TUESDAY, NOVEMBER 4, 1969 COMMISSIONERS PRESENT: Bazil, Bokor, Slates, Tom, Duke Miller, Porter COMMISSIONERS ABSENT: None MINUTES: On motion by Bokor and seconded by Bazil, the Minutes of the Huntington Beach Planning Commission of September 3 and 16, 1969, were accepted as transcribed and mailed by the Secretary. USE PERMIT NO 69-55 (Referred by Board of Zoning Adjustments) Applicant: John A. Marlow and Assoc. To permit the construction of a full service carwash including gasoline pump islands in the C4 Highway Commercial District. Located at the northwest corner of Beach Blvd. and Glencoe St. Chairman Slates informed the Commis- sion that a letter had been received from Joe Evans, representing the applicant, requesting a two weeks continuance. COMMISSIONER TOM: Commissioner Tom arrived at 7:12 P.M. and assumed his duties. A MOTION WAS MADE BY MILLER AND SECONDED BY BAZIL TO CONTINUE USE PERMIT NO 69-55 TO NOVEMBER 18, 1969, AT THE APPLICANT'S REQUEST. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Tom, Duke, Miller, Porter NOES: None ABSENT: None THE MOTION CARRIED. ZONE CASE NO 69-32 Applicant: Freeway Industrial Park Change of zone from Ml Light Industrial District to C4 Highway Commerical District with a 50 ft. setback from the ultimate right-of-way line. Jack Murdy, applicant, addressed the Commis- sion and explained the proposal. hearing was closed. There being no other comment, the Commission discussion was held. A MOTION WAS MADE BY BAZIL AND SECONDED BY BOKOR TO RECOMMEND APPROVAL OF ZONE CASE NO 69-32 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. This is the only parcel remaining in the industrial classification that fronts on the north side of Edinger Avenue. It is bounded on the north and west by Golden West College and on the east by a commer- cial use. 2. Because of surrounding land development, this is the only appropriate use for the property. ROLL CALL VOTE: AYES: Bazil, Bokor, Tom, Slates, Duke, Miller NOES: Porter ABSENT: None THE MOTION CARRIED. Minority Opinion: Commissioner Porter stated that he feels it is a mistake to rezone industrial property until such time as the central indus- trial study is completed and sufficient replacements of industrial property is established to compensate for any loses. CONDITIONAL EXCEPTION NO 69-72 Applicant: Leonard Lindborg To permit an additional story in height with no increase in maximum height limits in lieu of the permitted two stories. Also a reduction in the minimum 10 ft. dimension required for open space with cantilever of second story structure over such open space and a reduction in the required 22 ft. garage setback entered directly from a street to 10 ft. with automatic door opener in the R4 Multiple Family Residence District. Located at 13th St. approximately 200 ft. north of Pacific Coast Highway. A video tape was shown of the subject property and surrounding area. The hearing was opened to the audience. Sharleen Bauer, adjacent property owner, addressed the Commission and opposed that portion of the request to reduce the required open space. Leonard Lindborg, applicant, addressed the Commission and explained the proposal. -2- 11/4/69 - PC Minutes: H.B. Planning Commission Tuesday, November 4, 1969 Page No. 3 There being no other comment, the hearing was closed. The Commission held a lengthy dis- cussion. Commissioner Bazil and Commissioner Duke stated that they feel a 22 ft. setback for the garage entered from 13th Street should be provided as suggested by the Staff. A MOTION WAS MADE BY BAZIL AND SECONDED BY DUKE TO APPROVE CONDITIONAL EXCEPTION NO 69-72 AS PER STAFF'S RECOMMENDATION FOR THE FOLLOWING REASON: 1. The property is a 25 ft. lot between two relatively new apartments. THE MOTION WAS WITHDRAWN. Chairman Slates polled the Commission for a consensus on the 22 ft. setback for garage entered from the street. In favor of the 22 ft. setback were Bazil, Slates, and Duke and opposing were Porter, Tom, Miller, and Bokor. A MOTION WAS MADE BY BAZIL AND SECONDED BY DUKE TO APPROVE CONDITIONAL EXCEPTION NO 69-22 AS PER STAFF'S RECOMMENDATION FOR THE FOLLOWING REASON: 1. The property is a 25 ft. lot between two relatively new apartments. ROLL CALL VOTE: AYES: Bazil, Duke NOES: Slates, Porter, Miller, Tom, Bokor ABSENT: None THE MOTION DID NOT CARRY. A FURTHER MOTION WAS MADE BY TOM AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO. 69-72 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall submit an application to the Board of Zoning Adjustments for approval, requesting a 7/z ft. setback for the garage which is entered from 13th Street. 2. The garage shall be equiped with an automatic garage door opener. AND FOR THE FOLLOWING REASON: 1. The subject property is a key 25 foot lot between two relatively new apartments; thus there is no room for expansion. Planning Commission Tuesday, November 4, 1969 Page No. 4 CODE AMENDMENT NO 69-10 The Commission reviewed the pro- posed amendment. A) Amend Articles 943, C2 Community District, and 945, C3 General Business District, by adding the require- ments that automobile service stations may be permitted subject to a use permit in both districts. -B) Require approval of administrative review by the Board of Zoning Adjustments for all uses in the C2, C3, and C4 zones which do not require use permit approval. C) To amend Article 985, Design Review Board, by amending Section 9851, Design Review Board Objectives and Section 9852.2 by authorizing the Design Review Board to review any matter referred to them by any department, board or commission of the City and to recommend approval, conditional approval or denial of any design so reviewed. The hearing was opened to the audience, there being no comment the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY BOKOR AND SECONDED BY TOM TO RECOMMEND APPROVAL OF ITEMS A and B OF CODE AMENDMENT NO 69-10 TO THE CITY COUNCIL AND TO CONTINUE ITEM C OF SUCH AMENDMENT TO THE NOVEMBER 25, 1969, STUDY SESSION FOR FURTHER DISCUSSION. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Miller, Tom, Duke, Porter NOES: None ABSENT: None THE MOTION CARRIED. PLANNED RESIDENTIAL DEVELOPMENTS - Code Amendment No 69-2 (Continued) It was the consensus of the Commis- sion to continue discussion of this code amendment to November 18, 1969, to allow time for the Commission to review and submit comments pertaining to said matter. COMMENTS FROM THE COMMISSION: A) Commissioner Bokor re- quested that the Acting Secretary check with the State to see if the members of the Commission of Housing and Community Development have been appointed and to report back to the Commission. -4- 11/4/69 - PC Minutes: H.B. Planning Commission Tuesday, November 4, 1969 Page No. 5 B) Commissioner Bazil suggested that the Staff investigate methods to restrict access to streets within the area bounded by lst Street, 23rd Street, Palm Ave. and Ocean Avenue. Mr. Bazil further suggested that the Staff submits comments pertaining to guest parking requirements, C) Commissioner Duke requested that the Staff review that portion of the tape of the Planning Commission meeting pertaining to the apartment study and report back. D) Chairman Slates stated that two Commissioners should attend the AIP Seminar in San Francisco and that such request be submitted to the City AdministrRtor for appropriate action.
