USE PERMIT NO.. 69-8 (Continued) Applicant: Robert L. Stellrecht To permit construction of an 80 unit apartment complex on 4.08 acres of land in the R2 Two Family Residence District. Located 300 ft. north of Warner Ave. ap- proximately 680 ft. east of centerline of Gothard St. Legal description on file in the Planning Department Office. The hearing was opened to the audience. Robert Stellrecht addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY HARLOW TO APPROVE USE PERMIT NO. 69-8 WITH THE FOLLOWING CONDITIONS: 1. Washington Ave., Nichols St. and Lyndon St. shall be de- dicated and fully improved to City Standards.' Improve- ments shall include street trees, street signs, street lights and fire hydrants, sewage and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be approved by the,Department of Public Works and Fire Department. 5. All buildings on lots abutting a public easement shall be set back five (5) feet from the edge of such easement. 6. The flood control channel shall be fenced to Flood Control District Standards and City Standards.- 7. The property shall participate in the local drainage assessment district. 8. Soil reports as required by the Department of Public Works and the Building Department shall be submitted to the City prior to issuance of building permits. 9. All utilities shall be installed underground. 10. A lighting system shall be installed within the project equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Pub- lic Works for approval. 11. The structural street section of all private drives shall be approved by the Department of Public Works. 12. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 13. All applicable City Ordinances shall be complied with. 14. A drainage easement shall be provided at location and to specifications required by the Department of Public Works. 15. On -street parking along Nichols St. shall not be permitted and provisions shall be made to provide the ten (l?,) o'ff-' street parking spaces, shown on °Ni-Chols St., on site. Minutes: H. B. Southern Investment Co. To permit a 97 unit mobile home park on approximately 10 acres and customary accessory buildings in the R5 Office -Professional District. Located along east side of Ward St., north of Yorktown, between Ward St. and Santa Ana River. Legal description on file in the Planning Department Office. The hearing was opened to the audience. Dale Bush and Gene Harvey, representing the applicant, addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 69-9 WITH THE FOLLOWING CONDITIONS: 1. The wall along Ward St. shall be constructed within the public right-of-way. The wall and landscaping plan for Ward St. shall be approved by the Planning Department. 12. There shall be no fence, structure, or landscaping construc- ted or maintained over 32 ft. high within a 10 ft. x 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. x 25 ft. triangular area at the inter- section of streets. -2- 3/12/69 Minutes: H.B. All applicable City Ordinances shall be complied with. 15. Yorktown Ave. shall be vacated prior to issuance of Building permits. 16. A Division of Land application, separating this parcel from the remaining property held under the same owner- ship, shall be filed with the City, approved and recorded prior to framing inspection. Huben To permit an addition to an existing bar in the C4 Highway Commercial District. Located on the north side of Adams Ave. approximately 100 ft. west of Beach Blvd. Legal description on file in the Planning Department Office. The hearing was opened to the audience. Michael Huben addressed the Board and answered various questions. Mr. John Henrickson addressed the Board in protest of this use permit because of the noise and parking problems with the existing use. Mr. Ken Hopkins addressed the Board in protest of this use permit because the parking overflows onto his lot. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY HARLOW TO CONTINUE USE PERMIT NO. 69-10 TO GIVE THE APPLICANT TIME TO RESOLVE HIS PARKING PROBLEMS WITH THE PROPERTY OWNER. To permit the construction and opera- tion of a Burger King restaurant.in_the C4 Highway Commercial District. Located the southwest corner of Beach Blvd. and McDonald St. Legal description on file in the Planning Depart- ment Office. The hearing was opened to the audience. Paul Campbell and Mr. Davis, represent- ing the applicant, addressed the Board and answered various questions. Mr. A. E. Ruoff, Jr., property owner, addressed the Board stating he would move the existing water line and relocate the easement. Mr. Watson, abutting property owner, addre'ssed'the Board, inquiring as to the possible added noise as well as the drainage problems on his property. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 69-11 WITH THE FOLLOWING CONDITIONS: 1. McDonald Street and Beach Blvd. shall be dedicated and fully improved to City and/or State Standards at the time said parcel is developed.- Improvements shall include street trees, street signs, street lights, fire hydrants and sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 3. Sewage disposal shall be through the City of Huntington' Beach's sewage system at the time said parcel is developed. 4. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assess- ment district at the time said parcel is developed. 6. Soils reports, as required by the Building Department shall be submitted to the City prior to issuance of building permits. 7. All utilities shall be installed underground at the time said parcel is developed. 8. Fire alarm system conduit and appurtenances shall be in- stalled.by the developer at locations and to specifications provided by the Fire Department. 9. Driveways shall be constructed at locations and specifica- tions required -by traffic engineer and the State. 10. Lighting shall be directed away from the adjacent property. 11. Off-street parking facilities shall conform to Article 979. 12. A masonry wall shall be constructed along the west property line. The height of said wall shall be such, that the top will be 6 feet above the highest ground surface within 20 feet of the common property line. 13. No structure, other than those shown on the approved plot plan, shall be constructed within the project. 14. All applicable City Ordinances shall be complied with.., 15. A revised plot plan shall be submitted to the Board of Zon- ing Adjustments prior to issuance of building permits in- corporating the above changes. IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 69-14 Applicant: John L. Peterson To permit the construction of detached garages at 110" setback in lieu of the required 5 ft. interior side yard setback and a reduction in the required mini- mum 20 ft. dimension for open space to 12 ft. A MOTION WAS MADE BY HARLOW AND SECONDED BY COOK TO CONTINUE THE HEARING ON USE PERMIT NO. 69-12 AND CONDITIONAL EXCEPTION NO. 69-14 UNTIL MARCH 19, 1969, AND TO HAVE THE PLANNING DEPARTMENT CON- TACT THE APPLICANT AND ASK HIM TO BE PRESENT AT THE MEETING. DIVISION OF LAND NO. 69-5 Applicant: Stanley Fann To allow a division of land of one parcel into two legal building sites. Located at the northwest corner of Warner Ave. and Springdale St. Legal description on file in the Planning Department Office. There was no one present to represent the applicant. Board discussion was held. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE DIVISION OF LAND NO. 69-5 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Springdale Street and Warner Avenue shall be dedicated and fully improved to City Standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, and sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The flood control channel shall be fenced to Flood Control District Standards and City Standards at the time Parcel I is developed. 6. Drainage of the property shall be approved by Department of Public Works. 7. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 8. All utilities shall be installed underground. 9. Fire alarm system conduit and appurtenances shall be in- stalled by the developer at locations and to specifica- tions provided by the Fire Department. 10. A Parcel Map shall be filed with the City and recorded prior to framing inspection by the Building Department on the first parcel to develop. 11.
