, at -the southwest corner of Beach Boulevard and Chrysler Drive. Legal description on file in the Planning Department Office. The hearing was opened to the audience. There being no one present to speak for or against the matter, the hearing was closed. Young To allow a division of Land into two separate parcels. Located on the northeast corner of Beach and Ellis Street. 'Legal description on file in the Planning Department Office. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE DIVISION OF LAND NO. 68-29 SUBJECT TO THE FOLLOWING CONDITIONS.. 1. Beach.•Boulevard and Ellis Avenue shall be dedicated and fully improved to City and/or State Standards at the time each -parcel is developed. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. Easements for utilities or walkways shall be provided to Department of Public Works Standards. 6. The property shall participate in the local dralpap assessment district at the time each- parcel is developed. 7. All utilities shall be installed underground at the time each parcel is developed. 8. Fire alarm,system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department: 9. A Parcel Map shall be filed with the City and recorded. 10. The Division of Land shall -not -be effective until an agreement is signed and recorded agreeing to the -conditions listed above. PLOT PLAN AMENDMENT NO. 68-3 - Continued Applicant: Harbour Realty To"allow fence material along front property line to be changed from chain link to redwood. Located on the south side of Heil Avenue, approximately 200 feet west'of Graham Street in the R1 Single Family Residence District. Legal description on file in the Planning Department Office. The hearing was opened to the audience. Jack Koebig, representing the applicant, discussed the possibility of relocating the fence within the Right of Way for Heil Avenue and constructing the fence of -solid redwood rather than chain link. He stated that the duration of the request would be until the Department of Public Works requested installation of street improvements. There being no further comment, the hearing was clo;.sed. Board discussion followed. It was noted that the Board did not have,authority to allow the fence within the Right -of -Way; and that'an agreement to allow the fence would have to be approved by the Department of Public Works and City Attorney's Office. It was also noted that if the fence was to be solid rather than open, a strip of landscaping should be provided between the street and the fence. -4- 8/28/68 Minutes: H.B. The fence shall set back 3 feet from the edge of pavement and the area between the fence and pavement shall be landscaped. ROLL CALL VOTE: AYES: McFarland, NOES: None ABSENT: None THE MOTION CARRIED.
