TUESDAY, APRIL 15, 1969 COMMISSIONERS PRESENT: Bazil, Bokor, Miller, Tom, Porter COMMISSIONERS ABSENT: Slates, Duke TENTATIVE TRACT MAP NO 6866 Subdivider: Chip Development Co. A proposed 28 lot industrial subdivision on 10 acres of land located north of Talbert Avenue, 660 feet east of Golden West Street. The Subdivision Committee Report was read by the Acting Secretary. John Mandrell, engineer, repre- senting the applicant, addressed the Commission and explained the proposal. Mr. Mandrell asked what the timing would-be as to condem- nation by the city of subject property for the purpose of developing the land into a central city park and library site. Mr. Liberto, Deputy City Attorney informed Mr. Mandrell that the timing at the present time is unknown. The Acting Secretary informed the Commission that the City Council adopted a resolution instructing the Commission to defer all consideration of any proposed projects within the central city park area authorized to be condemned for public purposes by the City Council. Discussion was held. A MOTION WAS MADE BY MILLER AND SECONDED BY BOKOR TO DENY TENTATIVE TRACT MAP NO 6866 FOR THE AFOREMENTIONED REASONS. ROLL CALL VOTE: AYES: Bazil, Bokor, Miller, Tom, Porter NOES: None ABSENT: Slates, Duke THE MOTION CARRIED. COMMISSIONER DUKE: Commissioner Duke arrived at 7:20 P.M. and assumed his duties. TENTATIVE TRACT MAP NO 6933 Subdivider: Macco Corporation A proposed 44 lot residential subdivision on 13 acres,.located 430 feet south of Warner Avenue, 660 feet west of Edwards Street. -1- 4/15/69 - PC Minutes: H.B. Planning Commission Tuesday, April 15, 1969 .Page No. 2 The Subdivision Committee Report was read by the Acting ---Secretary-. _ Evan-Aliurphy,- representing the applicant, addressed the -Commission and stated -that he did not have objections to the conditions as suggested by the Subdivision Committee. A MOTION WAS MADE BY PORTER AND SECONDED BY DUKE TO APPROVE TENTATIVE TRACT MAP NO 6933 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received April 7, 1969, shall be the approved layout. 2. The water and fire hydrant system shall be approved by the Department of.Public Works ---and Fire Department. 3. A 6 ft. high masonry wall shall be constructed along the property line of all lots having a common property line with the park site and where R-1 lots abut property zoned or proposed for multiple family development. 4. Lot 33 shall be eliminated and included as,a part of the park site. 5. All utilities -shall be installed -underground. 6. A petition for rezoning lot 43 to R-3 shall be filed prior to the time the final map is submitted to the City Council for acceptance. 7. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. The Acting -Secretary read -a -letter submitted by the applicant, requesting c"ohtinuance of Zone Case No. 69-6 to May 6, 1969. A letter submitted by the Meredith Gardens Homeowners Association opposing the request was read by the Acting Secretary. audience. It is customary to grant such a request in fairness to the applicant. ROLL CALL VOTE: AYES: Bazil, Bokor, Miller, Duke, Tom, Porter NOES: None ABSENT: Slates THE MOTION CARRIED. CONDITIONAL EXCEPTION NO 69-14 Applicant - Del Bunch Corporation To permit the following: 1. Construction of a duplex causing a reduction in density to 1721 sq. ft. in lieu of the required 2000 sq. ft. per unit in the R-2 Two Family Residence District; 2. Construction of a 2nd story in the rear yard to within 5 ft. of an alley in lieu of the required 10 ft. rear yard setback; 3-. Maintain 14 ft. between main dwellings in lieu of the required 15 ft; 4. A minimum dimension of 17 ft. for the required open space in lieu of the required minimum of 20 ft. Located at the northwest corner of California Street and Joliet Avenue. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. A video tape was shown of the subject property and the surrounding area. A representative for the applicant, addressed the Commission and explained the proposal. James DeGuelle, 1011 California St., addressed the Commission and opposed the request. There being no other comment, the hearing was closed. Commission discussion was held. It was noted that the applicant is requesting permission to develop his lot to R-3 standards rather than R-2 and said lot is completely surrounded by property zoned R-2 and developed to R-1 and R-2 standards. A MOTION WAS MADE BY DUKE AND SECONDED BY TOM,TO DENY'CONDITIONAL EXCEPTION NO 69-14 FOR THE FOLLOWING REASONS: 1. The applicant has not demonstrated any reason why his property should not conform to development standards of the R-2 zone. 2. The entire area should be treated the same as to an increase in density and the applicant has not shown the need for an increase in density for the entire area. -3- 4/15/69 - PC Minutes: H.B. ZONE CASE NO 69-10 RESOLUTION OF INTENT Change of zone from M-2 G.eneral Manufacturing Industrial District and M-2-0 General Manufacturing Industrial District combined with oil production, to R-2 Two Family Residence District and R-2-0 Two Family Residence District combined wit oil p,rodu¢:tion to'R-3 Limit�d'Multiple Family Residence District 'and R-3-0 Limited Multiple Family Residence District combined with oil production; to R-4 Multiple Family Residence District and R-4-0 Multiple Family Residence District combined with oil production. The property is generally bounded by Palm Avenue on the north, 18th Street on the west, Ocean Avenue on the south, and 16th Street on the east. The Acting Secretary made a presentation of the proposal. A letter submitted by Wilford O'Brien, objecting the proposal was read by the Acting Secretary. The hearing was opened to the audience. The following property owners addressed the Commission and objected to the proposal: Phillis Galkin, 715 - 10th Street and Jack Ellsworth, 311 - 17th Street. A. C. Marion questioned the use of existing building. There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY DUKE AND SECONDED BY PORTER TO TABLE ZONE CASE NO 69-10 INDEFINITELY AND THAT ANY FURTHER ACTION ON THIS MATTER BE RE= -ADVERTISED. ALSO, THAT FURTHER ACTION NOT BE TAKEN UNTIL THE ECONOMIC BASE STUDY OF THE AREA IS COMPLETED. CODE AMENDMENT NO 69-3 (Continued) OIL CODE ORDINANCE Said amendment proposes to amend Article 968 (0-Combining Oil District) by renumbering, rewording and adding various sections within such Article. Planning Commission 15, 1969 The hearing was opened to the Bill Woods, Oil Committee repre- sentative, commented on the proposal.. A. C. Marion, Huntington Beach Oil Co., and•Charles'Cather, questioned various sections of the code and objected to the proposal. Mr. Fred Kalenborn, Standard Oil Company, addressed the Commission and gave his opinion on the existing oil well production. There being no other comment, the hearing was closed. A MOTION WAS MADE BY TOM AND SECONDED BY PORTER TO RECOMMEND ADOPTION OF CODE AMENDMENT NO 69-3 BY THE CITY COUNCIL AND FURTHER RECOMMEND THAT CONFLICTING PROVISIONS OF OTHER SECTIONS OF THE HUNTINGTON BEACH ORDINANCE CODE AND THE OIL ORDINANCE CODE BE DELETED. The Acting Secretary read a letter submitted by Standard Pacific Corp., requesting a one year extension of time of Tentative Tract Map No. 5972, located south of Atlanta Avenue and East of Newland Street. The Staff Report was read by the Acting Secretary. A MOTION WAS MADE BY TOM AND SECONDED BY PORTER TO GRANT A ONE YEAR EXTENSION OF TIME ON TENTATIVE TRACT MAP NO. 5972 UPON THE FOLLOWING CONDITION: 1. CODE AMENDMENT NO 69-2 PLANNED RESIDENTIAL DEVELOPMENT AN CODE AMENDMENT NO 69-4 MAXIMUM BUILDING HEIGHTS It was the consensus of the Commission to continue Code Amendment No. 69-2 and Code Amendment No. 69-4 to a Study Session on April 29, 1969. -5- 4/15/69 - PC Minutes: H.B. Planning Commission Tuesday, April 15, 1969 Page No. 6 BEAUTIFICATION AWARDS The beautification awards according to final tabulation were as follows: COMMERCIAL 1st Newman and Beach Medical Center 2nd Bank of America (Admiralty Drive and Coast Highway) 3rd Town and Country Shopping Center (east of Beach Blvd., 300 ft. south of Ellis Avenue) PARKING LOT Town and Country (east of Beach Blvd., 300 ft. south of Ellis Avenue) PERIMETER WALLS Lamb Trailer Park (Brookhurst Street, north of Yorktown Avenue) QUASI PUBLIC Methodist Church (17th Street and Delaware Street) RESIDENTIAL Tiburon Bay (southeast corner of Coast Highway and Admiralty Drive) DISCUSSION: The Commission held a discussion regarding the definition of side yard setbacks along ,arterial_ highways. It was the consensus to continue this item to the Study Session on April 29, 1969. PERIMETER WALLS The Acting Secretary presented three different requests for approval of perimeter walls on Tracts No. 6453, 5917 and 6716. The Commission reviewed the wall designs for said tracts. It was the consensus of the Commission that the material for said walls was satisfactory, but the design of such walls and the proposed landscaping should be approved by the Department of Public Works and Planning Department. MEMO: STATEMENT OF POLICY The Planning Commission -received a' memo submitted by the City Attorney's Office regarding applications for Use Permits and Public and Quasi Public Uses under Section 9251.2.3, Huntington Beach Ordinance Code. It was noted that this action is necessary as an interim measure until such time as the Planning Staff can prepare a code amendment to handle such uses under the Special Use Permit procedure. In this application, the burden of proof will be tied to the granting of the use permit rather than the denial and the burden of proof will rest with the applicant rather than the Planning Commission. And further, steps to affect this ordinance have not been taken because it is only a portion of an extensive study and review of all application procedures. -6- 4/15/69 - PC Minutes: H.B. Planning Commission Tuesday, April 15, 1969 Page No. 7 A MOTION WAS MADE BY PORTER AND SECONDED BY DUKE TO ADOPT THE FOLLOWING STATMENT OF POLICY AND FORWARD SAME TO THE CITY COUNCIL FOR APPROVAL. In all cases where an application for a Use Permit is filed to ermit public or quasi public uses, described in Section 251.2.3 of the Huntington Beach Ordinance Code, such application shall be heard in the first instance by the Planning Commission under Article 984 of the Huntington Beach Ordinance Code. Written notice of the action taken by the Commission in such Use Permit cases shall be mailed by each member of the City Council on the day following the Planning Commission meeting at which such action was taken. It is understood and acknowledged that under:Section 9881 of the Huntington Beach Ordinance Code the City Council, or any member thereof, may request in writing without explanation, within the ten-day period for appeal, a hearing before the City Council to consider any decision, determination or requirement of the Planning Commission.
