TUESDAY, JANUARY 21, 1969 COMMISSIONERS PRESENT: Bazil, Lane, Bokor, Slates, Duke, Miller, Tom. COMMISSIONERS ABSENT: None. SCHOOL SITE # 33 - Continued Located on the west side of Algonquin Street, south of Edinger Avenue. The Acting Secretary informed the Commission that items 2 and 3 are also in the same area and are in conjunction with this item. Mr. Harlow stated that School Site #33 should be continued to February 4, 1969, to allow time for the City to determine a park site location adjacent to the school. TENTATIVE TRACT MAP NO 6808 CONDITIONAL EXCEPTION NO 68-57 Subdivider: Huntington Harbour Corp. To allow the construction of 23 condominium units in the R-1 District, located approximately 300 feet west of Saybrook Lane on the north side of Humboldt Drive. The Acting Secretary read a letter submitted by the applicant requesting withdrawal of Conditional Exception,No. 68-57. A MOTION WAS MADE BY DUKE AND SECONDED BY LANE TO ACCEPT THE WITHDRAWAL OF CONDITIONAL EXCEPTION NO 68-57. Change of zone from C-2 Community Business District to R-3 Limited Multiple Family Residence District. Located at the southwest corner"' of Edinger Avenue and Bolsa Chica Street. The hearing was re -opened to the audience. J. A. Bergum, representing the applicant, addressed the Commission and gave his reasons for the request. Mr. Munselle, architect for the developer displayed various sketches of the proposal. Mr. Sneeders, associate with Mr. Bergum, who will be responsible for leasing and maintaining the project also discussed the project with the Commission. There being no other comment, the hearing was closed. A lengthy discussion was held. A MOTION WAS MADE BY LANE AND SECONDED BY DUKE TO DENY ZONE CASE NO 68-51 FOR THE FOLLOWING REASONS: 1. The applicant has indicated that a market analysis of this area indicates weak or marginal need for additional commercial; however, the applicant has not submitted infor- mation to substantiate this finding. 2. A survey for commerical need within 1/2 mile of the subject property indicates a commercial deficit of 11.33 acres and a 2.21 deficit within one mile of the subject property if the R-3 were approved. 3. Impact on the schools caused by an increased population density. 4. It would result in a spot zoning of the R-5 parcbls fronting on Bolsa Chica Street and Edinger Avenue. 5. The existing commercial will be needed because of the Aquatic Park, freeway alignment and the Multiple Family Residence District to the south. Planning Commission Tuesday, January 21, 1969 Page No. 3 ANOTHER MOTION WAS MADE BY MILLER AND SECONDED' BY SLATES TO APPROVE ZONE CASE NO 68-51 FOR THE FOLLOWING REASONS: 1. The applicant said that a market analysis of this area indicates a weak or marginal need for additional commer- cial, because of the ammunition depot to the north, MI -A zoned property to the northeast and Meadowlark Airport to the southeast. 2. It is not the policy of the Commission to allow commercial on the 1/2 mile intersection, but contrary to this policy the intersection 1/2 mile south of the subject property has three corners zoned commercial that has a definite impact on this property. 3. The applicant has deleted a 125 x 140 ft., parcel on Bol'sa Chica St. to allow for a small neighborhood shopping facility, ROLL CALL VOTE: AYES: Slates, Miller, Bazil, Bokor NOES: Lane, Duke, Tom ABSENT: None THE MOTION CARRIED. ZONE CASE NO 68-53 —Continued Applicant - Wm Lyon Development Co. Change of zone from C-4 Highway Commercial District and R-5 Office -Professional District to R-3 Limited Multiple Family Residence District. - Located on the north and south side of Holland Drive, east of Beach Blvd. The Acting Secretary made a presentation of four different proposals for zoning patterns on the subject and adjacent properties. _The hearing was re -opened to one representative for the applicant and one representative for the homeowners objecting to the request. Mr. Bergum, representing the applicant, addressed the Commission and explained the request. Don Rittman, representing homeowners within the area addressed the Commission and submitted a petititon signed by 415 property owners opposing the request. - He also outlined their reasons for opposition. There being no other comment, the hearing was closed. Bill Hartge, City Engineer, informed the Commission that traffic generated.from the parcel, if left in its present zone classification would be 2 1/2 times greater than the traffic generated from -the proposed use. -3- 1/21/69 Minutes: H.B. This use will result in a traffic problem on Holland Drive and within the subdivision to the east. 2. There is no traffic signal located at Holland Drive and Beach Blvd. ROLL CALL VOTE: AYES: Bazil, Lane, Bokor, Slates, Duke, Miller, Tom NOES: None ABSENT: None THE MOTION CARRIED. TENTATIVE TRACT MAP NO 4419 Developer: Bankers Development Co Located on the south side of Heil Avenue, 295.24 feet west of Springdale Street. The Subdivision Committee Report was read by the Acting Secretary. Don Conklin, representing the applicant, addressed the Commission and offered to answer questions. A MOTION WAS MADE BY DUKE AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO 4419 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Tract Map received December 30, 1968, shall be the approved layout. 2. All utilities shall be installed underground. 3. A petition for rezoning to R-1 shall be filed at the time the final map is submitted to the City Council for approval. 4. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. ZONE CASE NO 68-55 Applicant - Bernard McCune Change of zone from R-A Residential Agricultural District to R-2 Two Family Residence District. Located on the south side of Adams Ave., 960 ft. west of Brookhurst St. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. -4- 1/21/69 Minutes: H.B. Mr. McCune, applicant, addressed the Commission and explained the proposal. There being no other comment the hearing was closed. A MOTION WAS MADE BY SLATES AND SECONDED BY MILLER TO APPROVE ZONE CASE NO 68-55 FOR THE FOLLOWING REASONS: 1. It has been accepted practice to permit medium density development along arterial highways when adjacent to a large shopping facility such as that proposed east of this parcel. 2. The added population will not adversely effect the popula- tion balance in this quarter section because the 14.5 acre parcel to the east was originally proposed for residential development and is now proposed for commercial development. 3. The additional units will assist in supporting some of the commercial activities in the area. COMMISSIONER BAZIL: Commissioner Bazil's comments for voting no were as follows: 1) The area is master planned for low density; 2) This area should not be rezoned for multiple development until a stud on the southwest corner is completed to establish a need; 35 Eighty multiple units are under construction north of the shopping center at Adams Avenue and Brookhurst Street in the R-2 and R-3 zones and 25% to 30% of Huntington Continental development is used as rental units, which provide adequate multi -family housing area until the study will be completed. CONDITIONAL EXCEPTION NO 68-62 Applicant - Gary and Tad Nakase To permit the wholesale of growing plants and stocks and to allow the construction of customary shelters on the Southern California Edison Company R/W in the R-1 Single Family Residence District. Located on the east and west side of Bushard St., approximately 200 ft. south of Velardo Drive. The Staff Report was read by the Acting Secretary. Hal Skinner and Roy Smith, addressed -the Commission and opposed the request. There being no other comment, the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY BOKOR AND SECONDED BY DUKE TO APPROVE CONDITIONAL EXCEPTION NO 68-62 UPON THE FOLLOWING CONDITIONS: 1. Compost and sacked fertilizer shall be screened from the R-1 area. 2. Shrubs and trees shall be provided along the perimeter. 3. The site shall be kept in a neat and orderly manner subject to review by the Planning Staff quarterly. 4. Only commercial fertilizer shall be used and it shall be kept in sacks. 5. Conditional Exception No 68-62 shall become null and void on January 1, 1974. To permit the coratruction of a Mobile Home Park in the R-A Residential Agricultural District. Located at the southeast corner of Heil:Avenue and Springdale Street. The Staff Report was read by the Acting Secretary. Mr. Harlow also read a letter submitted by Richard Meine, opposing the request. It was noted by Bill Hartge, City Engineer, that the soils report was not adequate enough to properly analize the soil condition. Discussion was held. A MOTION WAS MADE BY MILLER AND SECONDED BY SLATES TO CONTINUE CONDIII-ML EXCEPTION NO 69-1 TO MARCH 18, 19699 FOR THE FOLLOWING REASONS: 1. To allow time for the Recreation and Park Commission to determine if this property should be a City Park. 2. PROPOSED CODE AMENDMENT NO 69-1 ON SITE -SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES IN R-5 DISTRICT The Commission reviewed the proposed amendment. A MOTION WAS MADE BY MILLER AND SECONDED BY BOKOR TO_RECOMMEND ADOPTION OF CODE AMENDMENT NO 69-1 BY THE CITY'COUNCIL. ROLL.CALL VOTE: AYES: Bazil', Lane, Bok or, Miller, Duke, Tom NOES: None, ABSENT: Slates THE MOTION CARRIED. CHAIRMAN BAZIL: Chairman Bazil informed the Commission of his attendance on the Sub -Committee of "Project D" pertaining to redevelop- ment of the downtown area. Chairman Bazil suggested that a new zone pertaining to standards, and possibly architec- tural review within -the area surrounding the parking districts should be prepared by the Staff. A MOTION WAS MADE BY BOKOR AND SECONDED BY TOM TO INSTRUCT THE STAFF TO PREPARE A DRAFT OF A NEW DOWNTOWN DEVELOPMENT ZONE. MEMO FROM THE PLANNING DEPARTMENT TO THE PLANNING COMMISSION The Acting Secretary read a memo from the Planning Department stating that the City of Huntington Beach has been requested to undertake the necessary steps to annex unincorporated area of Orange County known as Sunset Beach by certain residents and property owners of Sunset Beach. Mr. Harlow stated that this request has been forwarded to the Planning Commission for report or recommenda- tion to the City Council pursuant to Section 35108 of the Annextion Act of 1913. ,.-7- 1/21/69 11 Minutes: H.B. A MOTION WAS MADE BY LANE AND SECONDED BY DUKE TO RECOMMEND TO THE CITY COUNCIL TO UNDERTAKE THE NECESSARY STEPS TO ANNEX UNINCORPORATED AREA KNOWN AS SUNSET BEACH FOR THE FOLLOWING REASON: 1. After due consideration it was the Planning Commission's unanimous decision to recommend, in view of the rapidity of this proposal's culmination, that a positive approach be taken in the development of an action -study program. The City, working in close cooperation with Sunset Beach community representatives, should identify problems and offer alternative solutions concerning the area and the proposed annexation. Next, a workable Master Plan mutually acceptable should be developed. Third, a program of pre - zoning of the entire area would be culminated or in process prior to annexation.=-1his process would include an accelerated study of the area combined with positive action as different phases"of-the study are completed. INFORMATION: The'Acting Secretary informed the Commission that there will be a joint meeting on January 29, 1969, at 7:30 PM with City Council, Park and Recreation Commission and Planning Commission to discuss the park bond issue. DISCUSSION: The Commission discussed proposed code amendments pertaining to Planned Residential Development and Oil Ordinance. It was their consensus to bring these two items back to the Study Session on January 28, 1969. Richard A.
