TUESDAY, DUNE 24, 1969 - STUDY SESSION COMMISSIONERS PRESENT: Bazil, Bokor, Miller, Duke, Porter COMMISSIONERS ABSENT: Slates, Tom ZONE CASE NO 69-17 In Conjuntion With TENTATIVE TRACT NO 6948 Applicant: John D. Lusk & Son The Acting Secretary informed the Commission that several changes in the zone change and tentative map have been proposed by the Lusk Company and that these changes were in line with the suggestions offered at the June 17th meeting. Commissioner Bokor asked whether any provi- sions have been made to protect the Rl property adjacent to this project. It was noted that the Ml-A lots would be 200 feet deep with a 45 foot rear yard setback and an 8 foot high masonry wall constructed to provide separation of uses. The Acting Secretary also informed the Commission that a 10 ft. front yard setback on local streets has been agreed upon and that the entire setback area would be landscaped. Commissioner Bazil asked that a consensus of the Commission be established regarding the applicant's proposal to provide a 45 foot setback and an 8 foot high decor- ative masonry wall for separation between the R1 property and this project. ROLL CALL VOTE: AYES: Bazil, Bokor, Miller, Porter NOES: None ABSENT: Slates, Tom ABSTAIN: Duke DISCUSSION: Proposed Code Amendment Rear Yard Setback Ml-A Zone The Acting Secretary distributed copies of a proposed code amendment to require a 45 foot rear yard set- back in the M1 and Ml-A zones. -1- 6/24/69 - PC Minutes: H.B. Planning Commission Tuesday, June 24, 1969 Page No. 2 Commission discussion was held regarding setback requirements for industrial property when abutting resi- dential property. It was the consensus of the Commission to revise the code amendment to include a 45 foot setback on the side and/or rear yard when abutting residential property and to require a 10 ft. front yard setback in the M1A zone on a local street and that such area shall be landscaped. A MOTION WAS MADE BY COMMISSIONER DUKE AND SECONDED BY COMMISSIONER PORTER TO SET CODE AMENDMENT NO. 69-9 FOR PUBLIC HEARING AND THAT SAID AMENDMENT INCLUDE THE ABOVE CHANGES. DISCUSSION: Community Facilities District The Acting Secretary distributed copies of Proposed Article 966 Community Facilities District. He stated that this zone was established in order to designate areas devoted to major public developments which serve the community needs for educational, recreational, health, safety and govern- mental administrative facilities. Commission discusssion was held regarding such amendment. A MOTION WAS MADE BY COMMISSIONER PORTER AND SECONDED BY COMMISSIONER BOKOR TO SET ARTICLE 966 COMMUNITY FACILITIES DISTRICT FOR PUBLIC HEARING AND THAT THE AMENDMENT BE REVIEWED BY THE CITY ATTORNEY'S OFFICE AS TO FORM AND CONTENT PRIOR TO THE HEARING. ROLL CALL VOTE: AYES: Bazil, Bokor, Miller, Duke, Porter NOES: None ABSENT: Slates, Tom THE MOTION CARRIED. DISCUSSION: Civic District The Acting Secretary distributed copies of Proposed Article 967 Civic District Suffix. The Acting Secretary informed the Commission that this district was designed to apply to property around civic facilities in order to protect the public interest in major public developments. He stated that this district would essentially require approval by the Design Review Board for any building or structure within the district. It was the consensus of the Commission to set Article 967 Civic District Suffix for public hearing and that the City Administrator's Office review the amendment as to form and content prior to the public hearing. Planning Commission Tuesday, June 24, 1969 Page No. 3 DISCUSSION: Zone Case No. 69-16 Applicant: National Acceptance Corp. The Acting Secretary informed the Commission that this matter was referred to the staff for study in order that the entire 3.32 acre parcel of which this property is a part be reviewed to determine an appropriate use. The Acting Secretary reviewed several proposals with the Planning Commission. It was the consensus of the Commission that zoning of the parcel in question should be based on good planning, that Zone Case No. 69-16 should be considered on its own merits and that the use of the remaining property be reviewed when the Master Plan of Land Use in this area is considered. DISCUSSION: Clarification of Planning Commission policy regarding City Council action that modifies or disapproves Planning Commission Recommendation. It was the consensus of the Commission that any matter initiated by the Planning Commission should be referred back to the Planning Commission for further consideration prior to modi= fication or disapproval by the City Council. It was also the consensus that in their referral of these matters, the City Council should state the reasons for their intent to modify or deny the proposal. The Commission also asked that any ordinance change to effect this recommendation be referred back to the Commission for their review prior to Council action. DISCUSSION: Code Amendment 69-7 Off-street Parking The Acting Secretary informed the Commission that this item was referred back by the City Council for further consideration. It was the consensus of the Commission that this should be brought back to the Planning Commission for discussion at a later date. DISCUSSION: Code Amendment No. 69-8 - Open Space The Commission reviewed proposed Code Amendment No. 69-8 pertaining to open space for the R1 District. Discussion was held regarding the following: 1. Require open space on lots recorded prior to June 5, 1964, at a ratio of lot size to open space. 2. Require 900 sq. ft. of open space for lots recorded between June 5, 1946, and March 19, 1969. 3. Require 1200 sq. ft. of open space on all such lots recorded after March 19, 1969. A MOTION WAS MADE BY BOKOR AND SECONDED BY PORTER TO SET CODE AMENDMENT NO 69-8 FOR PUBLIC HEARING ON JULY 15, 1969. Planning Commission Tuesday, June 24, 1969 Page No. 4 DISCUSSION: Bill Hartge, City Engineer, discussed the possibility of locating fire hydrants and street lights adjacent to the curb in residential subdivisions. It was pointed out that the fire hydrants and street lights would be set back 18 inches, from inside the face of the curb rather than behind sidewalk as previously done. This will eliminate problems that have occurred with the present situation. The Commission agreed with this. THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED. ichard A.
