USE PERMIT NO. 68-44 (Continued) Applicant: A & W International, Inc. To permit the construction of coffee -shop restaurant -with supplemental car service in,the rear in the C4 Highway Commercial District. Located on the northwest corner of Beach Boulevard and Stark Street. Legal description on file in the Planning Department Office. The hearing was opened;to the audience. - Carl Arthofer, representing the applicant, addressed the Board and answered various questions:, - ' the hearing was closed. There being no further comment, Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 68-44 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Beach Boulevard and Stark Street shall be dedicated and fully improved to City and/or State Standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights and fire hydrants. 2. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 3. Sewage disposal shall'be through the City of Huntington B�eachvs'sewage system at the -time -said parcellis developed. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 7. All utilities shall be installed underground at the time said parcel is developed. 8. The structural street section of all private drives shall be approved by the Department of Public Works. 9. Off-street.parking facilities shall conform to Article 979. 10. Parking compounds shall be screened with a,conbination of fencing and landscaping., Said -.-plan shall be approved by the Planning Department. 11. A masonry wall shall be constructed along west and north property line as shown on Plot Plan. The hei ht of said wall shall be such, that the top will be six6) feet above the highest ground surface within twenty (20) feet of the common property line. 12. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 13. All applicable City Ordinances shall be complied with. 14. Driveway location and number shall be approved by the Traffic Engineer. 15. Subject to approval of Conditional Exception No. 68-51 as approved by the Planning Commission. 16. A Division of'Land shall be filed to consolidate R3 lots with the C4 parcel. 17. Building shall conform to model shown. That said use conform to Section 9730.25.4. ROLL CALL VOTE: AYES: McFarland, Palin, Spencer NOES: None ABSENT: None THE MOTION CARRIED. USE PERMIT NO. 68-45 Applicant: Houser Bros. Co. To permit the construction of 56 one-story garden apartment units within their pro- posed R2 zoning. Located on the southeast corner of -Edinger Avenue and Monterey Lane. Legal description on file in the Planning Department Office. The hearing was opened to the audience. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE USE PERMIT NO. 68-45 TO THE DECEMBER 4, 1968 MEETING FOR THE FOLLOWING REASONS: 1. Zone Case No. 68-28 has been deferred and scheduled for a new public hearing December 3, 1968. 2. The Board of Zoning Adjustments cannot act on this Use Permit within the R-5 zone. USE PERMIT NO. 68-46 Applicant: Newport Balboa Savings & Loan Assn. To permit the construction of a 50 unit apartment project in the R3 Limited Multiple Family Residence District. Located at the southwest corner of Warner Avenue and Edwards Street. Legal description on file in the Planning Department Office. audience. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 68-46 SUBJECT TO THE•FOLLOWING CONDITIONS: 1., Warner Avenue, Edwards Street and Saint George Lane shall be:dedicated and fully improved to City Standards at the time said -parcel is developed. Improvements shall include street trees, street signs, street lights and fire hydrants. 2. CONDITIONAL EXCEPTION NO. 68-56A Applicant: Kavanaugh -Beard To permit 110" rear yard setback on garages and that portion of dwelling constructed over such garages,on Lot 10 and 18. Also, a 5 ft. rear yard setback on second story portion of dwelling constructed over garages on Lots 1-9 and 11-17 as shown on plot plan. Located west of Gothard Street approximately 660 ft. north of Warner Avenue. Legal description on file in the Planning Department Office. to the audience. No.portion of structures and/or architectural features -shall project over property line. 2. No garage door shall project over property line. AND FOR THE FOLLOWING REASONS: 1. Said construction would be permitted under Code Amendment 68-9. 2. The 110" reaxyard setback will not affect the minimum 25 ft. turning radius required for garage or carport entered directly from an alley. ROLL CALL VOTE: AYES: McFarland, Palin, Spencer NOES: None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 68-57A Applicant: Standard Oil Co. of California To permit building addition encroachment with reduction of required landscaping and to allow canopy on Brookhurst Street to encroach into setback line. Located on the northwest corner, Brookhurst Street and Adams Avenue. Legal descrip- tion on file in the Planning Department Office. The hearing was opened to the audience. Charles Blumberg, representing the applicant, addressed the Board to explain the request. the hearing was closed. There being no further comment, Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 68-57A SUBJECT TO THE FOLLOWING CONDITIONS: 1. Street trees on Brookhurst Street and Adams Avenue. 2. The on -site landscaping shall be as shown on approved Plot Plan. FOR THE FOLLOWING REASONS: 1. The station is approximately 10 years old and con- structed prior to present requirements. 2. The 980 sq. ft. of landscaping will be 455 sq. ft. over that landscaping required for said encroachment. 3. Said structure conforms to the sight angle encroachment. -5- I1/6/68 Minutes: H.B.
