Harris To permit the construction of a stucco frame 6 ft.-high wall 7 ft. from front property line in lieu of the required 15 ft. front yard setback, in the R1 Single Family Residence District. Legally described as Lot 49, Tract 3420. The hearing was opened to the audience. Mrs. Harris addressed the Board and ex- plained her request. There being no further comment, the hearing was closed. Located on the northwest corner of Algonquin St. and Boardwalk. Legal description is on file in the Planning Department Office. No one was present to represent the applicant. Board discussion followed. A MOTION WAS MADE BY SPENCER AND SE- CONDED BY JONES TO APPROVE DIVISION OF LAND NO. 69-22 WITH THE FOLLOWING CONDITIONS: 1. Algonquin St. and Heil Ave. shall be dedicated to City standards at the time each parcel is developed. 2. Algonquin --St., Heil Ave., Saybrook Lane and Boardwalk Dr. shall be fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to speci- fications provided by the Fire Department. 11. A Parcel Map shall be filed with the City and recorded. 12. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the con- ditions listed above. To permit the construction of a shopping center in the C4 Highway Commercial District. Located on the northeast corner of Atlanta Ave. and Magnolia St. A legal description is on file in the Planning Depart- ment Office. The hearing was opened to the audience. Spencer and Mr. Douglas Spickard, adjacent property owners, addressed the Board and asked questions about the development. Mr. Wallace Wierick, property owner, stated that he paid half the cost of the existing wall between the R1 area and the commercial area. It was noted by the Board that clari- fication of ownership of the wall would be necessary. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 69-40 WITH THE FOLLOWING CONDITIONS: 1. Magnolia St. and Atlanta Ave. shall be dedicated and fully improved to City standards. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 3. Concrete filled pipes 4 ft. in height shall be installed for physical protection of the walls where parking stalls abut the separation wall. 14. If any portion of the separation wall is on abutting resi- dential property, said wall shall be protected by the installation of a 6 inch high concrete curb. Said curb shall be 2 ft. from and parallel to the wall. 15. The parking plan shall provide for complete traffic cir- culation between the parcels designated Phase I and Phase II. To permit the construction of a 158 unit apartment complex in the R3 Limited Multiple Family Residence District on approximately 5.56 acres of land. Located on the south side of Edinger Ave., 528 ft. east of Springdale St. A legal description is on file in the Plan- ning Department Office. In Conjunction With CONDITIONAL EXCEPTION N0: 69-57 Applicant: B & H Development Corp. To permit a 110" side and rear yard setbacks for carports in lieu of the required 5 ft. setbacks, and a reduction in driveway width to 28 ft. in certain locations as shown on the plot plan in lieu of the present 33 ft. width as required by the Board of Zoning Adjustments at such locations. Also a reduction to 33 ft. of clear width at certain locations as shown on the plot plan in lieu of the 40 ft. width as required by the Board of Zoning Adjustments at such locations. Located on the south side of Edinger Ave., 528 ft. east of Springdale St. A legal description is on file in the Planning Department Office. The hearing was opened to the audience. A MOTION WAS MADE BY SPENCER AND SECONDED BY HARLOW TO APPROVE USE PERMIT NO. 69-42 WITH THE FOLLOWING CONDITIONS: 1. Edinger -Ave. shall be dedicated and fully improved to City standards at the time said parcel is developed. Improvements shall include street trees, street signs, street lights and fire hydrants, sewer and water main extensions. 2. Water supply shall,be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assess- ment district. 6. All utilities shall be installed underground. 8. A lighting system shall be installed within the project equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Public Works for approval. 9. All private streets shall meet the minimum standards for planned residential developments as adopted by the Plan- ning Commission. 10. There shall be no fence, structure, or landscaping con- structed or maintained over 32 feet high within a 10 ft. by 10 ft. triangular area at the intersection of drive- ways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. 11. All applicable City Ordinances shall be complied with. 13. Off-street parking facilities shall conform to Article 979. 14. The curb along the north side of the service road shall be painted red and parking shall be prohibited as that location. 15. The access to the service road from Edinger Ave. shall be relocated easterly across from Plymouth Lane. 16. The service road shall be extended easterly to the ad- jacent property and the service road of both parcels shall be improved as one road. 17. A MOTION WAS MADE BY HARLOW AND SECONDED BY SPENCER TO APPROVE CONDITIONAL EXCEPTION NO.69-57 WITH THE FOLLOWING CONDITION: 1. The walls of the carports shall be constructed of mainten- ance free masonry material and shall be compatible with the existing masonry wall. FOR THE REASONS: 1. 110" setback construction of carports will provide a better buffer between the apartment units and abutting R1 dwell- ings. 2. This separation will provide for more privacy in the rear yard for abutting R1 property owners. 3. This arrangement will eliminate the need for a driveway to be constructed along.the property line thereby elimi- nating the flow of traffic adjacent to the R1 development. 4. The street widths as shown on the plan and required as conditions of approval for Use Permit No. 69-42 will pro- vide for adequate traffic circulation. 5. USE PERMIT NO. 69-44 Applicant: Wm. Lyon Development Co., Inc. To permit the construction of a 208 unit apartment complex in the R3 Limited Multiple Family Dis- trict on approximately 8.30 acres of land. Located on the northeast corner of Warner Ave. and Edwards St. A legal de- scription is on file in the Planning Department Office. In Conjunction With CONDITIONAL EXCEPTION NO. 69-60 Applicant: Wm. Lyon Development Co., Inc. To permit the construction of carports at 110" setback 'in lieu of the required 10 ft. exterior side yard setback. Also 110" setback of such carports at rear and interior side yard property lines in lieu of the required 5 ft. setback. Also to permit open carports in lieu of the required 3-side enclosure on all carports within the interior of the development. A MOTION WAS MADE BY HARLOW AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO.69-44 WITH THE FOLLOWING CONDITIONS: 1. The Plot Plan received August 6, 1969, shall be the ap- proved layout. 2. Edwards St. and Warner Ave. shall be dedicated and fully improved to City standards. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be ap- proved by the Department of Public Works and Fire Department., 6. The flood control channel shall be fenced to Flood Con- trol District standards and City standards. 7. The property shall participate in the local drainage assessment district. 8. Soil reports as required by the Building Department and Department of Public Works shall be submitted to the City prior to'issuance of building permits. 9. All utilities shall be installed underground. 10. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to speci- fications provided by the Fire Department. 11. There shall be no fence structure or landscaping construc- ted or maintained over 32 ft. high within a 10 ft. x 10 ft. triangular area at the intersection of driveways. 19. The intersection of the drives with Warner Ave. and Edwards St. shall be approved by the Traffic Engineer and the Planning Department. 20. A MOTION WAS MADE BY HARLOW AND SECONDED BY SPENCER TO APPROVE THAT PORTION OF CONDITIONAL EXCEPTION NO. 69-60 FOR "0" SETBACKS IN LIEU OF THE REQUIRED 10 FT. EXTERIOR SIDE YARD SETBACK WITH THE FOLLOWING CONDI- TION: 1. The carport walls, having the 110" setback, shall be con- structed of decorative masonry material and the architec- tural design of such walls shall be approved by the Board of Zoning Adjustments. FOR THE FOLLOWING REASON: 1. This conditional exception will provide for a better lay- out of the plan and the design of the carport can be such that it will create architectural interest and be esthe- tically pleasing when viewed from Edwards St. AND FURTHER TO APPROVE THAT PORTION OF THE REQUEST TO PERMIT 110" SETBACK OF CARPORTS ALONG THE REAR AND INTERIOR SIDE PROPERTY LINES WITH THE FOLLOWING CON- DITION: 1. Said wall shall be of maintenance free masonry material. FOR THE FOLLOWING REASON: 1. This will permit utilization of a 5 ft. strip of land which would otherwise be a nuisance to abutting property. AND FURTHER TO APPROVE THAT PORTION OF THE REQUEST TO PERMIT OPEN CARPORTS IN LIEU OF THE REQUIRED THREE -SIDED ENCLOSURE WITHIN THE INTERIOR OF THE DEVELOPMENT FOR THE FOLLOWING REASON: 1. This request will allow the developer the flexibility in creating architectural interest. Also the area will only be viewed by residents of the development and not from the public street. CONDITIONAL EXCEPTION NO. 69-58 Applicant: Robert Taylor To permit the construction of a garage to be set back 20 ft. entered directly from a street on a lot constructed with such requirement in lieu of the presently re- quired 22 ft. setback, in the R1 Single Family Residence District. Located on the south side of Flamingo Circle approximately 400 ft. west of the property line of Bluebird Lane. A legal description is on file in the Planning Department Office. The hearing was opened to the audience. There was no one present to represent the applicant. To permit the construction of a garage to be set back 20 ft. entered directly from a street on a lot constructed with such requirement in lieu of the presently required 22 ft. setback, in the R1 Single Family Residence District. Located on the southwest corner of Anita Lane and Sher Lane. A legal description is on file -in the Planning Department Office: The hearing was opened to the audience. Jerry-Upfold, representing the applicant, addressed the Board and answered various ques- tions. He stated that other garages in this area are only set back 20 ft. and it would be physically impossible to set- back 22 ft. There being no further com- ment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY SPENCER AND SECONDED BY JONES TO APPROVE CONDITIONAL EXCEPTION NO.69-59 FOR THE FOLLOWING REASONS: 1. Other garages in the area are only set back 20 ft. 2. It is physically impossible to set the garage back 22 ft. Mr. Morrical and Mr. Schmitz, representing the applicant, addressed the Board and answered various questions.
