Wednesday, November 5, 1969 BOARD MEMBERS PRESENT: McFarland, Cook, Harlow USE PERMIT NO. 69-45 - Continued ADDlicant: Standard Oil ComDanv of Calif. To permit the construction and operation of a 3-bay service station. Located on the southwest corner of Warner Ave. and Golden West St. in the C4 Highway Commercial District. A legal description is on file in the Planning Department Office. The hearing was opened to the audience. There was no one present to represent the applicant and there being no other comment, the hearing was closed. It was noted that this application was approved by the Planning Commission and referred to the Board of Zoning Adjustments to approve the plot plan and to establish any conditions of approval that were deemed necessary. Board discussion was held. A MOTION WAS MADE BY HARLOW AND SECONDED BY COOK TO APPROVE USE PERMIT NO. 69-45 WITH THE FOLLOWING CONDITIONS: 1. Warner Ave. and Golden West St. shall be dedicated and fully improved to City standards. Improvements shall in- clude street trees, street signs, street lights, fire hydrants, sewer and water main extensions, and relocation of the traffic signal. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assess- ment district. 6. Soil reports, as required by the Building Department and Department of Public Works shall be submitted to the City prior to issuance of building permits. 7. All utilities shall be installed underground. 8. Fire alarm system conduit and appurtenances shall be in- stalled by the developer at locations and to specifications provided by the Fire Department. 9. Off-street parking facilities shall conform to Article 979. 10. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 11. All applicable City Ordinances shall be complied with. 12. The exterior material of the building and columns for the canopies shall be of an off-white slump stone. Burke To permit the construction of a 9 ft. high wall on an interior side property line to be setback 30 ft. from the front property line in lieu of the permitted 6 ft. high wall. Also, to permit a patio cover to be constructed along the side property line in lieu of the required 5 ft. side yard setback. Located at 4162 Windsor Drive in the R1 Single Family Residence District. Legally described as lot 158, Tract No. 4880. It was noted that this matter was continued'from the October 22, 1969, meeting to allow the Board to inspect the site. to the audience. The hearing was opened Dr. Burke addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY HARLOW TO APPROVE THAT PORTION OF THE REQUEST FOR A 9 FT. HIGH FENCE WITH THE FOLLOWING CONDITION: 1. The side facing the adjacent property shall be finished to the adjacent property owner's satisfaction. FOR THE REASON: 1. The 9 ft. high wall is necessary to provide privacy for the applicant from the adjacent property owners' service area. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow NOES: None THE MOTION CARRIED. A FURTHER MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO DENY THAT PORTION OF THE REQUEST FOR A PATIO COVER TO BE CONSTRUCTED ALONG THE SIDE PROPERTY LINE IN LIEU OF THE REQUIRED 5 FT. SIDE YARD SETBACK. FOR THE REASONS: 1. The applicant failed to justify his request. 2. The required setback can be complied with. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow NOES: None THE MOTION CARRIED. C1 ADMINISTRATIVE REVIEW NO. 69-20 - Continued Applicant: Wm. Lvon Development Co. To permit a reduction in the front yard setback for garages entered directly from the street to 72 ft-. and being equipped with automatic door openers on lots .15, 30 and 60 of Tract 6726. Located east of Edwards Street between Slater Ave. and Warner Ave. in the R1 Single Family Residence District. The hearing was opened to the audience. CONDITIONAL EXCEPTION NO. 69-76 Applicant: PBS Corporation To permit the area of the spandrel to be included in the computing of the 6000 sq. ft. average for six reduced lots for Tentative Tract 6954. Located on the west side of Bushard St. south of Indianapolis Ave. in the RA-0 Residential Agricultural District combined with oil production. The hearing was opened to the audience. Ralph Van Buskirk, representing the applicant, addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion followed. USE PERMIT NO. 69-58 ADDlicant: John L. Henricksen To permit a 120 ft. x 25 ft. addi- tion to an existing mobile home park by moving a 6 ft. high chain link fence to the exterior bounds of said parcel for the purpose of storing tenants' campers and extra vehicles. Located on the south side of Adams Ave., 330 ft. east of Delaware St. in the R5 Office -Professional District. A legal description is on file in the Planning Department Office. To permit a two -car garage which is entered directly from the street to be setback 20 ft. from the front property line in lieu of the required 22 ft. setback. Located on the south side of Cornell Dr., approxi- mately 100 ft. west of Bolsa Park Lane in the R1 Single Family Residence District. A legal description is on file in the Planning Department Office. Marvin Crocker, representing the applicant, addressed the Board and answered various ques- tions. There being no further com- ment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY COOK AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 69-79 FOR THE FOLLOWING REASON: 1. The situation is the same as the driveways in the rest of the tract. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow NOES: None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 69-77 Applicant: Standard -Pacific Corp. To permit carports to be constructed on the rear and interior property lines in lieu of the required 5 ft. setback, and to permit such carports to be constructed within 10 ft. of the front property line in lieu of the required 50 ft. front yard setback. Such request applies to a 220 unit apartment complex located on the west side of Brookhurst St. approximately 260 ft. south of Hamilton Ave. in the R3 Limited Multiple Family District. A legal de- scription is on file in the Planning Department Office. In Conjunction With USE PERMIT:NO: 69-57 Applicant: Standard -Pacific Cor To permit the construction of a 220 unit apartment complex on approximately 9.15 acres of land in the R3 Limited Multiple Family District. Located on the west side of Brookhurst St., approximatly 260 ft. south of Hamilton Ave. A legal description is on file in the Plan- ning Department Office. The hearing was opened to the audience. Mr. Hudson, representing the applicant, addressed the Board and answered various ques- tions. Mrs. J. Zimmerman and Mrs. H.A. Sarwine, adjacent property owners, addressed the Board and expressed concern over the design of that portion of the project adjacent to their property. They also requested that the carports ad- jacent to their property be fully enclosed, to deter vandals. There being no further comment, the hearing was closed. Board discussion followed. It was the consensus of the Board that, if feasible, the developer should incorporate a landscaping strip along the rear property line. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 69-57 WITH THE FOLLOWING CONDITIONS: 1. Brookhurst St. shall be dedicated and fully improved to City standards. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be ap- proved by the Department of Public Works and Fire Depart- ment. 5. Easements for utilities or walkways shall be provided to Department of Public Works standards. 6. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of any City easement. 7. The property shall participate in the local drainage assessment district. 8. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 9. All utilities shall be installed underground. 10. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifica- tions provided by the Fire Department. 11. Off-street parking facilities shall conform to Article 979. 12. A masonry wall shall be constructed along the north, south and west property lines. The hei ht of said wall shall be such that the top will be six feet above the highest ground surface within twenty (20) feet of the common pro- perty line. Except within the area between the carports and Brookhurst St., in which case the height of said wall shall be reduced to 42 inches. 13. There shall be no fence, structure or landscaping con- structed or maintained over 32 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets. 14. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 15. A lighting system shall be installed within the project equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Public Works or Building Department for approval. 16. The structural street section of all private drives shall be approved by the Department of Public Works. 17. All applicable City Ordinances shall be complied with. 18. To permit a waiver of the required separation wall as required by Section 9103.3.1 of the Huntington Beach Ordinance Code (Minimum Open Space). Located on the southeast corner of Newland St. and Atlanta Ave. in the R1 Single Family Residence District. A legal description is on file in the Planning Department Office. The hearing was opened to the audience. Donald Dady, representing the applicant, addressed the Board and answered various ques- tions. There being no further comment, the hearing was closed. CONDITIONAL EXCEPTION NO. 69-78 Applicant: Tropicana Patio Co., Inc. To permit an unenclosed aluminum patio cover to be constructed with a 5 ft. encroach- ment over a public waterway in lieu of the requirement that such structures not project beyond the property line. Located at 16702 Baruna Lane in the R1 Single Family Residence District. A legal description is on file in the Planning Department Office. The hearing was opened to the audience. Bob McClure, representing the applicant, addressed the Board and answered various ques- tions. There being no further com- ment, the hearing was closed. The question was raised whether or not the Board has the authority to act on this appli- cation because it pertains to construction within the public right-of-way. Board discussion followed.
