MINUTES: Minutes of January 29, 1969, were accepted as
transcribed.
USE PERMIT NO. 68-51 - Continued
Applicant: P R C Development Corp.
To permit the construction of a
298 apartment complex in the proposed R3 Limited Multiple
Family Residence District. Located on the south side of
Warner Ave. 1320 ft. west of Goldenwest St. Legal descrip-
tion on file in the Planning Department Office.
In Conjunction With
CONDITIONAL EXCEPTION NO. 68-72 - Continued
Applicant: P R C Development Corp.
To permit the construction of car-
ports at 110" setback within a 298 unit apartment complex.
Located on the south side of Warner Ave. 1320 ft. west of
Goldenwest St. Legal description on file in the Planning
Department Office.
The hearing was opened to the
audience.
Thomas Yedor and Keith Lyon,
representing the applicant, addressed the Board and answered
various questions pertaining to street widths, street lay-
outs, parking assignment, a pedestrian access to the school
and provisions for trash collection.
There being no further comment,
the hearing was closed.
Board discussion followed.
A MOTION WAS MADE BY MCFARLAND
AND SECONDED BY HARLOW TO APPROVE USE PERMIT NO. 68-51
SUBJECT TO THE FOLLOWING CONDITIONS:
1. Goldenwest St. and Warner Ave. shall be dedicated and
fully improved to City Standards. Improvements shall
include street trees, street lights, fire hydrants,
sewer and water main extensions.
2. Water supply shall be through the City of Huntington
Beach's water system.
3. Sewage disposal shall be through the City of HuntingtDn
Beach's sewage system.
4. The water, sewer, and fire hydrant system shall be
approved by the Department of Public Works and Fire
Department.
5. Easements for utilities shall be provided to Department
of Public Works Standards.
6. The property shall participate in the local drainage
assessment district at the time said parcel is developed.
7. Soil reports as required by the Department of Public
Works and Building Department shall be submitted to the
City prior to issuance of building permits.
8. All utilities shall be installed underground.
9. Fire alarm system conduit and appurtenances shall be
installed by the developer at locations and to speci-
fications provided by the Fire Department.
10. A lighting system shall be installed within the project
equal to the illumination of lighting on public streets.

A lighting plan shall be submitted to the Department of
Public Works for approval.
11. All private drives shall be constructed to the require-
ments of the Public Works Department.
12. If the project is developed in increments, a plan for
traffic circulation within first increments and park-'
ing assignments shall be approved by the Board of
Zoning Adjustments.
13. Off-street parking facilities shall conform to Article 979.
14. A masonry wall shall be constructed along all interior
property lines. The height of said wall shall be such
that the top will be six (6) feet above the highest
ground surface within twenty (20) feet of the common
property line. A temporary waiver of this requirement
may be granted by the Department of Public Works at the
southwest corner of the project for drainage purposes.
15. There shall be no fence, structure, or landscaping con-
structed or maintained over 32 ft. high within a 10 ft.
x 10 ft. triangular area at the intersection of drive-
ways and streets.
16. No structures, other than those shown on the approved
plot plan, shall be constructed within the project.
17. Trash collection areas shall be shown on the plot plan
prior to issuance of a building permit.
18. Provisions shall be made to provide a pedestrian access
along the westerly 200 ft. of the south property line.
19. Street widths shall be -as follows:
1. Where vehicles can park on both sides, the paved
widths shall be 40 ft. between curbs.
2. Where vehicles can park on only one side the paved
width shall be 33 ft. between curbs.
Otherwise a minimum width of 28 ft. shall be provided.
20. All applicable City Ordinances shall be complied with.
21. A revised plot plan showing the above changes shall be
submitted to the Board of Zoning Adjustments for approval
prior to issuance of building permits.
22. A Division of Land application, separating this parcel
from the remaining property held under the same owner-
ship, shall be filed with the City, approved and recorded
prior to the framing inspection.

1. The walls having the 110" setback shall be of maintenance
free masonry construction.

SECONDED BY COOK TO CONTINUE ADMINISTRATIVE REVIEW NO.
69-2 AND CONDITIONAL EXCEPTION NO. 69-6 TO THE
FEBRUARY 19th MEETING FOR THE FOLLOWING REASON:
1. To allow time for the City Council to hold a second
reading of the ordinance adopting Code Amendment
No. 68-9 which will permit this kind of request.

east side of Pacific Coast Highway, north of Warner Ave.,
500 plus feet. Legal description is on file in.the Plan-
ning Department Office.
The hearing was opened to the
audience.
John Mandrell and Don Stuart,
representing the applicant, addressed the Board and
answered various questions pertaining to street layouts,
street widths and setback encroachments.

A MOTION WAS MADE BY HARLOW AND
SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 69-4
WITH THE FOLLOWING CONDITIONS:
1. Pacific Coast Highway and the rpoposed street shall
be dedicated and fully improved to City, County and/or
State Standards. Improvements shall include street
trees, street signs, street lights, fire hydrants,
sewer and water main extensions.

to the issuance of building permits.
18. A Division of Land application, separating this parcel
from the remaining property held under the same ownership,
shall be filed with the City, approved and recorded, prior
to framing inspection.

CONDITIONAL EXCEPTION NO. 69-5
Applicant: Bert Beria
To permit construction of
a patio cover 22 ft. from the exterior side property line in
lieu of the required 10 ft. setback. Located at 16581 Channel
Lane. Legal description on file in the Planning Department
Office.
The hearing was opened to
the audience.
Mr. Beria addressed the Board
and answered various questions.
Mr. A. W. Knox, spokesman
for the Huntington Harbour Home Owners' Association, opposed
the request, and stated that any such structure would have to

be approved by the Architectural Committee and further
that this structure did not meet with their approval.
He recognizes that there is a problem with people look-
ing into the lot and suggested that landscaping could
protect Mr. Beria's privacy and still preserve the
aesthetics desired by the Huntington Harbour Home -
Owners' Association.
Mr. Knox stated that he feels
the lot is an exterior lot and the required setback should
be maintained and further stated that if this conditional
exception is approved then other lots will request similar
consideration.
It was noted by the Board that
this lot should be considered equivalent to an interior
lot because of the physical conditions caused by the
bridge approach.
There being no further comment,
the hearing was closed.

A MOTION WAS MADE BY MCFARLAND
AND SECONDED BY COOK TO APPROVE CONDITIONAL EXCEPTION
NO. 69-5 WITH THE FOLLOWING CONDITION:
1. The structure shall maintain a 5 ft. side yard setback.
FOR THE FOLLOWING REASON:
1. The south side yard of the lot abuts an elevated street
which is caused by the bridge approach. Therefore, for
all practical purposes, the lot should be treated as an
interior lot.
