USE PERMIT NO. 69-28
Applicant: Joe Evans
To permit the construction of a
restaurant and required parking facilities in the C-4 High-
way Commercial District. Located on the northwest corner
of Beach Blvd. and Aldrich'St. Legally described as lots
11, 12, 13, 33 of Tract 417.
The hearing was opened to the audience.
Mr. Stevens, owner of property, and
Joe Evans, representing Mr. Stevens, addressed the Board and
answered various questions.
There being no further comment, the
hearing was closed.

A MOTION WAS MADE BY MCFARLAND AND
SECONDED BY PALIN TO APPROVE USE PERMIT NO. 69-28 WITH THE
FOLLOWING CONDITIONS:
1. Beach Blvd. and Aldrich St. shall be dedicated and fully
improved to City and State standards at the time the par-
cel is developed. Improvements shall include street trees,
street signs, street lights and fire hydrants, sewer and
water main extensions.
2. A bond shall be posted with the Department of Public Works
to guarantee installation of water facilities along Beach
Blvd.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
4. The water, sewer, and fire hydrant system shall be ap-
proved by the Department of Public Works and Fire Depart-
ment.
5. The property shall participate in the local drainage
assessment district.
6. Preliminary and final soil reports shall be submitted by
an approved private soils engineer to the City prior to
issuance of building permits.
7. All utilities shall be installed underground.
8. Fire alarm system conduit and appurtenances shall be in-
stalled by the developer at locations and to specifications
provided by the Fire Department.
9. 'Off-street parking facilities shall conform to Article 979.
10. Parking compounds shall be screened with a combination of
fencing and landscaping. Said Plan shall be approved by
the Planning Department.
11. No structures, other than those shown on the approved plot
plan, shall be constructed within the project.
12. All applicable City Ordinances shall be complied with.
13. Driveway widths and locations shall be approved by the
Traffic Engineer.

USE PERMIT NO. 69-29
Applicant: Surf Construction Co.
To permit the construction
of a 336 unit apartment complex on a 917 acre parcel of land
in the R-3 Multiple Family Residence District. Located on the
south side of Ellis Ave., 660 ft. to 990 ft. east of Beach Blvd.
Legal description on file in the Planning Department Office.
In Conjunction With
CONDITIONAL EXCEPTION NO. 69-34
Applicant: Surf Construction Co.
To permit the construction
of carports at 110" setback on interior side property lines in
lieu of the required 5 ft. setback in the R-3 Multiple Family
Residence District. Location and legal description same as above.
The hearing was opened to
the audience on Use Permit No. 69-29 and Conditional Exception
No. 69-34.
Dick Croul, representing the
applicant, addressed the Board and answered various questions.
Rev. De Lang questioned the
construction of the wall on the east property line. Rev.DELang
represents the church adjacent to this property.
There being no further com-
ment, the hearing was closed.
A MOTION WAS MADE BY MCFARLAND
AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 69-29 WITH THE
FOLLOWING CONDITIONS:
1. Ellis Ave. shall be dedicated and fully improved to City
standards at the time the parcel is developed. Improve-
ments shall include street trees, street signs, street
lights and fire hydrants, sewer and water main extensions.
2. Water supply shall be through the City of Huntington Beach's
water system.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
4. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
5. The property shall participate in the local drainage assess-
ment district.
6. Preliminary and final soil reports shall be submitted by
an approved private soils engineer to the City prior to
issuance of building permits.
7. All utilities shall be installed underground.
8. Fire alarm system conduit and appurtenances shall be in-
stalled by the developer at locations and to specifica-
tions provided by the Fire Department.
9. A lighting system shall be installed within the project
equal in illumination to lighting on public streets. A
lighting plan shall be submitted to the Department of
Public Works for approval.
10. All private streets shall meet the minimum standards for
planned residential developments as adopted by the Plan-
ning Commission.
11. The structural street section of all private drives shall
be approved by the Department of Public Works.
12. A masonry wall shall be constructed along the east and
west property line. The height of said wall shall be
such that the top will be six (6) feet above the highest
ground surface within twenty (20) feet of the common
property line.

13. There shall be no fence, structure, or landscaping
constructed or maintained over 32 ft. high within a
10 ft. x 10 ft. triangular area at the intersection
of driveways and streets or within a 25 ft.x 25 ft.
triangular area at the intersection of streets.
14. No structures, other than those shown on the approved
plot plan, shall be constructed within the project.
15. Driveway widths, locations and design shall be approved
by the Traffic Engineer.
16. All applicable City Ordinances shall be complied with.

A MOTION WAS MADE BY MCFARLAND AND
SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO.69-34
WITH THE FOLLOWING CONDITION:
1. That an 8 ft.high maintenance free masonry wall shall
be constructed on the east property line and that an
8 ft. high maintenance free masonry wall shall be con-
structed on the west property line where such carports
abut the property line. The developer may elect to
reduce said wall to a 6 ft. height between the carports.

USE PERMIT NO. 69-33
Applicant: Jerry J. Galich
To permit the construction of a
carport as provided for by Section 9106 of the Huntington
Beach Ordinance Code in the R-1 Single Family Residence
District. Located on the north side of Tenth Street approxi-
mately 150 ft. west of Lake St. Legally described as lots
11 and 13 of Tract 910.
The hearing was opened to the
audience.
Mr. Galich, applicant, addressed
the Board and answered various questions. The Acting Secre-
tary informed the applicant the accessory building at rear
of subject property could never be used as required parking
for this use.
There being no further comment,
the hearing was closed.

CONDITIONAL EXCEPTION NO. 69-35
Applicant: Rosil Co., Inc.
To permit the placement of a
freestanding identification sign having an area of 337 sq. ft.
in lieu of the maximum 200 sq. ft. and a height of 53 ft.
6 inches in lieu of the maximum 50 ft. height allowable within
the 50 ft. setback in the C-2 Community Business District.
Located on the northwest corner of Warner Ave. and Golden
West St. Legal description on file in the Planning Depart-
ment Office.

questions.

A MOTION WAS MADE BY
MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL
EXCEPTION NO. 69-35 WITH THE FOLLOWING CONDITION:
1. The applicant shall comply with the 50 ft. height limit
permitted in the district.
FOR THE FOLLOWING REASON:
1. The City is processing a sign ordinance that will allow
the sign area as requested.

CONDITIONAL EXCEPTION NO. 69-36
Applicant: Kavanauzh-Beard
To permit the construction
of an apartment building to within 8 ft. of the front property
line in lieu of the required 10 ft. setback on lot No. 2, Tract
6650 in the R-3 Multiple Family Residence District. Located
on the north side of LaMancha Circle and east side of Bardon
Lane, west of Gothard St.

A MOTION WAS MADE BY PALIN
AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION
NO. 69-36 FOR THE FOLLOWING REASON:
1. In order for the applicant to construct units on Lot 2,
Tract 6650 having a 10 ft. utility easement and because
of the shape of such knuckle lot, it is a necessity that
the structure be constructed with an 8 ft. front yard
setback to maintain the required 5 ft. setback from such
easement and other required setbacks. Such encroachment
is only for a distance of 2 ft. and for a width of 5 ft.

Applicant: Wm. Lyon Development Co.
To permit the construction of fully
ventilated carports within the interior of a 256 unit apart-
ment complex in lieu of the required three fully enclosed
sides in the R-3 Limited Multiple Family Residence District.
Located on the southeast corner -of Edwards St. and Warner
Ave. Legal description on file in the Planning Department
Office.
The hearing was opened to the
audience.
John Van Daele, representing the
applicant, addressed the Board and answered various questions.

hearing was closed.

A MOTION WAS MADE BY MCFARLAND AND
SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 69-39
WITH THE FOLLOWING CONDITION:
1. The applicant shall submit a revised plan to the Board
for review prior to the issuance of building permits
delineating required storage areas and a combination of
landscaping and fencing at the ends of the open carports.

Applicant: Wm. Lyon Development Co., Inc.
To permit the construction of a 448
unit apartment complex on 18.23 acres of land within the R-3
Limited Multiple Family District. Located on the west side
of Brookhurst St. approximately 600 ft. south of Hamilton
Ave: Legal description on file in the Planning Department Office.

CONDITIONAL EXCEPTION NO. 69-40
Applicant: Wm. Lyon Development Co., Inc.
To permit the construction of fully
ventilated carports within the interior of a 448 unit apart-
ment complex in lieu of the required three fully enclosed
sides in the R-3 Limited Multiple Family Residence District.
Location and legal description same as above.
The hearing was opened to the audience.
John Van Daele, representing the ap-
plicant, addressed the Board. As there were numerous home
owners present interested in this development, Mr. Van Daele
made a presentation on the apartment complex, explaining the
development and answering numerous questions.
It was noted by the Acting Secretary
that Conditional Exception No. 69-15 was appealed to the
City Council for three story building and 110" setback of car-
ports within this development. ,
Ronald Ritz, spokesman for the adjacent
homeowners, objected to the three story units being so close
to the R-1 homes. He suggested it would be more desirable to
the homeowners if these particular units could be moved more
toward the center of the development. They feel their pri-
vacy would be infringed on, and that the transition could be
improved on.
Branton Bennett also voiced opposi-
tion to the three story units so close to the single family
residences, feeling they would lose their privacy.

Mr. Van Daele agreed with
the homeowners to continue the item for a week so that an
alternate plan might be submitted to see whether it would
indeed be feasible to relocate the three story units.
It was noted that present
plans as submitted are well within the code of the City.

MCFARLAND AND SECONDED BY PALIN TO CONTINUE USE PERMIT
NO. 69-31 and CONDITIONAL EXCEPTION NO. 69-40 TO THE MEET-
ING OF MAY 28, 1969, TO GIVE THE APPLICANT TIME TO SUBMIT
AN ALTERNATE PLAN FOR REVIEW.
