Wednesday, October 22, 1969 BOARD MEMBERS PRESENT: McFarland, Lovejoy, Harlow BOARD MEMBERS ABSENT: None MINUTES: On motion by Harlow and seconded by Lovejoy, the minutes of October 1 and October 8, 1969, were accepted USE PERMIT NO. 69-55 Applicant: John A. Marlow & Assoc. To permit the construction of a full service carwash including gasoline pump islands in the C4 Highway Commercial District. Located on the northwest corner of Beach Blvd. and Glencoe St. A legal description is on file -in the Planning Department Office. The hearing was opened to the audience. The applicant was informed that the Planning Commission has requested the Board of Zoning Adjust- ments to refer any applications pertaining to service stations to them for decision. Joe Evans, representing the applicant, addressed the Board and discussed the continuance. He was in- formed of the kind of information they should present to the Planning Commission. There being no further comment, the hearing was closed. A MOTION WAS MADE BY HARLOW AND §ECONDED BY LOVEJOY TO REFER USE PERMIT NO. 69-55 TO THE PLANNING COM- MISSION FOR HEARING AND DECISION AT THEIR NOVEMBER 4, 1969, MEETING TO BE HELD IN THE COUNCIL CHAMBERS AT 7:00 P.M. ROLL CALL VOTE: AYES: McFarland, Lovejoy, Harlow NOES: None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 69-74 Applicant: Gene Burke To permit the construction of a 9 ft. high wall on an interior side property line to be setback 30 ft. from the front property line in lieu of the permitted 6 ft. high wall. Also, to permit a patio cover to be constructed along the side property line in lieu of the required 5 ft. side yard setback. Located at 4162 Windsor Lane in the R1 Single Family Residence District. Legally described as Lot 158, Tract 4880. Dr. Burke, applicant, and Mr. Rosene, adjoining property owner, addressed the Board. The Board was informed that the fence is existing. Mr. Rosene requested that the facing of the fence be of material that meets with his ap- proval. Mr. Burke explained his reasons for the request. There being no further comment, the hearing was closed. Board discussion was held regarding proper separation as well as the appearance, height and con- struction of the fence. It was the consensus of the Board that a field check of the structure should be made before action,by the Board, was taken. A MOTION WAS MADE BY HARLOW AND SECONDED BY LOVEJOY TO CONTINUE CONDITIONAL EXCEPTION NO. 69-74 TO NOVEMBER 5, 1969, TO ALLOW TIME FOR A FIELD CHECK BY THE BOARD. Board of Zoning Adjustments Wednesday, October 22, 1969 Page 2 ADMINISTRATIVE REVIEW NO. 69-18 Applicant: La Cuesta To permit 42 in. high fences in the front yards of lots 3, 4, 6, 7, 9, 12 and 34 of Tract 6893 to provide for 900 sq. ft. minimum open space, in the RA-0 Residential Agricultural District combined with oil. Located south of Atlanta Ave. and east of Bushard St. Legally described as Tract 6893. There was no one present to represent the applicant. Board discussion was held. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 69-18. ROLL CALL VOTE: AYES: McFarland, Lovejoy, Harlow NOES: None ABSENT: None THE MOTION CARRIED. MISCELLANEOUS: A memo from the Planning Di- rector was read by the Secretary requesting review of the provisions of Use Permit No. 68-23 for com- pliance to the ordinance and compliance to the condi- tions of approval. Board discussion was held. It was the consensus that the Board should conduct a field check of the use. THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED. Richard A.
