TUESDAY, MAY 6, 1969 COMMISSIONERS PRESENT: Bazil, Bokor, Slates, Tom, Miller, Porter COMMISSIONERS ABSENT: Duke MINUTES: On motion by Bokor and seconded by Porter, the Minutes--of- the,Huntington Beach Planning Commission of _march 4, 1969, were accepted as transcribed and mailed by the Secretary-. TENTATIVE TRACT MAP NO 6948 Subdivider: John D Lusk and Son 376 lots on 351.7 acres of land, located on the south side of Bolsa Avenue and west of Springdale Street. The Acting Secretary read a letter submitted by the developer, requesting a two week extension of time on said tract. A MOTION WAS MADE BY TOM AND SECONDED BY MILLER TO CONTINUE TENTATIVE TRACT MAP NO 6948'TO MAY 20, 1969, AT THE REQUEST OF THE APPLICANT. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Tom, Miller, Porter NOES: None ABSENT: Duke THE MOTION CARRIED. TENTATIVE TRACT MAP NO 6954 Subdivider: P B S Corporation 263 lots on 61.5 acres of land, located at the northwest corner of Atlanta Avenue and Bushard Street. COMMISSIONER DUKE: Commissioner Duke arrived at 7:10 P.M. and assumed his duties. The Subdivision Committee Report was read by the Acting Secretary. Mr. John Parker, one of the developers, addressed the Commission and explained -the proposal. Commission discussion followed. A MOTION WAS MADE BY SLATES AND SECONDED BY TOM TO APPROVE TENTATIVE TRACT MAP NO 6954 UPON THE FOLLOWING CONDITIONS AS AMENDED: 1. The Tentative Map received May 6, 1969, shall be the approved, layout. -1- 5/6/69 - PC Minutes: H.B. Planning Commission Tuesday, May 6, 1969 Page No. 2 2. The water and fire hydrant systems shall be approved by the Department of Public Works and Fire Department. 3. The flood control channel shall be fenced to Flood Control District Standards. 4. A permit shall be obtained from the Orange County Flood Control District for any work within the Talbert Channel right-of-way. 5. A six foot high masonry wall shall be constructed along that portion of the subdivision where rear lot lines abut the school site. 6. All utilities shall be installed underground. 7. All existing oil wells within the subdivision shall be abandoned and removed in accordance with the requirement of the City Oil Code and the State Division of Oil and Gas, or the lots upon which oil wells are located shall be improved in a manner compatible with the proposed residential development, enclosed with a 6 ft. high masonry wall and landscaped. A precise plan showing the location and type of oil facilities, the wall location and proposed land— scaping shall be submitted to the Planning Commission for approval prior to issuance of building permits. Wall locations shall conform to the requirements of the R-1 Zone and provisions shall be made for permanent maintenance of the landscaping. 8. Masonry wall shall be constructed to City 4pecifizatibns along lots siding or backing onto arteri al -highways, --Said wall - shall be 6 inches wide and 6 ft. high: The height of said wall shall be measured from whichever side is higher at finished grade. The architectural design shall be approved by the Planning Department. Structural design shall be approved by the Department of Public Works. 9. Streets trees shall be provided to City Standards with 15 gallon trees on all local streets and 20 inch box trees on all arterial highways. The type and placement of such trees shall be approved by the Department of Public Works and Planning Department. (On - site trees shall conform to the requirements of the Subdivision Ordinance.) 10. The architectural design of the perimeter wall and the type and placement of street trees shall create unity grid interest in the street scene. 11. The intersection of "K" Street and "E" Avenue shall be knuckled in compliance with the requirements of the Department of Public Works. 12. The "Not A Part" parcel shall be fully improved._as a'numbered lot in the subdivision or a Division of Land application separating this parcel from the remaining property held under the same owner- ship shall be filed with the Board of Zoning Adjustments, approved and recorded prior to submitting a final map to the City Council for approval. 13. The existing oil storage tanks shall be removed and if a storage tank site or tank facilities are proposed within the "Not A Part" parcel, a precise plan of such facility shall be submitted to the Planning Commission for approval prior to issuance of building permits. 14. A petition for rezoning to R-1 and to remove the "0" designation from property not planned for oil operations shall be filed approximately at the time the final map is submitted to the City Council for approval. -2- 5/6/69 - PC Minutes: H.B. Telephone conduit shall be stubbed from' -the rearest telephone vault to the northwest corner of Atlanta Ave and Bus_hard St to facilitate installation of a fire alarm box. 16'. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. ZONE CASE NO 69-6 - Continued Applicant - Nathan Shapell To allow change of zone from R-A to R-3. Located on the south side of Adams Avenue, 960 feet west of Brookhurst Street. Secretary. Bernard McCune, S & S Construction -Co., addressed the Commission and discussed the need for apartments in the area.- The following property owners addressed the Commission and opposed the request: Dave Ifland, representing the Meredith Gardens Homeowners Association, Edward Kerins and D. McDonald. Mr. Kerins submitted a petition, signed by 561 property owners opposing the change -of zone. Mr. Charles Palmer, representing the H.B. School District addressed the Commission and commented on the R-3 density. A letter submitted by the Shorecrest West Homeowners Assoc., was submitted to the Secretary stating their opposition. closed. A MOTION WAS MADE BY SLATES AND SECONDED BY MILLER TO APPROVE ZONE CASE NO 69-6 FOR THE FOLLOWING REASONS: 1. It has been accepted practice to permit medium density development along arterial highways when adjacent to a large shopping facility. 2. The added population will not adversely effect the Xppulat-ion balance within this quarter section because the 1-4.5 acre.cnmmercial development east of this property was originally proposed for' residential development. 3. This change will not adversely effect the -Master Plan. 4. The additional units will assist in supporting some of the commercial activities in the area. 5. A zoning study of the southeast corner of Adams Avenue and Brookhurst Street resulted in the property -remaining in its C-2 classification. Planning Commission Tuesday, May 6, 1969 Page No. 4 COMMISSIONERS PORTER AND DUKE gave the following reasons for voting against the request: 1. By no means does 20 dwelling units per acre constitute low density development as master planned. 2. Recent actions before city bodies indicate that residents favor abutting commercial use as o posed to multiple dwellings. (Terry Drive and Beach Blvd. 3. Additional multiple dwellings in the vicinity of Brookhurst Street and Adams Avenue will result in a disproportionate bunching of apartment units in one area. 4. The request, if approved, constitutes spot zoning. It is not a true buffer to commercial because it does not wholly divide C-4 and R-1. 5. Tax assessments and school population must be an indication for weighing zoning. 6. Several studies have been performed by the Staff, School Board and public groups all using the same input. The results in each study have been different; therefore, it may be advisable for the,City Council to do an indbpendent study based on population and school enrollment in different zones. COMMISSIONER TOM: Commissioner Tom was excused at 9:10 P.M. from further participation. ZONE CASE NO 69-11 Applicant - Edith M Anderson Change of zone from R-A-O Residential Agricultural District combined with oil production to M-1 Light Industrial District. Located on the north side of Garfield Street, 150 ft. west of Stewart Street. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. Mary Reynolds, 201 - 10th Street, Huntington Beach, addressed the Commission and commented on the proposal. Mrs. Reynolds -spoke in favor of the request. There being no other comment, the hearing was closed. The Acting Secretary informed the Commission that the property fronting on Golden West Street and Garfield Avenue was zoned R-A rather than industrial by the Planning Commission in April 1965, because the future of the surrounding property was unknown. Mr. Harlow stated that since that time, the alignment of the Coast Freeway has been determined and the City is in process of performing extensive land use studies as well as an economic base study of the City and Mid -Beach Development Area. Preliminary results of these studies indicate that the property is best suited for industrial use. Mr. Harlow informed the Commission that the results of the Economic Study and translation into land use data will be presented --to the Commission and City Council on May 12, 1969. CONDITIONAL EXCEPTION NO 69-15 Applicant - Wm. Lyon Development Co To permit the following: 1. Carports to be constructed on property line -in lieu -of the required 5 ft. setback; and., -- 2. Allow three story structures to be located on portions of parcel as permitted under provisions of proposed Code Amendment No. 69-4. Located on the west side of Brookhurst St. approximately 660 ft. south of Hamilton Ave. - The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. John Van Daele, representing the -applicant, addressed the Commission and explained- the-- equest:--- Mr. McDonald, 6382 Santa Inez Drive, Huntington:ffe66E=-addressed-the Commission and stated that he was concerned with -vandalism in the area. - was closed. There being no other comment, the hearing Commission discussion followed. A MOTION WAS MADE BY MILLER AND SECONDED BY PORTER TO APPROVE CONDITIONAL EXCEPTION NO 69-15 UPON THE FOLLOWING CONDITIONS: 1. The wall of the carports having the zero setback shall be of maintenance free masonry construction.- The --maximum height of said carport wall shall be 8 feet. 2. All provisions of Code Amendment No. 69-4 dated May 6, 1969, shall be complied with. 3. A Use Permit application for the apartment complex shall be approved by the Board of Zoning Adjustments. AND FOR THE FOLLOWING REASONS: 1. That portion of the request to allow carports to be constructed on the propert;r line is reasonable -as carports so constructed will eliminate a 5 ft. strip of land between the carport and propPrt'v line which generally results in a trash collection area'to the detriment of abutting properties, also it will provide for better separation between uses. 2. The portion of the request for three-story buildings in accordance with the provisions of Code Amendment No. 69-4 also appears reason- able as such construction will provide more open space within the project, also the required 85' setback within said code amendment will afford a much better separation between such 3 story con- struction and adjacent Rl properties. -5- 5/6/69 -PC Minutes: H.B. Located on the west side of Golden West Street, approximately 320 feet north of Ellis Avenue. The Acting Secretary read a letter sub- mitted by the -Southern California Edison Co., requesting a continuance of Conditional Exception No. 69-16 to June 3, 1969. The hearing was opened to the audience, there being no comment, the hearing was closed. A MOTION WAS MADE BY MILLER AND SECONDED BY SLATES TO CONTINUE CONDITIONAL EXCEPTION NO 69-16 TO JUNE 31 1969, AT THE REQUEST OF THE APPLICANT. COMMUNICATION: The Acting Secretary read a letter submitted by the Huntington Beach City School District requesting approval of School Sites #6, #81 #91 #10, and #12. PROPOSED CODE AMENDMENT NO 69-7 Article 979 - Off-street Parking The Commission reviewed a proposed amend- ment to Article 979, Off -Street Parking requirements which would add. commercial parking lots or structures, landscaping within 5 ft. of a public right-of-way and requirement of a concrete curb on all exterior boundaries of landscaped areas. PROPOSED CODE AMENDMENT NO 69-2 PLANNED RESIDENTIAL DEVELOPMENT The Acting Secretary informed the Commis- sion that Code Amendment No 69-2 was referred back to the Commission by the City Council for further review with the possibility of estab- lishing a minimum lot area on waterfront lots within planned residential developments in the R-1 Zone. The Commission amended said Code Amendment by adding provisions to require recreation area to be integrated with the dwelling -units and to be of an adequate size to allow proper utili- zation of such open space. It also added provisions that will exclude areas used solely by the resident of an individual dwelling unit from the required recreation and leisure areas, and established minimum lot sizes for lots similar to those found in standard subdivisions. It was the consensus of the Commission that these changes will accomplish the request of the City Council and eliminate the possibility of substandard single family developments and to recommend approval of the revision to Code Amendment No. 69-2 by the City Council. The Commission further discussed the need for a public hearing when a site plan is reviewed for such developments. It was noted that Section 9891.3 provides the Commission the opportunity of holding a public hearing when they so desire. A MOTION WAS MADY BY SLATES AND SECONDED BY MILLER TO REQUIRE A PUBLIC HEARING ON ALL PLANNED RESI- DENTIAL DEVELOPMENTS WHEN SUCH DEVELOPMENTS ARE PROPOSED ALONG ANY PUBLIC WATERWAYS OR WATERWAYS PROPOSED FOR PUBLIC USE. A MOTION WAS MADE BY PORTER AND SECONDED BY BOKOR TO RECOMMEND APPROVAL OF CODE AMENDMENT NO 69-2 - PLANNED RESIDENTIAL DEVELOPMENT AS AMENDED BY THE CITY COUNCIL. PROPOSED CODE AMENDMENT NO 6974 HEIGHT LIMITS The Acting Secretary informed the Commis- sion that Code Amendment No. 69-4 Height Limits was referred back to the Commission for further review with the possibility of permitting three-story dwellings in the R-1 District. -7- 5/6/69 , - PC Minutes: H.B. Planning Commission Tuesday, May 6, 1969 Page No. 8 It was the unanimous recommendation of the Commission to amend the proposed code amendment by permitting three-story structures in the R-1, R-2, and R-3 Zones. Changes agreed to are as follows: 1. Three-story dwellings in the R-1 Zone provided the three- story buildings are setback 100 ft. from the boundary of such development, and 2. Three-story buildings in the R-2 and R-3 Zone provided the three-story buildings are setback 100 ft. from an abutting R-1 development. A MOTION WAS MADE BY BOKOR AND SECONDED BY PORTER TO RECOMMEND APPROVAL OF THE REVISION TO CODE AMENDMENT NO 69-4 BY THE CITY COUNCIL. COMMUNICATION: The Acting Secretary read a letter submitted by Mr. George Shibata, requesting that the Planning Commis- sion consider Tentative Tract Map No. 6874 and Conditional Exception . No. 69-5 at their May 20, 1969, meeting. The Commission reviewed the request. A MOTION WAS MADE BY PORTER AND SECONDED BY DUKE THAT NO FURTHER ACTION BE TAKEN ON EITHER MATTER UNTIL A NEW MAP HAS BEEN SUB- MITTED AND THE MATTER DISCUSSED AT A SUBDIVISION COMMITTEE MEETING. INFORMATION: The Acting Secretary informed the Commission that a meeting will be held on May 12, 1969, at 7:00 P.M, in`.the Adminis- trative Annex pertaining to the Mid -Beach Economic Study. INFORMATION: The Acting Secretary informed the Commission that the City Council has authorized one Commissioner to attend the ULI Conference in Miami Beach on May 18 through 22.
