TUESDAY, SEPTEMBER 16, 1969 COMMISSIONERS PRESENT: Bazil, Bokor, Slates, Miller, Tom, Duke COMMISSIONERS ABSENT: Porter MINUTES: On motion by Miller and -seconded by Bokor, the Minutes of the Huntington Beach Planning Commission of July 8 and 15, 1969, were accepted as transcribed and mailed by the Secretary. CONDITIONAL EXCEPTION NO 69-12 - Continued Applicant - Atlantic Oil Company To permit the construction of a 15 unit apartment complex in the C3 General Business District. Located at the -southwest corner of 2nd Street and Olive Avenue and legally described as Lots 19, 21, 23, 25, and 27, of Block 202, Main Street Section. The Acting Secretary -informed the Commission that the staff' 's study of this area has not been completed and requested a further continuance -to December 2, 1969. The hearing was reopened to the audience. Mary Reynolds, -representing -the applicant, addressed the Commission and asked that a decision be made on this matter or'that the Commission expedite their study of the area. There being -no other --comment, the hearing -was closed.' Planning Commission Tuesday, September 16, 1969 Page No. 2 USE PERMIT NO 69-45 (Referred by Board of Zoning Adjustments) Applicant - Standard Oil Co. of Calif. To permit the construction and operation of a 3-bay service station in the C4 Highway Commerical District. Located at the southwest corner of Warner Avenue and Golden West Street. Chairman Slates stated that the public hearing has been closed, and that this case was continued for decision only. The reason for the continuance was to allow the City Attorney time to submit a report on architectural control of service stations to the City Council. A MOTION WAS MADE BY BOKOR AND SECONDED BY TOM TO CONTINUE USE PERMIT NO 69-45 TO OCTOBER 7, 1969, FOR DECISION ONLY. AYES: Bazil, Bokor, Slates, Miller, Tom, Duke NOES.: None ABSENT: Porter THE MOTION CARRIED. ZONE CASE NO 69-26 In Conjunction with CONDITIONAL EXCEPTION NO 69-34 Applicant:_ Fredericks Dev. Change of zone from C2 Community Business District to R3 Limited Multiple Family Residence District. To permit the following: 1) Construction of a 50 unit apartment complex with zero side yard setback for carports constructed within such development; 2) Detached carports to be constructed within 12 ft. of Bolsa Chica Street; and 3) A 10 ft. front yard'setback on the commercial portion of the development in lieu of the required 50 ft. setback in the C2 Community'Business District. Located at west of Bolsa Chica Street, 170 feet south of Warner Avenue. The hearing was opened to the audience on Zone Case 69-26 and Conditional Exception 69-34. Mildred Kuchne, 17032 Bolsa Chica Street, addressed the Commission and stated that she feels that property taxes will increase if this property is rezoned, also if this request is approved such a complex would be within the flight pattern of Meadowlark airport. Mr. Fredericks, applicant, addressed the Commission and explained the proposal. Joe Case, representing Fredericks Development Co., addressed the Commission and presented results of a survey which had been conducted to determine the commercial needs within the surrounding area. Approval of this request will reduce the size of the commer-' cial property to .92 acres which is little more than a service station site. 2. The area is primarily undeveloped and it is unreasonable to state that the property is improperly zoned based on today' s demand. ROLL CALL VOTE: AYES: Duke, Tom, Bazil, Slates, Miller NOES: Bokor ABSENT: Porter THE MOTION CARRIED. CONDITIONAL EXCEPTION NO 69-35 Applicant - Pacific Sands Cabana Club To permit on -sale of alcoholic beverages for a private club in the Rl Single Family Residence District. Located at the northwest corner of Atlanta Ave. and Schooner Lane. The hearing was opened to the audience. Charles Devilbiss, 8122 Snowbird Drive, addressed the Commission and requested that a block wall be constructed to provide proper separation between the club house and the Rl homes to the north. Mr. Carlton, 8132 Wildwood Circle, addressed the Commission and opposed the request because of a potential traffic problem, a need for additional parking, and noise. Mr. Carlton also stated that the liquor license would add to the problem. Mr. Bauman, representing the applicant stated that the club will not be open to the public and that no addi- tional traffic will be generated. He also stated that they can provide the required parking. There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY BAZIL AND SECONDED BY BOKOR TO APPROVE CONDITIONAL EXCEPTION NO 69-35 UPON THE FOLLOWING CONDITIONS: 1. The Planning Commission shall review Conditional Exception No 69-35 during the month of September 1970, to determine the compatibility of this use with the surrounding area and to review any complaints regarding the conduct of the use. If no bonafide complaint has been registered with the City, approval may be extended for an additional 5 year period. -3- 9/16/69 - PC Minutes: H.B. Planning .Commission Tuesda , September 16, 1969 Page No. 4 If the Commission finds it necessary in order to pre- serve the character of the neighborhood and values of property in the area, or if the use has been operated contrary to the conditions applicable to such use, the Commission may refuse to extend the authorization, in which case Conditional Exception No. 69-35 shall become null and void and the on -premise sale of alco- holic beverages shall be immediately discontinued. 2. Parking shall be provided at a -ratio of one space for each 35 sq. ft. of floor area used for dining, drinking and entertainment. The arrangement and access of all parking spaces shall conform to Article 979• 3. A. 6 ft. high masonry wall shall be constructed along the entire northerly property line where said use abuts property used for residential purposes. AND FOR THE FOLLOWING REASONS: 1. Slates, Miller, Tom CONDITIONAL EXCEPTION NO 69-36 Applicant- Carpenters Local Union #1453 To permit the construction of a 24 sq. ft. freestanding pole sign in the R3 Limited Multiple Family Residence District. Located on the south side of Atlanta Avenue, approximately 1600 feet east of Beach Blvd. The hearing was opened to the audience. The following property owners addressed the Commission and opposed the request: Arthur Duncan, 8391 Atlanta Avenue, V. C. Hennings, 8291 Atlanta Avenue and H. Bowers, 8251 Atlanta Avenue. Mr. Ceryl Fritz and Jess Green, representing the Carpen- ter's Union, addressed the Commission and gave their reasons for the request. hearing was closed. There being no other comment, the Commission discussion followed. A MOTION WAS MADE BY DUKE AND SECONDED BY TOM TO DENY CONDITIONAL EXCEPTION NO 69-36 FOR THE FOLLOWING REASONS: 1. The proposed sign does not conform to the area. 2. This request is a commercial use within a residential area. 3. Sova To permit a free-standing pole sign with a height of 58 feet in lieu of the required 50 ft. height limit in the C4 Highway Commercial District. Located north of Ellis Avenue, west of - Beach Blvd. The hearing was opened to the audience. Leonard Sova, applicant, addressed the Commission and stated his reasons for the request. hearing was closed. There being no other comment, the Commission discussion was held. A MOTION WAS MADE BY BAZIL AND SECONDED BY TOM TO DENY CONDITIONAL EXCEPTION NO 69-62 FOR THE FOLLOWING REASONS: 1. There is no apparent justification for granting this request. 2. If this application is approved, there is nothing to prevent other businesses in the area from filing similar requests. ZONE CASE NO 69-27 Applicant - Ethan M Johnson Change of zone from Ml Light Indus- trial District to R5 Office -Professional District. Located on the south side of Slater Avenue, approximately 660 feet east of Gothard Street. ROLL CALL VOTE: AYES: Bazil, Tom, Bokor, Duke, Slates, Miller NOES: None ABSENT: Porter THE MOTION CARRIED. ZONE CASE NO. 69-28 Applicant: Seabury Development Co. Change of zone from M1-A-0 Limited Manu- facturing District combined with oil production to R5-0 Office -Professional District combined with oil production. Located on the southeast corner of Hamilton Ave. and Newland St. The hearing was opened.to the audience. Ron Foell, representing the applicant, addressed the Commission and was informed the staff had re- quested a continuance on this matter to the October 7, 1969, meeting to allow time to study the area. Mr. Foell stated that he was agreeable to such a continuance. There being no other comment, the hear- ing was closed. Change of zone from R5 Office -Professional District to R3 Limited Multiple Family Residence District. - Located 260 ft. south of the centerline of Hamilton Ave. and west of Brookhurst St. The hearing was opened to the audience. Cris C. Cris, 9627 Adams Ave., addressed the Commission and asked if the school district had any com- ments on the proposal. Mr. Harlow stated that the school district had been notified but no comment was received. Ron Foell, representing the Standard Pacific Corp., addressed the Commission and stated that he was in agreement with the staff's recommendation. There being no other comment, the hear- ing was closed. Commission discussion followed. A MOTION WAS MADE BY BOKOR AND SECONDED BY MILLER TO RECOMMEND APPROVAL OF ZONE CASE NO. 697'29 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. RESOLUTION OF INTENT; A MOTION WAS MADE BY BAZIL AND SECONDED BY SLATES TO INSTRI T-THE STAFF TO PREPARE A RESOLUTION OF INTENT TO REZONE THE OLD HUNTINGTON BEACH SCHOOL SITE NO. 9 FROM R2 TO Rl AND SET SAID ITEM FOR PUBLIC HEARING. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Duke, Tom, Miller NOES: None ABSENT: Porter THE MOTION CARRIED. TENTATIVE TRACT MAP NO. 7046 - Revised Subdivider: Newoort Balboa Savinzs & Loan Assoc. 10 lots on 2 acres. Located east of Brookhurst St., approxi- mately 500 ft. south of Hamilton Ave. Commission discussion was held. A MOTION WAS MADE BY BOKOR AND SECONDED BY BAZIL TO APPROVE THE REVISED TENTATIVE_TRACT MAP NO.7046 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map and the plot plan received August 26, 1969, shall be the approved layouts. 2. Documents shall be submitted to and approved by the City Attorney's Office and Planning Department that will assure perpetual maintenance of the private street and related structures. 3. The private street shall not be dedicated separate and apart from each individual lot. 4. All "Standard Conditions of Approval" for tentative maps that are applicable shall be complied with. 5. TENTATIVE TRACT MAP NO. 6904 Subdivider: Green Hills'Development Co. 81 lots on 22.27 acres. Located at the northwest corner of Palm Ave. and Golden West St. Commission discussion was held. A MOTION WAS MADE BY MILLER AND SECONDED BY BOKOR TO APPROVE TENTATIVE -TRACT MAP NO. 6904 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received July 21, 1969, shall be the approved layout. 2. Alternate methods of meeting the requirements of the -7- 9/16/69-PC Minutes: H.B. Planning Commission Tuesday, September 16, 1969 Page 8 Uniform Fire Code shall be accepted by the Fire Chief prior to acceptance of the final map by the City Council. 3. All requirements of the Huntington Beach Oil Code shall be complied with. 4. A plan depicting the landscaping along Golden West St. shall be submitted to the Department of Public Works for approval. An agreement for maintenance of such landscaping shall be approved by the City Attorney's Office and Department of Public Works. 5. A petition to remove the 110" designation from the lots not under oil production and to rezone the lots having oil production to 1102" shall be filed prior to accep- tance of the final map by the City Council. 6. The off -island wells on lots 4, 5, 6, 21, 31, 42, 64, 65, 66, 80 and 81 shall be enclosed with a 6 ft. high decorative masonry wall, landscaped and provided with irrigation facilities. A plan showing the wall loca- tions and proposed landscaping shall be submitted to the Planning Department for approval. 7. Lots 46 and 47 shall be landscaped and provided with irrigation facilities and a plan showing such landscap- ing shall be submitted to the Planning Department for approval. 8. Lot 32 shall be landscaped and provided with irrigation facilities and a plan showing such landscaping shall be submitted to the Planning Department for approval or such lot shall be enclosed with lot 31 and improved in the same manner as lot 31. 9. All oil well sites within 150 ft. of the tract boundary shall be screened from view of the tract with a 6 ft. high decorative masonry wall. 10. All oil lines within the street right-of-way shall be maintained by the owner of such lines and an agree- ment for maintenance shall be entered into with the City and approved by the Department of Public Works and City Attorney's Office. 11. All "Standard Conditions of Approval" for tentative tracts adopted on May 20, 1969, that are applicable shall be complied with. COMMISSIONER MILLER: Commissioner Miller requested that the statt review t e study of the 17th St. area and bring such report back to the Commission for further discussion at the September 23rd study session.
