Wednesday, November 26, 1969 BOARD MEMBERS: McFarland, Cook, Harlow CONDITIONAL EXCEPTION NO. 69-83 - Continued Applicant: Westport Enterprises, Inc. To permit 110" setback for carports con- structed on interior and rear property lines in lieu of the required 5 ft. setback within a 242 unit apartment complex. Located on the east side of Bolsa Chica Ave., approximately 995 ft. south of Warner Ave., in the R2 Two Family Residence District and R3 Limited Multiple Family District. A legal description is on file in the Planning Department Office. In Conjunction With USE PERMIT NO. 69-60 - Continued Applicant: Westport Enterprises, Inc. To permit the construction of 242 unit apartment complex on approximately 8.3 acres of land. Legal and location same as above. In Conjunction With DIVISION OF LAND NO. 69-33 - Continued Applicant: Westport Enterprises, Inc. To allow a division of land into three separate parcels of approximately 8.3 acre parcel of land. Location and legal description same as above. The hearing was opened to the audience. Mr. Bergonz, representing the Homeowners Association, addressed the Board and read a letter requesting that certain conditions be required of the developer. Mr. Clendennen, the applicant, addressed the Board, stating that a meeting had been held with the home- owners and he was agreeable to their conditions. It was noted that Parcel 3 would have to be made to comply to density as required by ordinance and that a revised plot plan should be submitted to the Planning Depart- ment prior to the issuance of building permits. There being no further comment, the hear- ing was closed. Board discussion was held. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. Easements for utilities or walkways shall be provided to Department of Public Works standards. 6. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 7. The property shall participate in the local drainage assessment district at the time said parcel is developed. 8. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 9. All utilities shall be installed underground. 10. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifi- cations provided by the Fire Department. 11. Off-street parking facilities shall conform to Article 979. 12. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Department. 13. A masonry wall shall be constructed along the north and east property lines. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common pro- perty line. Except within the west 15 ft. along the north property line, in which case the height of said wall shall be reduced to 42 inches. 14. There shall be no fence, structure or landscaping construc- ted or maintained over 32 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the inter- section of streets. 15. No structures, other than those shown on the approved plot plan shall be constructed within the project. 16. A lighting system shall be installed within the project equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Public Works or Building Department for approval. 17. The structural street section of all private drives shall be approved by the Department of Public Works. 18. All applicable City Ordinances shall be complied with. 19. All the conditions stipulated by the Homeowners Associa- tion and agreed to by the property owner, shall be included as conditions of approval. 20. Laundry rooms shall be vented internally. 21. A revised plot plan shall be submitted to the Planning Department prior to issuance of building permits. CONDITIONAL EXCEPTION NO. 69-86 - Continued Applicant: Dr. Joseph C. Scheitzach To permit an 8 ft. high block wall in lieu of the permitted 6 ft. high block wall. Located at 17220 Courtney Lane approximately 120 ft. south of the inter- section of Edgewater Lane in the R1 Single Family Residence District. Legally described as Lot 3, Tract 5667. The hearing was opened to the audience. Dr. Scheitzach addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY HARLOW AND SECONDED BY COOK TO DENY CONDITIONAL EXCEPTION NO. 69-86 FOR THE FOLLOW- ING REASONS: 1. The wall would cause an unsightly appearance from Warner Ave. 2. Located at the northwest cor- ner of Beach Blvd. and Aldrich St. in the C4 Highway Com- mercial District. A legal description is on file in the Planning Department Office. The hearing was opened to the audience. Joe Evans addressed the Board and answered various questions. There being no further com- ment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO.69-59 WITH THE FOLLOWING CONDITIONS: 1. Beach Blvd. and Aldrich St. shall be dedicated and fully improved to City and/or State standards. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system at'the time said parcel is developed. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed. 4. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assess- ment district at the time said parcel is developed. 6. All the above conditions shall be complied with prior to issuance of a Certificate of Occupancy by the Building Department unless otherwise specified. Located on the south side of Atlanta Ave. approximately 1600 ft. east of Beach Blvd. in the R3 Limited Multiple Family District. Mr. John Banks and Mr. Cyril Fritz, re- presenting the applicant, addressed the Board and answered various questions. Board discussion followed. It was the consensus of the Board that the request should be checked in the field. Also, that the provisions of the sign code pertaining to this type of sign should be reviewed. A MOTION WAS MADE BY COOK AND SECONDED BY MCFARLAND TO CONTINUE ADMINISTRATIVE REVIEW NO. 69-25 TO DECEMBER 3, 1969, TO ALLOW TIME FOR THE BOARD TO MAKE A FIELD CHECK OF SUBJECT PROPERTY. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow THE MOTION CARRIED. USE PERMIT NO. 69-64 Applicant:_ Church of the Nazarene To permit a room addition to an existing church to serve as classrooms. Located 640 ft. north of Garfield Ave., approximately 580 ft. east of Beach Blvd. in the R3 Limited Multiple Family District. A legal description is on file in the Planning Department Office. The hearing was opened to the audience. A letter was read by the Secretary from Dr. Frankel, requesting that a masonry wall be constructed between properties. Rev. Brinkley, representing the applicant, addressed the Board and answered various questions. It was noted that the State Division of Highways will be taking this property for freeway use within a relatively short period of time. There being no further comment, the hearing was closed. A MOTION WAS MADE BY COOK AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 69-64 WITH THE FOLLOW- ING CONDITIONS: 1. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 2. Sufficient evidence shall be provided that the 40 foot alley located at the southeast corner of the parcel pro- vides access to the subject property from Garfield Ave. Said alley shall be paved to Building Department standards to a minimum width of 40 feet. 3. The alley shown on the east side of the parcel shall be private. 4. Constantine Drive shall be dedicated to City standards. 5. Said property shall participate in the proposed assess- ment district. 6. Off-street parking facilities including landscaping arrangement, access, paving and striping of all parking spaces shall conform to Article 979. 7. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of a building permit. 9. A plan conforming to the grading ordinance shall be sub- mitted to the Department of Public Works for approval prior to issuance of a building permit. 10. No structures, other than those shown on the approved plot plan which are indicated for immediate construction, shall be constructed within the project. 11. A plan conforming to the above conditions shall be sub- mitted for approval by the Board of Zoning Adjustments prior to the issuance of a building permit. THE REASON GIVEN FOR NOT REQUIRING THE SEPARATION WALL WAS: 1. This property does not directly abut the apartment com- plex to the south. Located on the west side of Baruna Lane, approximately 120 ft. south of Sea Witch Lane in the R1 Single Family Residence District. There was no one present to represent the applicant. Board discussion was held. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE DIVISION OF LAND NO. 69-40 WITH THE FOLLOWING CONDITION: 1. DIVISION OF LAND NO. 69-41 Applicant: Robert Stellrecht To permit a division of land into four separate parcels each being 66.2 ft. in width by 620 ft. in depth. A MOTION WAS MADE BY HARLOW AND SECONDED BY COOK TO CONTINUE DIVISION OF LAND NO. 69-41 INDEFINITELY FOR THE FOLLOWING REASON: 1. It has not been City policy to approve divisions of land such as this without knowledge of a development plan and the continuance will allow the applicant time to submit a plan of the proposed development. Lindborg To permit a 72 ft. setback for a garage entered directly from the street in lieu of the required 22 ft. setback. Located on the west side of Thirteenth St., approxi- mately 75 ft. south of Walnut Ave. in the R4 Multiple Family Residence District. Legally described as Lot 15, Block 113. The hearing was opened to the audience. Leonard Lindborg addressed the Board and answered various questions. It was noted by the Secretary that the Planning Commission required this application to be submitted. There being no further comment, the hear- ing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 69-89 WITH THE FOLLOWING CONDITION: 1. The garages shall be equipped with automatic garage door openers. CONDITIONAL EXCEPTION NO. 69-87 Applicant: Jerry & Rosemary Pazzulla To permit an existing 12 ft. driveway to serve two-way traffic in lieu of the required minimum 20 ft. width. Located on the east side of Gothard St., approximately 450 ft. south of Slater Ave. in the M1 Light Industrial District. A legal description is on file in the Planning Department Office. The hearing was opened to the audience. Mrs. Pazzulla addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion followed. It was noted that the driveway is exist- ing and is presently 12 ft. wide. Also, the addition does not reduce the efficiency of the drive.
