Acting Secretary. Mr. Harlow informed the Commission this item
had been continued from the May 6th meeting to allow the Planning
Commission to have the results of the economic base study which
was presented on May 12, 1969.
The hearing was opened to the
audience, there being no comment, the hearing was closed.

ZONE CASE NO 69-12

Change of zone from R-1 Single
Family Residence District to R-3 Limited Multiple Family Residence
District.
Located 400 ft. south of Warner
Avenue, 660 feet west of Edwards Street.
The Staff Report was read by the
Acting Secretary.
COMMISSIONER DUKE: Commissioner Duke arrived and assumed his duties.
The hearing was opened to the
audience.
Evan Murphy, representing the
applicant, addressed the Commission and explained the proposal.
Three persons representing the Sol Vista Homeowners Assoc.,
Beach -North Homeowners Assoc., and Franciscan Fountains Homeowners
Assoc., opposed the request. A petition signed by 410 property
owners, opposing the request was filed with the Acting Secretary.
An adjacent property owner objected to the proposed alignment of
Summerdale Street.
There being no further comment,
the hearing was closed.
Commission discussion was held.
It was noted that park fees for the entire apartment complex would
be approximately $29,000 and $8,000 for the single family area.
A MOTION WAS MADE BY DUKE TO DENY
ZONE CASE NO 69-12. THE MOTION WAS LOST FOR LACK OF SECOND.
A FURTHER MOTION WAS MADE BY
MILLER AND SECONDED BY PORTER TO APPROVE ZONE CASE NO 69-12 FOR
THE FOLLOWING REASONS:
1. This plan is the result of several different layouts that were.
worked out by the developer,'. the staff and the Subdivision
Committee in an attempt to:
a. Provide a transition between the existing R-3 to the
west and the single family development within Tentative
Tract Map No. 6933•
b. Align Summerdale St. so as to discourage through traffic
and still provide traffic circulation within the area,
and,
c. Provide sufficient access and street frontage for the
park site.
2. A hardship exists on the property because of its relationship
to existing R-1 to the west and R-3 property to the east. The
development will be a credit to the City.

3. This reqeust does not constitite spot zoning.
4. A condition of approval on Tentative Tract Map No. 6933 required
the applicant to submit a petition for rezoning the subject
--
parcel to R-3 prior to the time the final map is submitted
to the City Council for acceptance.
5. This request will not significantly effect the Master Plan.
6. To vote against this request will result in a poor plan.

COMMISSIONER DUKE: Commissioner Duke gave the following`ress n -for-
voting against the request:
l.- The request, if approved, constitutes spot zoning.
2. Due to a difference between the R-3 depth to the north and
the R-3 to the west, there is sufficient depth for R-1 lots
to front on the north side of Summerdale Street, thereby
separating the park from the apartments.
3. The R-3 zone is not a true buffer adjacent to a park site.
4. There is no definite hardship between the relationsh-ip,:o
R-1 and R-3.
5. A park site has its highest and best use when adjacent to
single family homes and not when such site is adjacent to an.
adult community.

Commission that this zone case and the next item on the agenda -
Zone Case No. 69-14 are in the same area and should be discussed
in conjunction with each other. Mr. Harlow suggested that both
items be open to the audience.
The hearing was opened to the
audience on Zone Case No. 69-13 and Zone Case No. 69-14.
William Bray, applicant, addressed
the Commission and explained his request pertaining to Zone Case
No. 69-14,James DeGuelle, applicant, addressed the Commission and
stated his reasons for his request on Zone Case No. 69-13.
There being no other comment,
the hearing was closed.

COMMUNICATION: The Acting Secretary read a letter submitted by
William D. Lusk, requesting the Planning Commission
to initiate a resolution of intent to amend the Master Plan of Land
Use to provide a balance of land use to include residential
and commercial as an integral part of the Huntington Beach indus-
trial Park.
The Commission discussed the request. It was the
unanimous decision not to initiate an amendment to the Master Plan,
The letter was received and ordered filed.
COMMUNICATION: The Acting Secretary read a letter submitted by
the Huntington Harbour Property Owners Assoc.,
stating their concern about the future development of Huntington
Harbour as it relates to a minimum square footage for each single
family dwelling and, that the proposed Planned Residential Ordinance
include a requirement -that all owners of property within 300 ft. of
any such development be notified.
The letter was received and ordered filed.
PROPOSED REVISION TO STANDARD CONDITIONS
OF APPROVAL FOR TENTATIVE TRACTS
The Commission reviewed a proposed
revision to the Standard Conditions of Approval for Tenetative Tracts.
A MOTION WAS MADE BY DUKE AND
SECONDED BY TOM TO ADOPT THE FOLLOWING STANDARD CONDITIONS OF APPROVAL
FOR TENTATIVE TRACTS:
1. Access rights along all arterial highways, except at street
intersections, shall be dedicated to the City of Huntington
Beach.
2. Sewer and water systems shall be constructed by the developer
and dedicated to the City of Huntington Beach.
3. Water supply shall be through the City of Huntington Beach's
water system.
4. The water and fire hydrant system shall be approved by -the
Dept. of Public Works and Fire Dept.
5. Sewage disposal shall be through the City of Huntington Beach's
sewage system.
6. All streets shall conform to City of Huntington Beach Standards.
7. Street sections shall be determined by soil "R" value and_
traffic index.
8. Street trees shall be provided to City Standards with 15 gallon
trees on all local streets and 20 inch box trees on all arterial
highways. The type and placement of such trees shall be
approved by the Dept. of Public Works and Planning Dept. (On -
site trees shall conform to the requirements of the Subdivision
Ordinance.)
9. Masonry walls shall be constructed to City Specifications along
lots siding or racking onto arterial hi hways. Said wall shall be
at least six (6) inches`wide and six (65 feet high. The height
of said wall shall be measured from whichever side is higher
at finished grade. The architectural design of said wall shall
be approved by the Planning Dept. Structural design shall be
approved by the Dept. of Public Works.

10. The architectural design of the perimeter wall and the type
and placement of street trees shall create unity and interest
in the street scene.
11. Street lighting shall be provided to City Standards.
12. Sub -surface water rights shall be deeded to the City of
Huntington Beach.
13. Drainage of the subdivision shall be approved by the Director
of Public Works prior to final recordation of any part of the
approved tentative subdivision.
14. Said property shall participate in the local drainage assessment
district.
15. All buildings on lots abutting a City easement shall be set
back 5 feet from the edge of such easement.
16. Retaining walls may be required by the Building Department
where there is a difference in elevation of one (1) foot
between adjoining lots or lots abutting City right-of-way.
Determination of this requirement shall be made at the time
grading plans are approved.
17. Preliminary and final soil reports shall be submitted by an
approved private soils engineer to Department of Public
Works prior to issuance of building permits_
18. Right-of-way for street widening on all parcels not included
within the proposed subdivision, held under the same ownership
as the subdivision, shall be dedicated to the City of Huntington
Beach and fully improved. This -provision shall not apply to
property upon which a division of land has been approved by the
City, recorded, and all conditions of approval have been
fulfilled.
19. Fire alarm system conduit and appurtenances shall be installed
by the developer at locations and to specifications provided
by the Fire Department.
20. A masonry wall shall be constructed to City Specifications
along lots siding or backing onto property zoned or intended
to be zoned for professional, commercial or industrial use.
Said wall shall be six (6) feet high, constructed of at least
six (6) inch block and shall be located on the property zoned
or intended to be zoned for professional, commercial or industrial
use. The height of said wall shall be such that the top will
be six (6) feet above the highest ground surface within twenty
(20) feet of the common property line on the professional -
commercial or industrial side of the wall. Measurement -shall
be taken at any given point along said wall. This requirement
shall pertain to all parcels; including numbered lots, those
labeled "Not A Part" and/or those parcels not within the
subdivision but held under the same ownership as the property
being subdivided.
21. All utilities shall be installed underground.
22. A six (6) ft. high masonry wall shall be constructed along
any lot line separating the subject tract from any school
site, park site or other public property as determined by
the Planning Department. The height of said wall shall be
measured from whichever side is higher at finish grade.
