Wednesday, July 16, 1969 BOARD MEMBERS PRESENT: McFarland, Cook, Palin BOARD MEMBERS ABSENT: None CONDITIONAL EXCEPTION NO. 69-53 Applicant: Jerry King To permit a 35 ft. setback in lieu of the required 50 ft. setback in the C4 Highway Commercial District. Located on the south side of Atlanta Ave. at Beach Blvd. A legal description is on file in the Planning Depart- ment Office. In Conjunction With PLOT PLAN AMENDMENT NO. 69-5 Applicant: Jerry King To permit a reduction in the parking spaces as shown on the plot plan for the Use Permit No. 67-29 in the C4 Highway Commercial District. Located on the south side of Atlanta Ave. at Beach Blvd. Legal description on file in the Planning Department Office. The hearing was opened to the audience. The applicant was not present and these items were tabled. CONDITIONAL EXCEPTION NO. 69-52 Applicant: G. A. Baletka To permit a patio cover to be construc- ted to within 5 ft. of the side yard in lieu of the required 10 ft. setback as per Area Variance 67-8 in the R1 Single Family Residence District. Located on the south side of Five Harbors Dr., approximately 100 ft. east of Beachwood Lane. Legally de- scribed as Lot 24, Tract 6309. The hearing was opened to the audience. Mr. Baletka, applicant, addressed the Board and answered various questions. The Board informed the applicant that this request was in violation of the C C & R's #6309 and he must get approval from the developer, Armour Development Co., before action may be taken by the Board. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY COOK TO CONTINUE CONDITIONAL EXCEPTION NO. 69-52 UNTIL AUGUST 13, 1969. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 69-51 Applicant: General Maintenance, Inc. To permit the construction of a pole sign with 80 sq. ft. in sign area in lieu of the permitted 70 sq. ft. of sign area, in the C4 Highway Commercial District. Located on the south side of Hamilton Ave. approximately 200 ft. east of Bushard St. A legal description is on file in the Planning Department Office. The hearing was opened to the audience. Mr. Randall Kall, representing the applicant, addressed the Board and answered various questions. It was stated'that this sign is a standardized sign for the chain store. Board of Zoning Adjustments Wednesday, July 16, 1969 Page 2 of the City of Newport Beach, California, was read stating they have no comments to offer regarding this Conditional Exception. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY COOK AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 69-51 WITH THE FOLLOWING CONDITION: 1. The easterly half of the common drive between Parcel 2 and 3 (Division of Land No. 69-16) shall be utilized to satisfy the frontage requirements of Parcel 2 for the 80 sq. ft. of sign area and that Parcel 3 shall not use such common drive frontage on any future request for sign area. FOR THE REASON: 1. This is a standard sign for this use with only 10 sq. ft. increase in sign area and the applicant could achieve this square footage by revising the parcel map for Division of Land No. 69-16. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None ABSENT: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW -NO. 69-13 Applicant: Christiana Communitv Bldrs. To allow a sales office for water front models in the R1 Single Family Residence District. Located on the west side of Carousel Lane approxi- mately 200 ft. north of Wanderer Lane. Legally described as lots 144 and 145 of Tract 5481. Mr. Burns, representing the applicant, addressed the Board and answered various questions. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO.69-13 WITH THE FOLL014ING CONDITION: 1. Section 9730.25.4 of the Huntington Beach Ordinance Code shall be complied with. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None ABSENT: None THE MOTION CARRIED. DIVISION OF LAND NO. 69-20 Applicant: Wm. Lyon Development Co. To permit a division of land of approximately 40 acres into two separate parcels in the R3 Limited Multiple Family Residence District. Located on the southeast corner of Warner Ave. and Edwards St. Legal descrip- tion is on file in the Planning Department Office. Mr. Ralph Van Buskirk, re- presenting the applicant, addressed the Board and answered various questions. The Acting Secretary informed Mr. Van Buskirk that the Board can take no legal action on this request until the City Council rescinds action on Final Map 6726. -2- 7/16/69-BZA Minutes: H. B. Board of Zoning Adjustments Wednesday, July 16, '1969 Page 3 A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE DIVISION OF LAND NO. 69-20 UNTIL JULY 23, 1969, TO ALLOW THE APPLICANT TIME TO FILE A REQUEST WITH THE CITY CLERK FOR THE CITY COUNCIL TO RESCIND ACTION ON FINAL MAP 6726, AS THE BOARD WAS ADVISED THEY CAN TAKE NO LEGAL ACTION AFTER A FINAL MAP HAS BEEN FILED WITH THE CITY. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 69-53 Applicant: Jerry King In Conjunction With PLOT PLAN AMENDMENT NO. 69-5 Applicant: Jerry King The applicant being present, the hearing was opened to the audience on Conditional Exception No. 69-53 and Plot Plan Amendment No. 69-5. The applicant addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY COOK AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 69-53 WITH THE FOLLOWING CONDITION: 1. The four parking spaces in front of the bank shall be eliminated and replaced with landscaping and aidewalk. 2. The screening wall at the location of the encroachment shall be removed to afford vista of landscaping from Atlanta Ave. FOR THE FOLLOWING REASON: 1. The use will conform to the sight angle encroachment of Section 9432 of the Huntington Beach Ordinance Code and adequate parking has been provided within the shopping center as required by Article 979. A MOTION WAS MADE BY COOK AND SECONDED BY PALIN TO APPROVE PLOT PLAN AMENDMENT NO. 69-5 WITH THE FOLLOWING CONDITION: 1. All applicable conditions of previously approved Use Permit No. 67-29 shall be complied with. FOR THE FOLLOWING REASON: 1. This is a much better plan with drive -through windows at the bank and this plan provides more landscaping than the previously approved plan. It was the consensus of the Board that the plan for present and future development sub- mitted by the applicant with seven parking spaces provided for the car wash was adequate and such plan shall be the ap- proved layout for parking requirement for said use. o James W.
