BOARD MEMBERS ABSENT: None CONDITIONAL EXCEPTION NO. 68-50 - Continued Applicant: R. D. Slates To allow waiver of construction of .a ,6 ft.. high block wall, as required by Use Variance No. 727. Located at the southeast corner of Beach Boulevard and Newman Avenue. Legal description on file in-the,Planning Department Office. The hearing was opened to the audience. r Roger Sullivan, attorney for Good Sheppard Cemetery, addressed the Board and stated that he felt Roger'Slates had a conflict of interest in this case because he is a Planning Commissioner. Roger Slates addressed the Board and disqualified himself. Gerald McAdams, representing the Cemetery and Roger Sullivan stated that they were adamantly opposed to the waiver -of the fence. They stated that a 6 ft. high masonry wall would help control noise, fumes and cars parking over the property line. It would also provide privacy for mourners. Mr. Cain, representing the appli- cant, stated the reasons for requesting the waiver and proposed an alternate plan of landscaping be considered. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE CONDITIONAL EXCEPTION NO. 68-50 AND REFER IT TO PLANNING COMMISSION FOR A DECI5ION-FOR THE FOLLOWING REASON: 1. The intent of the Planning Commission concerning the requirement*of the masonry wall as a condition -6f�approval of Use Variance No. 727 is unclear. They prefer'a decision at Board level because to automatically refer the matter_ to Planning Commission benefits the,applicant. 2. Since a fence was shown on the plot plan it was not necessary for the Planning Commission to spell it out as a condition of approval in the original decision. CONDITIONAL EXCEPTION NO 68-51 Applicant: L. Carl Wieland To allow the construction of a room addition'to within 5 ft. of the rear property line in deviation to the required 10 ft.'rear yard setback. Located on the north side of Castle Drive; . -approximately 400 ft. east of Clubhouse Drive in the R1 Single Family Residence District. Located at the southeast corner of Edinger, Avenue and Goldenwest Street. Legal description on file iri the Planning Department Office. The hearing was opened to the audience. Adnan Khatib, applicant, addressed the Board and discussed the suggested conditions of approval. Jerry Nelson, 7171 Bluesails, addressed the Board and opposed the request.' A MOTION WAS MADE BY MCFARLAND AND.-SECONDEDL-BY-PALIN TO APPROVE USE -PERMIT NO. 68-35 SUBJECT'TO THE FOLLOWING -CONDITIONS AS AMENDED WITH CONDITION 9'ADDED: 1. Goldenwest Street and Edinger Avenue shall be dedicated and fully improved to City Standards. Improvements shall include street trees, street signs, street lights and fire hydrants. 2. Water supply shall be through the City of Huntington Bea'd1l' s water system. 3. 'Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer-, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall'pafticipate in the local drainage assessment district. - 6. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and. -to specifications provided by the Fire Department. 7. Al11-applicable City Ordinances shall be complied with. 8. A Division of Land application, separating this parcel from the remaining property held under the same ownership, shall be -filed with the City,- -approved and recorded. 9..-•A 6 ft.. high block wall shall -be constructed along the south and east property lines at such time as abutting property develops residential. USE PERMIT NO. 68-36 Applicant: Dick Nerio To permit construction of a new car dealership with all necessary facilities in the C4 Highway Commercial Zone. Located on the east side of Beach Boulevard, approximately 265 ft. south of - Terry Drive, excluding the 150' x 150, corner. Legal description on file in the Planning Department Office. The hearing was opened.to the ­ audience. Dick Ner'io, applicant, addressed the Board and answered -questions.- Hugh Conroy, Ford Motor Co.; and Dennis-McElrath•,-Jerry Moss & Co. questioned the conditions of approval. They stated that a traffic hazard would be created in their tract by prospective buyers trying out the cars. There being no further comment, the hearing was ,clos'ed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 68-36 SUBJECT TO THE FOLLOWING CONDITIONS AS AMENDED WITH CONDITIONS 9, 10, and 11 ADDED: 1. Beach Boulevard shall be -fully improved to City and State Standards. Improvements shall include streettrees, street signs, street lights and fire hydrants. 2. Water supply shall be throughfthe City of. Huntington Beach's water system. 3. Sewage disposal shall be through -the City,of Huntington Beach's sewage system: 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assessment district. 6. A masonry wall shall be constructed al-ong the'east.property line if the property to the east is rezoned for residential purposes. The height of said wall shall be such, that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. 7. All applicable City Ordinances shall be complied with. 8. Driveway locations shall be approved by the Traffic Engineer. 9. Any lighting within said use shall be directed away from abutting property. 10. A Division of Land and parcel map filed with City and recorded. 11.
