Wednesday, April 23, 1969 BOARD MEMBERS PRESENT: McFarland, Cook, Harlow BOARD MEMBERS ABSENT: None MINUTES: The minutes of April 16, 1969, were accepted as transcribed. CONDITIONAL EXCEPTION NO. 69-28 (Continued) Applicant: Dwight S. Wadsworth To permit the installation of steel patio top and steel posts on a corner lot approximately 6 inches from the lot line in lieu of the required 5 ft. rear yard and side yard setbacks. Located at the southwest corner of Melody Lane and Prelude Drive in the R-1 Single Family Residence District, and legally described as Lot 142, Tract 3670. The hearing was opened to the audience. The applicant was not present. There being no comment from the audience, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO CONTINUE CONDITIONAL EXCEPTION NO. 69-28 TO THE MEETING OF A►,PRIL 30, 1969, TO ALLOW THE APPLICANT TIME TO APPEAR AT THE MEETING. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow NOES: None ABSENT: None THE MOTION CARRIED. USE PERMIT NO. 69-22 Applicant: Aptek Development Corp. To permit the construction of a 140 unit apartment complex on 4.07 acres of land in the R-3 Multiple Family Residence District. Located on the west side of Gothard St. 283 ft. north of Warner Ave. Legal description on file in the Planning Department Office. IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 69-30 Applicant: Aptek Development Corp. To permit the construction of de- tached carports at 110" setback on a portion of the north and south property lines in lieu of the required 5 ft. setback within a 140 unit apartment complex in the R-3 Multiple Family District. Located on the west side of Gothard St., 283 ft. north of Warner Ave. Legal description on file in, -the Planning Department Office. The hearing was opened to the audience. Mr. Pitts, representing the appli- cant, addressed the Board and answered various questions. Mr. Poole, representing the drive-in theater near the Aptek development, addressed the Board and requested some control of lighting in the development so that it would not impair his client's business. Board of Zoning Adjustments Wednesday, April 23, 1969 Page 2 A MOTION WAS MADE BY MCFARLAND AND SECONDED BY COOK TO APPROVE USE PERMIT NO.69-22 WITH THE FOLLOWING CONDITIONS: 1. Gothard St. shall be dedicated and fully improved to City standards at the time said parcel is developed. Improvements shall include street trees, street signs, street lights and fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be ap- proved by the Department of Public Works and Fire Depart- ment. 5. The flood control channel shall be fenced to Flood Control District standards and City standards. 6. The property shall participate in the local drainage assessment district. 7. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 8. All utilities shall be installed underground. 9. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to speci- fications provided by the Fire Department. 10. A lighting system shall be installed within the project equal in illumination to lighting on public streets. Lighting shall be directed away from abutting property. 11. All private streets shall meet the minimum standards for planned residential developments as adopted by the Planning Commission or the driveway plan as sub- mitted shall be approved by the Fire Department. 12. The structural street section of all private drives shall be approved by the Department of Public Works. 13. A masonry wall shall be constructed along the west and south property line. The height of said wall shall be such, that the top will be :six (6) feet above the highest ground surface within twenty (20) feet of the common property line. 14. There shall be no fence, structure, or landscaping con- structed or :maintained over 32 ft. high within a 10 ft. x 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. x 25 ft. triangular area at the intersection of streets. t. 15. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 16. All applicable City Ordinances shall be complied with. 17. A Division of Land application, separating this parcel from the remaining property held under the same owner- ship, shall be filed with the City, approved and re- corded, prior to issuance of building permits. That carports constructed on property line shall be of maintenance free masonry material. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow NOES: None ABSENT: None THE MOTION CARRIED. DIVISION OF LAND NO. 69-12 Applicant: Union Oil Co. of Calif. To permit a division of land of approximately 6.9 acres into two separate parcels. Located on the southeast corner of Adams Ave. and Magnolia St. Legal description on file in the Planning Department Office. John Eddy and Parker Smith, repre- senting the applicant, addressed the Board and answered various questions. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE DIVISION OF LAND NO. 69-12 WITH THE FOLLOWING CONDITIONS: 1. Adams Ave. and Magnolia St. shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights and fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is de- veloped. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. 4. The property shall ' participate in the local drainage assessment district at the time each parcel is developed. 6. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 7. All utilities shall be installed underground at the time each parcel is developed. 8. A Parcel Map shall be filed with the City and recorded. 9. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the condi- tions listed above.
