USE PERMIT NO. 69-5 (Continued) Applicant: Fifth Avenue Realty Corp. To permit construction of a 14.5 acre shopping center with a major department store and miscellaneous shops within the C4 Highway Commercial District. Located on the southwest corner of Brookhurst and Adams St. Legal descrip- tion on file in the Planning Department Office. s The hearing was opened to the audience. There was no one present to represent the applicant. There being no comment from the audience, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SE- CONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 69-5 WITH THE FOLLOWING CONDITIONS: L. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. A Division of Land application, separating this parcel from the remaining property held under the same owner- ship, shall be filed with the City, approved and recorded, prior to issuance of building permits. A MOTION WAS MADE BY COOK AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 69-10 WITH THE FOLLOWING CONDITIONS: 1. Adams Ave. shall be fully improved to City Standards at the time said parcel is developed. Improvements shall include street trees, street signs, streetlights and fire hydrants. _ 2. Located on the west side of Beach tivd. approximately 500 ft. south of.Cypress Ave. Legal description on file in the Planning Department Office. IN CONJUNCTION WITH DIVISION OF LAND NO. 69-6 Applicant: Harold Robbins, M.D. To permit a division of land of a 132 ft. x 330 ft. parcel of land into two spearate parcels. IN CONJUNCTION WITH ADMINISTRATIVE REVIEW NO. 69-5 Applicant: Harold Robbins, M.D. To permit the display of used autos in the required setback as required by Section 9432.3 of the Huntington Beach Ordinance Code. The hearing was opened to the audience. Don Jones, representing the applicant, addressed the Board and answered various questions. He also questioned the need for the division of land. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY COOK TO APPROVE USE PERMIT NO. 69-14 WITH THE FOLLOWING CONDITIONS: 1. Beach -Blvd. shall be fully improved to'City and State standards. Improvements shall include street trees, street lights, fire hydrants, sewer and water main extensions. 2. _Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be ap- proved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assessment district. 6. A 3 ft. wide landscaping strip shall be provided along the front property line as required under 9432.3 of the Huntington Beach Ordinance Code. 9. Three percent of the site shall be landscaped. 10. Six off-street parking spaces shall be provided for the medical building and three employee off-street parking spaces shall be provided for the car agency. -Such spaces shall be designated on the plan and shall not be used for any other purpose. 11. All applicable City Ordinances shall be complied with. 12. IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 69-22 Applicant:. -Dorothy R. Fulmer To permit the construction of detached parports within a 76 unit apartment complex to -.be constructed at 110" setback in lieu of the required 5 ft. setback. The hearing was opened to the audience. Dorothy Fulmer addressed the Board and answered various questions. - Mr. & Mrs. -Manning, Mrs. Hardy and Mrs. Cantrell addressed the Board, asking various questions about the proposed construction. There being no further comment, the hearing was closed. Board discussion followed. Keelson Lane and Elm St. shall be dedicated and fully improved to City standards. Improvements shall include street trees,,street lights, fire hydrants and sewer and -water main extensions. 2. Water -supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be ap- proved by the Department of Public Works and Fire Depart- ment. 5. The property shall participate in the local drainage assessment district. 6. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to the issuance of building permits. 7. A lighting plan'shall be submitted to the Department of Public Works for approval. 10. The structural street section of all private -drives shall be approved by the Department of Public Works. 11. There shall be no fence, structure, or landscaping con- structed or'maintained over 32 ft. high within a 10 ft.x 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. x 25 ft. triangular area at the intersection of streets. 12. The off-street parking area obtaining access from Keelson Lane shall be revised to eliminate the excessive curb break. Curb cuts shall be subject to approval by -the Traffic Engineer. 13. A 6 ft. high masonry wall shall be constructed on the - west property line for separation purposes, where deemed necessary by the Building Department. 14. A Division of Land application, separating this parcel from the remaining -property held under the same owner- ship, shall -be filed with -the City, approved and recorded prior to framing inspection. 15. The configuration of the turnaround on the westerly drive shall be circular. 16. All applicable City Ordinances shall be"complied with. CONDITIONAL EXCEPTION NO. 69-20 Applicant: Richard L. Zylstra To permit a reduction of the required 900 sq. ft. of open space to 792 sq. ft. and to per- mit a reduction in the required minimum dimension of 20 ft. to a minimum of 15"ft. Also, to permit a 3 ft. cantilever of the second story over the garages to be,constructed to,'- within 7 ft. of the rear property line in lieu of the re- quired 10 ft. rear yard setback. Said request:_applies to a proposed three (3) unit apartment complex on a 54 ft. x 122.5ft. lot in the R2 Two. -Family Residence District. Located on the northwest corner of Knoxville Ave. and Delaware St'. Legal description on file in the Planning Department Office. The hearing was opened to the audience. Richard Zylstra addressed the Board and answered various questions. A letter was read by the Secretary opposing this -request. A MOTION WAS MADE BY HARLOW AND SECONDED BY_MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 69-20 WITH THE FOLLOWING CONDITION:. 1. Delaware St. and Knoxville Ave. shall be dedicated and fully improved to City standards at the time said parcel is developed. Improvements shall in- clude street -trees, street signs, street lights, fire hydrants and sewer and water main extensions. FOR THE REASONS: 1. The applicant is providing 792 sq. ft. of open space with a minimum dimension of-15 ft. which exceeds the amount of open space required by ordinance and the arrangement of open space is such that it serves the units more efficiently. 2. Mr. Ruggles and Mr. Devlin, representing the applicant, addressed the Board and answered various questions. There being no further comment, the hearing was closed.
