COMMISSIONERS PRESENT: Bazil, Bokor, Miller,Tom, Porter,
Duke.
COMMISSIONERS ABSENT: Slates.
MINUTES: On motion by Duke and seconded by Miller,
time Minutes of the Huntington Beach Planning Commission of
September 23, and October 7, 1969, were accepted as trans-
cribed and mailed by the Secretary.
AGENDA ITEMS TO BE CONTINUED:
USE PERMIT NO 69-55
Applicant - John A. Marlow & Assoc.
The Acting -Secretary read a letter sub-
mitted by Joe Evans, for John Marlow and Assoc., requesting
two weeks continuance on Use Permit No 69-55, in order to
submit proper renderings & elevation to the Commission.
A MOTION WAS MADE BY BOKOR AND SECONDED
BY MILLER TO CONTINUE USE PERMIT NO 69-55 AT THE APPLICANTS
REQUEST.

A letter, submitted by the Ocean View
School District, opposing the request was read by the Acting
Secretary.
The Commission reviewed the Staff Report.
Commission Discussion Followed.
A MOTION WAS MADE BY BAZIL AND SECONDED
BY BOKOR TO APPROVE SITE PLAN NO 69-4 UPON THE FOLLOWING
CONDITIONS:
1. Approval of this application shall only be applicable
for the Bully Beef Restaurant.

2. All applicable provisions of Division 9 of the H. B.
Ordinance Code shall be complied with.
AND FOR THE FOLLOWING REASONS:

2. This request is compatible with the area, and is not
detrimental to the neighborhood.

CONDITIONAL EXCEPTION NO 69-39

Residence District.
Located south side of Heil Avenue
approximately 250 ft. west of the centerline of Graham St.
The hearing was opened to the audience.
Jack Koebi.g, representing the applicant,
addressed the Commission and spoke in favor of the request.

The Commission held a Lengthy discussion.
A MOTION WAS MADE BY DUKE AND SECONDED
BY BAZIL TO APPROVE CONDITIONAL EXCEPTION NO 69-39 WITH THE
FOLLOWING CONDITIONS:
1. All provisions of Section 9231.3 of the Huntington Beach
Ordinance Code shall be complied with. The area within
the front 15 ft. along Heil Ave. shall not be used to
satisfy this requirement.
2. The land area required under Section 9231.3 shall be
satisfied by expanding the proposed use to the east in
which case the applicant shall improve the entire parcel
or shall file a division of land application causing
separation of the parcel to be used from the remaining
property held under the same ownership.
3. All conditions of approval of Conditional Exception No.
68-35 shall be complied with. Such conditions shall also
apply to the expansion of the parcel to the east.
AND FOR THE FOLLOWING REASON:
The use is providing a service for the community for
which there is a need.

CONDITIONAL EXCEPTION NO 69-12 - Continued
Applicant - Atlantic Oil Company
To permit the construction of a 15 unit
apartment,complex in the C3 General Business District.
Located on the southwest corner of 2nd
Street and Olive Avenue and legally described as lots 19,
21, 23, 25, and 27 of Block 202, Main Street Section.
The hearing was opened to the audience.
COMMISSIONER PORTER:
Commissioner Porter'arrived at 7:30 P.M.,
and assumed his duties.
Mr. Freebairn, Saddleback Investment Co.,
addressed the Commission and explained the proposal.
Ralph Kiser of the Huntington Beach
Chamber of Commerce, spoke in favor of'the request.
Mary Reynolds, representing the property
owner, stated that there is no demand for commercial develop-
ment in the area, but there is a demand for apartments.
Miss Reynolds asked for a decision on this item.
There being no other comment, the hear-
ing was closed.
The Commission held a lengthy discussion.
The Commission ask Mary Reynolds if the property owner would
agree to a continuance to allow the staff time to draft a
town center zone, Mary Reynolds informed the Commission
that she would check with the property owner.

BY BAZIL TO CONTINUE CONDITIONAL EXCEPTION NO 69-12 TO
DECEMBER 16, 1969, FOR DECISION ONLY, TO ALLOW THE APPLI
CANT TIME TO CHECK WITH THE PROPERTY OWNER FOR A CONTINUANCE
TO ALLOW THE STAFF TIME TO DRAFT A TOWN CENTER ZONE.

Applicant - James Hodges
To permit 1. Construction of a 10 unit apartment
complex in lieu of the permitted maximum of 6 units.

2. Such units shall be three stories in
height in lieu of the permitted maximum two stories (such
buildin s are not to exceed the permitted building height of
30 feet.
3. Constructhn of carports at 110" side
yard setback in lieu of the required 4 foot setback.
4. Open unenclosed stairways to setback
18 inches from the side property line in lieu of the required
3 ft. setback.
5. To permit the second story of such
building to cantilever over the required 600 sq. ft. of open
space and to permit construction of an open stairway within
open space.
Located in the R4 Multiple Family Resi-
dence District, on the east side of 13th Street, approxi-
mately 125 feet north of Walnut Avenue.
The hearing was opened to the audience.
Mr. Hodges, applicant, addressed the
Commission and explained the request. Mr. Hodges stated
that the proposed project will be of very desirable complex.
Mrs. L. Koester, 305 - 13th Street,
opposed the 3 story portion for the request. There being
no other comment the hearing was closed.
The Commission held a lengthy discussion.

BY BOKER TO CONTINUE CONDITIONAL EXCEPTION NO 69-41 TO
DECEMBER 1_6, 19699 FOR DECISION ONLY, TO ALLOW THE APPLI-
CANT TIME TO CHECK WITH THE PROPERTY OWNER ON THE CONTIN-
UANCE REQUEST BY THE STAFF TO STUDY DEVELOPMENT STANDARDS
IN THE DOWNTOWN AREA.

COMMISSIONER BOKER: Commissioner Bokor was excused from

PROPOSED CODE AMENDMENT - DESIGN REVIEW BOARD
It was the consensus of the Commission
to continue this item to December 9th Study Session meeting,
ZONING STUDY SOUTHEAST CORNER OF ADAMS AVENUE AND BROOK-
HURST STREE
The Acting Secretary distributed copies of a letter which
was written to Councilman Matney by Edward H. Kerins, Presi-
dent of Meredith Gardens Homeowners Association, requesting
that the City Council initiate action to adopt a resolution
declaring a moratorium on the issuance of building permits
for the C-2 property located at the southeast corner of
Brookhurst Street and Adams Avenue.

Mr. Harlow informed the Commission that the matter was re-
ferred to the Planning Commission by the City Council for
a recommendation. Mr. Harlow stated that the Commission
studied the zoning of this parcel at the April 1, 1969 meet-
ing, at which time it was the consensus of the Commission
to leave said property within the commercial classification.
1. This corner is one of the most ideal sites in the city
for large,_shopping facilities due to its proximity to
major highways.
2. The property should not be rezoned for any other use
because the potential for commercial is too great for
this area.
3. Although there is a surplus of commercial zoning at
this intersection, the discount store at the southwest
corner of said intersection serves a large area and such
does not significantly add to the surplus.
A lengthy discussion was held by the Planning Commission.
It was the consensus of the Commission that this property
should remain in a commercial classification, but for bet-
ter planning and a more orderly development it should be re-
zoned to C-4, a more restrictive classification.
The Commission found that there is a probability that the
two parcels on the southeast corner may be sold or leased
into multiple parcels. The Commission also found that such
a development would be a hodgepodge of uncoordinated, poorly
planned commercial structures which could be built, creating
blight in the city.
It was also the consensus of the Commission that the Board
of Zoning Adjustments should refer any application pertaining
to the parcel to the Commission for a decision.
A motion was made by Duke and seconded by Porter to instruct
the Secretary to set a public hearing to rezone the subject
property to C-4.

THE MOTION CARRIED.
Further discussion was held by the Commission pertaining to
a resolution affecting issuance of building permits as reques-
ted by the Meredith Gardens Homeowners Association.
A motion was made by Porter and seconded by Duke to adopt a
resolution recommending that the City Council declare a morato-
rium on issuance of building permits on the C-2 property at the
southeast corner of Adams Avenue and Brookhurst Street until
the City Council takes action on the resolution of intent pro-
posed by the Commission for rezoning of said property from C-2
to C-4.

THE RESOLUTION WAS ADOPTED
ZONING STUDY - SOUTHWEST CORNER OF GARFIELD AND BROOKHURST
The Acting Secretary made a presentation
and reviewed the zoning pattern at the southwest corner of
Garfield Ave. and Brookhurst St.
This information was presented at the
request of Commissioner Porter, of his concern with properties
being rezoned as a condition of a conditional exception and
development never taking place.
Mr. Harlow informed the Commission that
the staff feels that the existing zoning pattern does not
create incompatibility between uses.
It was the consensus of the Commission
not to initiate a resolution of intent to rezone the sub-
ject property; but in the future, when the Commission re-
quires rezoning of a parcel of land as a condition of
another application, the rezoning should not be processed
until construction of the project is under way,
PLANNED RESIDENTIAL DEVELOPMENTS:
The Acting Secretary stated that this
item was continued from the Study Session to allow time for
interested citizens to discuss proposed changes with the
City Attorney's office, It was noted that all the changes
have not been discussed.
It was the consensus of the Commission
to continue this item to the December 16th meeting.
DISCUSSION - CENTRAL CITY PARK:
The Acting Secretary informed the Comm-
ission that the City Administrative office has requested the
Planning Commission to rezone the Huntington Central Park
R-A - Residential Agriculture or Civic Facility Zone,
Commission discussion followed.

A PUBLIC HEARING.

COMMUNICATION:
The Acting Secretary read a letter sub-
mitted by the City of Newport Beach, requesting that the Comm-
ission initiate rezoning on their property located in the
vicinity of Bushard Street and Hamilton Ave.

A MOTION WAS MADE BY BAZIL AND SECONDED
BY PORTER TO INSTRUCT THE SECRETARY TO SET A ZONE CHANGE OF
ZONING THE SUBJECT PROPERTY FROM R-A-O TO R-A FOR A PUBLIC
HEARING AS REQUESTED BY THE CITY OF NEWPORT BEACH.

THE MOTION CARRIED.
COMMISSIONER DUKE:
Commissioner Duke suggested that the staff
investigate a method to screen the view of trailer parks from
public streets due to the unsightly appearance they present
from the street.
COMMISSIONER PORTER:
Commissioner Porter suggested that the
staff look into possible zoning pattern at the northwest
corner of Atlanta Avenue and Newland Street, also the zon-
ing of property on the west side of Golden West Street,
900 feet south of Warner Avenue.
