TUESDAY, JUNE 3, 1969 COMMISSIONERS PRESENT: Bazil, Bokor, Slates, Miller COMMISSIONERS ABSENT: Duke, Tom, Porter MINUTES: On motion by Miller and seconded by Bokor, the Minutes of the Huntington Beach Planning Commission of March 18, 25, and April 1, 1969, were accepted as transcribed and mailed by the Secretary. CONDITIONAL EXCEPTION NO 69-12 (Continued) Applicant - Atlantic Oil Company To permit the construction of a 15 unit apartment complex in the C-3 General Business District. Located at the southwest corner of 2nd Street and Olive Avenue. The Acting Secretary read a letter submitted by Mary Reynolds, representing the applicant, requesting continuance of Conditional Exception No. 69-12 to June 17, 1969. The hearing was opened to the audience, there being no comment the hearing was closed. A MOTION WAS MADE BY MILLER AND SECONDED BY SLATES TO CONTINUE THE HEARING ON CONDITIONAL EXCEPTION NO 69-12 TO JUNE 17, 1969, AT THE REQUEST OF THE APPLICANT. TENTATIVE TRACT MAP NO 6948 ZONE CASE NO 69-17 Applicant - John D Lusk and Son 376 lots on 351.7 acres. Change of zone from M-1-A Limited Manufacturing District to 100-M-1-A 20,000 and 100-M-1-A 15,000 and to R-3 Limited Multiple Family Residence District and C-4 Highway Commercial District with a 50 ft. setback from the ultimate right- of-way line. Located south of Bolsa Avenue, west of Springdale Street. ROLL CALL VOTE: AYES: Bokor, Slates, Bazil, Miller NOES: None ABSENT: Duke, Tom, Porter THE MOTION CARRIED. ZONE CASE NO 69-17 The Acting Secretary read the Staff Report. The hearing was opened to the audience. William Lusk, applicant, addressed the Commission and explained the need for a mixture,of commercial and residential uses with the primary industrial uses.- Mr. Lusk informed the commission that the approximate tax base for the development would be $6,600 per acre for individual 20,000 sq. ft. lots, $5;000 per acre for individual 15,000 sq. ft. lots, residential $8,000 per acre and $15,000 for commercial portion. Richard Volpert, Attorney, repre- senting the Peck Estate, addressed the Commission and spoke in favor of the request and the need for this type of development in the city. John D. Lusk addressed the Commission and further commented on the need of commercial and industrial uses for the area. The following people addressed the Commission and opposed the Zone Case: John Bolch was opposed because of traffic, location of industrial adjacent to school and that the commercial portion of the request was too great for the area. Richard Hollingshead, Ocean View School District, stating his concern over the loss of the tax base if the R-3 portion of the request was approved. Mr. Bosanko and Mr. McDonald were opposed to the R-3 portion of the request and questioned R-3 adjacent to park sites in the city. Mr. Grizzard addressed the Commission and stated that he was repre- senting 80 homeowners in the Bolsa Park tract. Mr. Grizzard read a petition opposing the request signed by said homeowners. Mr. Martin questioned the small lots in the industrial development. Mr. Braebrick objected to small lots abutting the residential areas and questioned the fact that no buffer was shown on the plot plan between the indus- trial development and the residential to the west. Mr. Al Aello opposed the zone change. Nat Ross informed the Commission that the traffic count at Springdale and Edinger into the shopping center was 4,300 cars per day during the week and 6,800 cars on weekends. Mrs. Doughert addressed the Commission and stated that she would like to see the area develop as she is facing the open field at present time which creates dust. Mrs. Dougherty further stated that the developer should construct what is best for the City of Huntington Beach and that the decision as to what is best for the City should be left to the Planning Commission as they know what is required for a well planned community. COMMISSIONER PORTER: Commissioner Porter arrived at 7:25 P.M. and assumed his duties. The Commission held a lengthy discussion. Each Commissioner stated his opinion regarding the R-3, M-1-A and C-4 request. -2- 6/3/69 - PC Minutes: H.B. Planning Commission Tuesday, June 3, 1969 Page No. 3 A MOTION WAS MADE BY BOKOR AND SECONDED BY PORTER TO DENY THAT PORTION OF THE REQUEST FOR R-3 AND TO CONTINUE THE PUBLIC HEARING ON THAT PORTION OF THE REQUEST FOR C-4 AND R-3 TO JUNE 17, 1969, TO ALLOW IT TO BE CONSIDERED IN CONJUNCTION WITH TENTATIVE TRACT MAP NO 6948. REASONS GIVEN BY THE COMMISSION FOR DENIAL OF THE R-3 ZONE: 1. There is sufficient R-3 in the area to serve the industrial development. 2. The requested R-3 would reduce the prime industrial acreage within the development by 21%. ROLL CALL VOTE: AYES: Bokor, Porter, Miller, Bazil, Slates NOES: None ABSENT: Duke, Tom THE MOTION CARRIED. A MOTION WAS MADE BY PORTER AND SECONDED BY BOKOR TO INSTRUCT THE STAFF TO AMEND THE PRESENT ORDINANCE REGARDING SETBACK AREAS IN THE M-1-A ZONE WHERE IT ABUTS RESIDENTIAL DEVELOPMENTS. ROLL CALL VOTE: AYES: Porter, Bokor, NOES: None ABSENT: Duke, Tom THE MOTION CARRIED. Slates, Miller, Bazil TENTATIVE TRACT MAP NO 6985 Subdivider: C. Michael, Inc. 78 lots on 15.7 acres, located on the south side of Slater Avenue 282 feet west of Beach Blvd. The Subdivision Committee Report was read by the Acting Secretary. Commission discussion followed. A MOTION WAS MADE BY SLATES AND SECONDED BY PORTER TO APPROVE TENTATIVE TRACT MAP NO 6985 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received May 2, 1969, shall be the approved layout. 2. A petition for rezoning the property to R-1 shall be filed prior to submitting a final map to the City Council for acceptance. 3. The property to the east which is held under the same ownership as this parcel shall be included in the final map as a numbered lot or a Division of Land application separating both parcels shall be filed with the Board of Zoning Adjustments, approved and the conditions of approval complied with. 4. All standard conditions of approval that are applicable shall be complied with. Located on the west side of Golden West Street, approximately 320 feet north of Ellis Avenue. The Acting Secretary read a letter submitted by the applicant, requesting continuance of Conditional Exception No. 69-16 to June 17, 1969. The hearing was opened to the audience, there being no comment, the hearing was closed. A MOTION WAS MAD-E 8Y PORTER AND SECONDED BY MILLER TO CONTINUE THE HEARING ON CONDITIONAL EXCEPTION NO 69-16 TO JUNE 17, 1969, AT THE REQUEST OF THE APPLICANT. CODE AMENDMENT NO 69-7 ARTICLE 979 Said code amendment proposes to amend Article 979 (Off -Street Parking) as follows: 1) Section 9790 (Intent) - Adding commercial parking lots or structures; 2) Section 9792.2 (Landscaping) - Adding the requirement for approval of all landscaping within five (5) feet of a public right-of-way by the Department of Public Works; and, 3) Section 9792.2.4 (Physical Protection for Landscaping) - Requiring a concrete curb on all exterior boundaries of landscaped areas. Also, adding Department of Public Works approval of land- scaping within five (5) feet of a public right-of-way to Section 9432.3 (c) of the C-2 zone. Planning Commission Tuesday, June 3, 1969 Page No. 5 TENTATIVE TRACT MAP NO 6231 - EXTENSION OF TIME SUBDIVIDER: Mills Construction The Acting Secretary read a letter submitted by VTN, engineers for the developer, requesting a one year extension of time in which to record the final map of tract No. 6231. A MOTION WAS MADE BY SLATES AND SECONDED BY BOKOR TO APPROVE A ONE YEAR EXTENSION OF TIME FOR TENTATIVE TRACT MAP NO 6231 UPON THE FOLLOWING CONDITION: 1. All conditions of approval of the previously approved tentative tract map shall be complied with. ROLL CALL VOTE: AYES: Bokor, Slates, NOES: None ABSENT: Duke, Tom THE MOTION CARRIED. Miller, Bazil, Porter ZONE CASE NO 69-16 Applicant -,Alpha Beta Acme Market Change of zone from R-A Residential Agricultural District to C-4 Highway Commercial District with a 50 ft. setback from the ultimate right-of-way line. Located on the west side of Springdale St. 660 ft. south of Edinger Ave. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. John Aaron, representing the applicant, addressed the Commission and explained the request. Nat Ross, owner of the adjacent shopping center, addressed the Commission and opposed the request because there are nine existing restaurants in the immediate area. Also speaking in opposition were the following property owners: Ted Grinager, Mrs. Grinager and Mr. Dickinson. There being no other comment, the hearing was closed. Commission discussion was held. It was pointed out by the Acting Secretary that some consideration should be given to development of the property into a use other than R-1. Also that when reviewing the proposed request, the entire 3.32 acre parcel should be considered. A MOTION WAS MADE BY SLATES AND SECONDED BY MILLER TO CONTINUE ZONE CASE NO 69-16 TO JULY 19 1969, THEREBY.ALLOWING TIME FOR THE STAFF TO STUDY THE PROPERTY FOR DIS- CUSSION AT THE JUNE 24th STUDY SESSION. Located on the northeast corner of Gothard Street and Edinger Avenue. The Staff Report was read by the Acting Secretary. The hearing was opened to the audience. Ray Kruiger, representing the applicant, addressed the Commission and gave his reasons for the request. There being no other comment, the hearing was closed. Commission discussion followed. Commissioner Porter stated that he feels this request will set a precedent for future requests. A MOTION WAS MADE BY BOKOR AND SECONDED BY SLATES TO APPROVE CONDITIONAL EXCEPTION NO 69-17 UPON THE FOLLOWING CONDITION: 1. All applicable requirements of the proposed sign ordinance shall be complied with. AND FOR THE FOLLOWING REASONS: 1. The sign will not obstruct view. 2. The area of the proposed sign is less than the 3000:sq. ft. per- mitted within the new sign ordinance. 3. The size of the development is such that a'sign having substantial size and height is required for proper identification. 4. The proposed sign will set back approximately 70 feet from the street. 5. Unique location as to distance from the freeway and being separated by high powered electrical structures is such that the request is reasonable. Mr. Jim Sam, applicant, stated his reasons for the request. The Acting Secretary informed the Commission that the Staff, including the Police Department, has review the request and does not find the proposed use or location objection- able. A MOTION WAS MADE BY SLATES AND SECONDED BY PORTER TO APPROVE SITE PLAN NO 69-1 AS PER STAFF RECOMMEND- ATION. ROLL CALL VOTE: AYES: Slates, Porter, Bazil, Bokor, Miller NOES: None ABSENT: Duke, Tom -THE MOTION CARRIED. MASTER PLAN - GOALS AND OBJECTIVES The Acting Secretary distributed sample copies of the Master Plan "Goals and Objectives -"--to the Commission. Chairman Bazil appointed Commissioner Slates, Porter and himself to serve on the Committee to work out such goals.
