Wednesday, May 14, 1969 BOARD MEMBERS PRESENT: McFarland, Cook, Palin BOARD MEMBERS ABSENT: None MINUTES: April 23, April 30, 1969, were accepted as transcribed. USE PERMIT NO. 69-24 (Continued) Applicant: Thomas Bernatz To permit the construction of a family restaurant in the C-4 Highway Commercial District. Located on the west side of Beach Blvd., approximately 480 ft. north of Warner Ave. A legal description is on file in the Planning • Department Office. The hearing was opened to the audience. Don Jones, representing the applicant, Thomas Bernatz and Ken Johnson addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 69-24 WITH THE FOLLOW- ING CONDITIONS: 1. Beach Blvd. shall be fully improved to City and State stan- dards. Improvements shall include street trees, street signs, street lights, fire hydrants and sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assess- ment district. 6. Soil reports as required by the Building Department and Department of Public Works to the City prior to issuance of building permits. i 7. All utilities shall be installed underground. 8. Off-street parking facilities shall conform to Article 979. 9. All applicable City Ordinances shall be complied with. 10. Driveway locations shall be approved by the Traffic Engineer. 11. Approval is limited to the revised plan received May 14, 1969. USE PERMIT NO. 69-25 Applicant: Bill Maxey Toyota, Inc. To permit the construction and opera- tion of a body shop in conjunction with an existing automobile agency in the C-4 Highway Commercial District. Located on the west side of Beach Blvd., 300 ft. north of Garfield Ave. Legal description on file in the Planning Department Office. The hearing was opened to the audience. -1- Minutes: H. B. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE USE PERMIT NO.69-25 WITH THE FOLLOWING CONDITION: 1. All applicable conditions of the previously approved Use Permit No. 68-5 and all City ordinances shall be complied with. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None ABSENT: None THE MOTION CARRIED. USE PERMIT NO. 69-26 Applicant: Marion Archer To permit the construction of a muffler shop in the C-4 Highway Commercial District. Lo- cated west of Beach Blvd., 75 ft. north of McDonald St. Legally described as Lots 116, 117, 118, of Tract No. 417. The hearing was opened to the audience. Ms. Archer addressed the Board and answered various questions. It was noted by the Acting Secretary that the applicant should check location of the private water easement and that the structure should not be built over such water easement. Also, no truck repair or body work will be allowed at this location and that the ap- proval is for muffler shop only. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY COOK AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 69-26 WITH THE FOLLOWING CONDITIONS: 1. Beach Blvd. shall be fully improved to City and State standards. Improvements shall include street trees, street signs, street lights, fire hydrants and sewer and water main extensions. 2. CONDITIONAL EXCEPTION NO. 69-32 Applicant: Sterling Building Design To permit a cantilevered balcony to be constructed 3 ft. into the rear property setback in the R-1 Single Family Residence District. Located on the west side of Carousel Lane approximately 475 ft. northwest of property line of Wanderer Lane. Legally described as Lot 140, Tract 5481. The hearing was opened to the,., ! audience. Ms. Martin addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 69-32 FOR THE FOLLOWING REASON: 1. A code amendment is currently in process to allow this type of construction into the rear yard where such dwelling abuts permanent open space. CONDITIONAL EXCEPTION NO. 69-33 Applicant: Tom & Truskier Arch., AIA To permit the construction of a covered balcony to encroach to within 4 ft. into the required 10 ft. setback in the R-1 Single Family Residence District. Located at 16575 Ensign Circle approximately 169 ft. south of Humboldt Dr. Legal description on file in the Planning Department Office. The hearing was opened to the audience. There being no one present to repre- sent the applicant and no comment from the audience, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY COOK TO APPROVE CONDITIONAL EXCEPTION NO. 69-33 FOR THE FOLLOWING REASON: 1. The Planning Commission and the City Council have approved a code amendment that will permit this type of construction when such dwelling abuts permanent open space. A MOTION WAS MADE BY MCFAR- LAND AND SECONDED BY PALIN TO CONTINUE USE PERMIT NO. 69-27 TO JUNE 4, 1969, TO ALLOW THE APPLICANT TIME TO SUBMIT A REVISED TENTATIVE TRACT MAP TO THE CITY FOR APPROVAL. ADMINISTRATIVE REVIEW NO. 69-10 Applicant: Four Seasons Homes To permit garages entered directly from the street to set back 72 ft. on lots.l,'6, 14, 21, 75 and 77 of Tract 6322 as provided for in the Huntington Beach Ordinance Code, in the R-1 Single Family Residence Dist- rict. Located on the north of Indianapolis Ave. and west of Bushard St. Mr. W. G. Long, the appli- cant, addressed the Board and answered various questions. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 69-10 FOR THE FOLLOWING REASON: 1. The applicant has increased the number of garages entered directly from the street with a 72 ft. setback to 6 of the 36 lots within the first unit of Tract No. 6322 and this request is within the intent of the ordinance.
