MINUTES: The Planning Commission Minutes of August 6
and August 20, 1968 were accepted as tran-
scribed and mailed by the Secretary.
CONDITIONAL EXCEPTION NO. 68-47
TENTATIVE TRACT MAP NO. 6726
Subdivider: Wm. Lyon Development Co.
To permit the following:
1) 46 ft., 50 ft. , 52 ft. and 54 ft. right of
way streets as indicated on accompanying map of T.T. No. 6726. Subject
streets to be in compliance with standards proposed by the Deputy Director
of Public Works, and approved by both the Planning Commission (8/3/65)
and City Council (9/7/65).
2) 10 ft,, minimum front yard setbacks for
fences not over 6 ft, in height, for garages with side ,on -to -street approach
and for other portions of a residence. (Note: Front setback requirements
for garages entered directly from the street to be 22 ft. min.).
3) 10 ft. minimum rear yard,setbackJon,
irregular shaped lots, providing an average rear yard depth of 20 ft. is
maintained. On other lots 10 ft. minimum rear yard setback for a portion
of a house provided the remaining rear yard has 900 sq. ft, minimum of
area with the min. rear yard depth being 20 ft.
4) Every 6 consecutive lots to average 60 ft.
in width (at a 20 ft. setback from front property line) with an average 6, 000
sq. ft. of lot area for said 6 consecutive lots. (The minimum rectilinear lot
shall not be less than 50 ft. in width with 5, 000 sq. ft. of lot area including
corner lots) .

District;

To allow a cocktail bar to cater to adult residents
to the north Huntington Beach area.
The Staff Report was read by the Acting Secretary.

REASONS:
1. The use will be conducted within an existing shopping center.
2. The Police Department has reviewed this request and does not find the use
or location objectionable.

District.
The Staff Report was read by the Acting Secretary.
The hearing was opened to the audience.
Representative for the applicant addressed the
Commission and explained the proposal.
Richard Nerio, owner of the subject property,
5741 Warner Avenue, Huntington Beach, addressed the Commission and spoke
in favor of the request.
George Dudrow, 16801 Heritage Lane, Huntington
Beach, addressed the Commission and submitted a petition signed by 232 property
owners objecting to the zone change. The following property owners addressed
the Commission and opposed the request: Ralph James, 16831 Heritage Lane,
Al Molega, 16782 Heritage Lane, and Virgil Engel, 16781 Heritage Lane.
There being no other comment the hearing
was closed.
A lengthy discussion was held.

submit a petition to rezone the property to R-1.

RESOLUTION NO. 68-35 A Resolution of the City Planning Commission
Recommending Approval of Zone Case No. 68-35
to the City Council.
A MOTION WAS MADE BY TOM AND SECONDED
BY SLATES TO ADOPT RESOLUTION NO. 68-35 RECOMMENDING APPROVAL OF
ZONE CASE NO. 68-35 TO THE CITY COUNCIL FOR THE FOLLOWING REASON:
1. A condition of approval for Tentative Tract No. 6651 required the applicant
to submit a petition to rezone the property to R-1.

Family Residence District.
The Staff Report was read by the Acting Secretary.
The Acting Secretary informed the Commission
that the next item on the agenda is a proposed precise plan of street alignment
to extend Terry Drive west of Beach Blvd., which will tie in with Zone Case
No. 68-34, and suggested that the hearing should be open to both cases.
The hearing was opened on Precise Plan No. 68-1
and Zone Case No. 68-34 to the audience.
, William Carlson, representing the applicant
in Zone Case No. 68-34, addressed the Commission and explained the proposal.
There being no other comment the hearing was
closed.

A Resolution of the City Planning Commission
Recommending Approval of Zone Case No. 68-34
to the City Council.
A MOTION WAS MADE BY SLATES AND SECONDED
BY MILLER TO ADOPT RESOLUTION NO. 68-34 RECOMMENDING APPROVAL OF
ZONE CASE NO. 68-34 TO'THE CITY COUNCIL FOR THE"FOLL'OWING REASONS:
1. Precise Plan of street alignment No. 68-1 extending Terry Drive westerly of
Beach Blvd. was adopted by the Planning Commission.
2. This parcel is one of a few parcels fronting on Beach Blvd. , and the only
parcel in this area not designated for commercial development.
3. The property is master planned for high density development.

Dan Sizemore and Larry Chaffers, representing
the applicant, addressed the Commission and explained the request.
E. D. Harpole, La Bolsa Tile Company addressed
the Commission and opposed the request.
There being no other comment the hearing was
closed.
A MOTION WAS MADE BY LANE AND SECONDED
BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO. 68-49 FOR THE
FOLLOWING REASON: .
1. The subject request -is in compliance with surrounding uses.
AND UPON THE FOLLOWING CONDITION:
1. Driveway location shall be approved by the staff.

CODE AMENDMENT NO. 68-9 - Continued
Said proposal will (1) Amend the -Subdivision'
Ordinance; (2) Amend Section 9102:1 of the R1 zone to increase the minimum
lot size to 6500 sq. ft. ; (3) Amend Section 1903.3.1 of the R-1 zone to increase
the minimum open space requirements in the rear yard to require 1200 sq. ft.
with a minimum dimension of 25 ft. with ekceptions made for previously
established building sites; (4) Amend Article 910 (R-1 Zone) by adding Sections
9106.2.1 and 9104.5 to permit a reduction of the required front yard setback to
7-1/2 ft. for garages and fences subject to site plan approval; (5) Amend
Articles 910, 916, 920 and 923 to permit unenclosed stairways or balconies to
encroach four (4) ft. into the required front and/or exterior side yard setbacks;
(6) Amend Article 920 and 923 to permit construction of a portion of the
dwelling within the required rear yard when constructed over a garage and/or
carport; and (7) Amend Articles 910, 916, 920 and 923 by permitting "0"
side yard setbacks on one side'of the lot subject to certain'conditions and
site plan approval.

there being no comment the hearing was closed.
The Commission reviewed the -compilation'
of recommendations regarding the proposed amendments -to the- Subdivision
and Zoning Ordinance. The following items were discussed by the Commission.
1) Lot sizes; 2) setbacks; 3)'open space; 4) garden walls within- the 10 ft.
side yard setback; 5) "0" side and rear yard construction; °6)=architectural
features projecting over a lot line; 7)' second story 'setback; and, 8) street
trees.

SECONDED BY TOM TO RECOMMEND APPROVAL OF THAT PORTION OF CODE
AMENDMENT NO. 68-9 AS MODIFIED AND INDICATE POINTS OF DISAGREE -
MENT TO THE CITY COUNCIL.

COMMISSION RECONVENED: The Commission reconvened at 10:15 ,P. M.
LOT CONSOLIDATION - SITE No. 12
The Planning Director 'made 'a presentation
on the proposed lot .consolidation' of blighted parcels pertaining to Site No. 12,
located 500 ft. north of Ellis Avenue, on the east side of Beach Blvd.
Discussion was held between the Commission
and various property owners.
It was the -consensus -that the Staff should --
meet with property owners and discuss the proposal.

COMMUNICATION:
The Acting Secretary read a legal notice
submitted by the Orange County Planning Commission pertaining to Zone
Case No. 68-1 which proposes to change the zone from R-4 Suburban
Residential District to. PC Planned Community District.
The Commission reviewed the request and
it was their consensus to recommend approval to the Orange County Planning
Commission.
DISCUSSION:
The Acting Secretary stated that the staff
is in the process of preparing a code amendment which will permit "0" set-
back for carports and garages on large apartment projects.
A MOTION WAS MADE BY SLATES AND
SECONDED BY MILLER TO INSTRUCT THE STAFF TO PREPARE A CODE
AMENDMENT PERTAINING TO "0" SETBACKS FOR CARPORTS AND
GARAGES TO BE BROUGHT BACK TO THE COMMISSION FOR FURTHER
CONSIDERATION.
