Lyon Development Co., Inc. -Continued To permit the construction of a 448 unit apartment complex on 18.23 acres of land within the R-3 Limited Multiple Family District. Located on the west side of Brookhurst St. approximately 600 ft. south of Hamilton Ave. Legal description on file in the Planning Department Office. In Conjunction With CONDITIONAL EXCEPTION NO. 69-40 Applicant: Wm. Lyon Development.Co., Inc. -Continued To permit the construction of fully ventilated carports within the interior of a 448 unit apart- ment complex in lieu of the required three fully enclosed sides in the R-3 Limited Multiple Family Residence District. Location and legal description same as above. The hearing was opened to the audience. John Van Daele, representing the appli- cant, addressed the Board. The Board asked him to explain his alternate plan to those homeowners in the audience who opposed the three-story structures abutting their property. He ad- vised that if the three story units were moved to the center of the complex then a 45 ft. setback would be maintained for two story structures on the west property line in lieu of the 85 ft. setback of the three story units. He further stated that in order to maintain their rent structure, the recreation areas and aesthetic values would have to be maintained and this may not be feasible with the changes as suggested by the adjacent homeowners. Mr. Van Daele pointed out the car- ports along the perimeter of the complex would not be desirable or compatible in a high quality development as shown on the alternate plan. Mr. Wilson and Mr. Bennett spoke for the homeowners and thought the carports along the perimeter would help to protect their privacy. The Board Chairman noted that a written statement by the homeowners would be required stating their requirements before the appeal on Conditional Excep- tion No. 69-15 could be withdrawn and if withdrawn, they would not be able to file an appeal again for the same item. There being no further comment, the hearing was closed. Board discussion followed. Lo- cated on the east side of Pacific Coast Highway 500 ft. approxi- %/mately north of Warner Ave. Legal description on file in the Planning Department Office. There was no one present to represent the applicant. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALINCTO APPROVE DIVISION OF LAND NO. 69-14 WITH THE FOLLOWING CONDITIONS: 1. Pacific Coast Highway and the proposed street shall be dedicated and fully improved to City and County stan- dards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights and fire hydrants, sewer and water main extensions. 2. Street sections shall be determined by soil "R" value and traffic index. 3. Water supply shall be thicough the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. S. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Easements for utilities or walkways shall be provided to Department of Public Works Standards. 7. The property shall participate in the local drainage assessment district at the time each parcel is developed. 8. All utilities shall be installed underground at the time each parcel is developed. 9. Fire alarm system conduit and appurtenances shall be in- stalled by the developer at locations and to specifications provided by the Fire Department. 10. A Parcel Map shall be filed with the City and recorded prior to framing inspection on any parcel. 11. The Division of Land shall not be effective until an agree- ment is signed and recorded agreeing to the conditions listed above. Opdahl To allow additional height to an existing slump stone wall to 8 ft. between an R-1 Single Family dwelling and a condominium developemnt with a pedes- trian access to a slip area being immediately adjacent to such wall. Located on the north side of Morning Star Dr. approxi- mately 100 ft. west of Harbour Lane. Legally described as Lot 90 of Tract 5360. to the audience. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY COOK TO APPROVE CONDITIONAL EXCEPTION NO. 69-42 WITH THE FOLLOWING CONDITION: 1. The required 15 ft. front yard setback shall be maintained. AND FOR THE REASON: 1. The proposed fence addition will provide the desired separation between a single family residence and a multiple family residence. Baumel To permit the construction of a 4 ft. balcony into the required 10 ft. rear yard setback in the R-1 Single Family Residence District. Located at 4989 Mistral Dr., north side of the street. Legally described as Lot 58, Tract 5481. The hearing was opened to the audience. There was no one present to repre- sent the applicant and there being no further comment, the hearing was closed. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assessment district. 6. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 7. All utilities shall be installed underground. 8. To permit the construction of a room addition between the main dwelling and:'detached garage causing a reduction in the required rear yard setback to 5 ft. in lieu of the required 10 ft. setback. Also to allow a re- duction in the minimum dimension for open space from 25 ft. to 19.5 ft., on a lot recorded prior to the effective date of Ordinance 1469, March 19, 1969, in the R-1 Single Family Residence District. Located at 8702 Squires Circle, legally described as Lot 60, Tract 5575. The hearing was opened to the audience. Dick Maddux, representing the applicant, addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY COOK TO APPROVE CONDITIONAL EXCEPTION NO. 69-38 FOR THE FOLLOWING REASON: 1. The proposed room addition will not cause a reduction in the rear yard setback as such addition is proposed between the main dwelling and detached garage. Open spaces are adequately provided for. To permit an additional height to 12 ft. of a wire cyclone type fence, plastic covered, on the north property line from the rear of dwelling to rear property line, in the R-1 Single Family Residence District. Located at 16621 Greenview Lane. Legally described as Lot 2, Tract 6469. The hearing was opened to the audience. Mr. Meine and Mr. Middleton, repre- senting the applicant, addressed the Board and explained their request and answered various questions. Mr. Rowland, adjacent property owner, opposed this request because it would spoil the view of the golf course from his property. Also Mr. Rowland filed a petition with the Acting Secretary opposing said request. Mr. Huston also opposed this request doubting that balls from the golf course would enter the sub- ject property and felt the fence would be unsightly. To permit the construction and operation of a 152 bed, type "L" (long-term psychiatric care) sanitarium on approximately 3.36 acres of land in the R-5 Office Professional District. Located on the south side of Holland Dr. approximately 265 ft. from center line of Beach Blvd. Legal description on file in the Planning Depart- ment Office. In Conjunction With CONDITIONAL EXCEPTION NO. 69-44 Applicant: Major D Corp. To permit a reduction of the required off-street parking spaces for a 152 bed, type "L" sanitarium from 102 parking spaces to 70 parking spaces as shown on the plot plan. The property is zoned R-5 Office Professional District. Location and legal same as above. The hearing was opened to the audience. It was noted by the Chairman that applications of this nature cannot be acted on by the Board`'of Zoning Adjust- ments but must be referred to the Planning Commission for de- cision. Mr. Evans, representing the applicant, addressed the Board. Miss.., Doro'thp Conrad from the audience requested to see the plans. There being no further com- ment, the hearing was closed. The hearing was opened to the audience. Mr. Douglas, Mr. Lincoln and Mr. Stone, representing the applicant, addressed the -Board and answered various questions. Mrs. Schildhauer, from the -audience, addressed the Board and asked to see the plans. She also asked the acreage of the park site adjacent to the school. The Board informed Mrs. Schildhauer the park would be approximately 2.5 acres. There being no further comment, the hearing was closed. Board discussion followed. Improvements shall include street trees, street signs, street lights and fire hydrants, sewer and water main extensions. 2. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Department. 14. A masonry wall shall be constructed along the north and south property lines. No structures, other than those shown on the approved plot plan, shall be constructed within the project until a revised plan is submitted to the Board for review. 17. All applicable City Ordintinces shall be complied with. 18. A Division of Land application, separating this parcel from the remaining property held under the same owner- ship, shall be filed with the City, approved and re- corded prior to framing inspection of any structure. 19.
